RELEASES, AUTHORIZATIONS, AND WAIVER OF LIABILITY

 

NOTICE: Please read the following carefully, as you may be giving up rights and protections you may otherwise be afforded. There are numerous activities that you will be able to participate in while at GREAT ESCAPES PELAHATCHIE MANAGEMENT LLC, D/B/A JELLYSTONE PARK™ PELAHATCHIE (“Campground”). This Assumption of Risk, Authorization and Waiver of Liability and Release Agreement (“Agreement”) contains important information and releases. If you have any questions or do not understand this Agreement, please consult legal counsel. By signing this Agreement, you are giving up substantial rights you may ordinarily be afforded.

 

I wish to camp at JELLYSTONE PARK™ PELAHATCHIE and participate in the activities offered at the Campground. I understand that I will be involved in camping and activities with the risk of injury or death or damage to personal property. I acknowledge that I am knowingly and voluntarily participating in camping and activities which give rise to these risks including, but not limited to: building and maintaining campfires; staying and being outdoors; campfires or fires in general; dangerous animals or insects; weather related incidents; bodies of water on or around the grounds; use of pools; outdoor terrain and dangerous vegetation; recreational amenities; and the use of knives, hatchets, axes, and saws. I acknowledge that I have read the following Agreement and agree to its terms and conditions. If I am signing on behalf of a minor, I consent that I am the parent or legal guardian of said minor.

 

I understand that part of the amenities at JELLYSTONE PARK™ PELAHATCHIE is the Aquatic Facilities, provided by JELLYSTONE PARK™ PELAHATCHIE. Such facilities include equipment and activities, such as, but not limited to, aquatic facilities, hayrides, playground and jumping pillow, sports courts, and more. I am voluntarily assuming the risk associated with such activities, and understand that I will be held liable and accountable for any injury or damage(s) arising from engaging in such activities, even if they result from negligence on behalf of JELLYSTONE PARK™ PELAHATCHIE, or its agents, employees, designees, etc.

 

Further, I understand and agree that should I engage in ANY aquatic activity, life vests must be worn at ALL TIMES.

 

RELEASE OF LIABILITY AND ASSUMPTION OF RISK: I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES ARE POTENTIALLY AND INHERENTLY DANGEROUS ACTIVITIES THAT INVOLVE THE RISK OF SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF GREAT ESCAPES PELAHATCHIE MANAGEMENT LLC, D/B/A JELLYSTONE PARK™ PELAHATCHIE. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE ACTIVITIES WITH AN EXPRESS UNDERSTANDING OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITIES, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE CAMPGROUND OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, HAZARDS ARISING FROM STAYING AND BEING OUTSIDE, INJURY OR DAMAGE ARISING FROM CAMPFIRES OR FIRES IN GENERAL, DANGEROUS ANIMALS OR INSECTS THAT MAY BE FOUND IN THE AREA INCLUDING BLACK BEARS, INJURY OR DAMAGE ARISING FROM ANY WEATHER RELATED INCIDENTS, INJURY OR DAMAGE THAT MAY ARISE FROM ANY BODIES OF WATER ON OR AROUND THE GROUNDS, INJURY OR DAMAGE THAT MAY ARISE FROM THE OUTDOOR TERRAIN AND THE DANGEROUS VEGETATION LOCATED ON SUCH, AND ANY INJURY OR DAMAGE THAT MAY ARISE FROM ANY RECREATIONAL AMENITIES AND ACTIVITIES THAT MAY BE ENGAGED, INCLUDING ANY WATER RECREATIONAL EQUIPMENT OR ACITIVIES. I hereby waive, release, and forever discharge Great Escapes Pelahatchie Management LLC, D/B/A Jellystone Park™ Pelahatchie, its affiliates, managers, members, agents, attorneys, employees, staff, volunteers, heirs, executors, administrators, representatives, predecessors, successors, and assigns from any claims resulting from physical or personal injury, pain, suffering, illness, disfigurement, temporary or permanent disability, loss or death, and any property damage that may occur caused by fire, theft, vandalism, accidents, natural events, or any other occurrences or mishaps. I am here at my free will, and entirely at my own risk. I understand that these injuries or outcomes may arise by my own or others’ negligence, conditions on the Campground, or related to travel to and from the Campground. Nonetheless, I assume all related risks, both known and unknown. Great Escapes Pelahatchie Management LLC, D/B/A Jellystone Park™ Pelahatchie is not responsible for errors, omissions, acts, or failures to act pertaining to any party or entity conducting a specific event or activity. I fully understand that this is a release of liability that waives certain rights I possess. I agree to voluntarily give up, or waive any right that I otherwise have, to bring legal action against Great Escapes Pelahatchie Management LLC, D/B/A Jellystone Park™ Pelahatchie for any personal injury or property damage whatsoever for negligence on the part of Campground, its agents, and employees. This waiver and release of liability shall remain in effect for the duration of my presence at the Campground.

 

INDEMNIFICATION: I further agree to indemnify, defend, and hold harmless Great Escapes Pelahatchie Management LLC, D/B/A Jellystone Park™ Pelahatchie, and all related agents, entities, and employees, against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney’s fees and any other related costs, including the costs of enforcing any right to indemnification under this Agreement, and the cost of pursuing any insurance providers incurred by or awarded against the Campground, and all related agents, entities, and employees, in a final non-appealable judgment, arising out of or resulting from any claim of a third party related to my participation in the Activities, including any claim related to my own negligence or the ordinary negligence of the Campground.

 

MEDICAL TREATMENT: I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activities. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless the Campground from any claim based on such treatment or other medical services.

 

ENTIRE AGREEMENT: This Release constitutes the sole and entire agreement of the Campground and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction.

 

CHOICE OF LAW AND FORUM: This Release is binding on and shall inure to the benefit of the Campground and me and their respective successors and assigns. All matters arising out of or relating to the making or performance of this Release whether sounding in contract, tort or statute shall be governed by and construed in accordance with and enforced under the internal laws of the State of Mississippi including its statute of limitations and Mississippi Code Title 15 Chapter 1 without giving effect to any choice or conflict of law provisions thereof to the extent such principles or rules would require or permit the application of the laws of any jurisdiction other than those of the State of Mississippi. Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in the area the Campground is located in and I hereby consent to the exclusive jurisdiction of such courts.

 

CAMPING RULES & REGULATIONS: See and Fully Read Attached Campground Guidelines for a Great Stay. I certify that I read and fully understand the Campground Rules, Policies & Regulations. I certify that me, any family member, and/or guest will follow the rules and procedures outlined. I understand that failure to abide by the Campground Rules, Policies & Regulations will result in the immediate removal of me, any family member, and/or guest from the grounds. I understand that the Campground Rules, Policies & Regulations are subject to change at the discretion of Campground without notice. I understand that it is my responsibility to request a newly updated version of such Campground Rules, Policies & Regulations for viewing.

 

I agree that before signing: I am at least 18 years of age. I am competent to contract in my name or contract on behalf of a minor for which I am the parent or legal guardian. I read this document in its entirety. I fully understand the contents, meaning, and impact of this document. I understand that I am giving up substantial rights by signing this document. I agree that I am signing this document freely and voluntarily without inducement.

PHOTO RELEASE

This document is legally binding and an enforceable contract between Great Escapes Pelahatchie Management LLC, D/B/A Jellystone Park™ Pelahatchie (hereinafter referred to as “Campground”) and the undersigned (hereinafter referred by the use of the pronouns “I” or “me”).

 

I hereby grant Campground permission to use my image and likeness (photographs and/or videos) in which me, any family member, or guest appear for any of its public displays such as but not limited to websites, social media, and advertisement prints, without payment or any other consideration. I hereby irrevocably authorize the Campground to edit, alter, copy, exhibit, publish, or distribute these photos/video for purposes of publicizing the Campground or for any other lawful purpose of Campground. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein I appear. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo/video. I hereby hold harmless and release and forever discharge the Campground from all claims, demands, and causes of action which me, my heirs, representatives, executors, administrators, or any other persons acting on my behalf, on behalf of an estate, or may have by reason of this authorization. It is the responsibility of the registered Licensee to inform their guests of this photo use policy.

Campground Guidelines for a Great Stay

At Jellystone Park™ Pelahatchie, our guests are known for their kindness, courtesy, and spirit of fun. Whether you're here for the weekend or the whole season, these shared standards help create the safe, clean, and family-focused experience we're proud of.

Wristbands

  • All guests must wear the park provided wristband. This shows us you’re a registered guest.
  • You will not be allowed access to our amenities & attractions if you are not wearing your wristband.
  • Guests without wristbands may be asked to leave, since we won’t be able to confirm they’re part of the fun.

Golf Carts

  • Golf carts must be picked up during office hours. There will be no reimbursement for carts not picked up until the next morning.
  • Golf carts can only be picked up by the person whose name is on the reservation.
  • Drivers of the golf carts must be 18 years old with a valid license and listed on the waiver.

Campfire Fun Done Right

  • Fires are welcome in the designated rings provided at each site.
  • We keep it cozy, not crazy — bonfires or oversized flames are not permitted.
  • Fire bans may go into effect during very dry conditions, based on guidance from local authorities. If this is the case, we will inform you upon arrival.
  • Firewood is available for purchase at the Ranger Station — please don't bring outside wood. This is to help protect our trees! Hauling firewood, even a short distance, is a common way for invasive species to infest new locations.
  • Color flame packs and fire starters are available at the Ranger Station to make your evening glow.

Sharing the Outdoors with Wildlife

  • Guests help protect the environment (and their snacks!) by storing food properly and keeping campsites clean.
  • Please don’t leave trash, food, or pet bowls outside overnight. Our staff will be around during open hours to pick up your trash.

Enjoy Responsibly

  • Adults over 21 may enjoy alcoholic beverages at their campsite.
  • If you’re walking around the park, please use a koozie or other non-descript container.
  • Glass containers aren’t allowed in or near aquatic areas — safety first!

Welcoming Visitors

  • Visitors are welcome and must check in at the Ranger Station upon arrival.
  • Fees may apply based on when they arrive and which activities they join.
  • Visitors are expected to follow all campground rules and depart by 10 PM.
  • Visitors must wear a park provided wristband while onsite.

Keeping it Clean

  • Gray water and black water must be emptied only at your site hookup or the dump station.
  • Hoses must be properly fitted to prevent leaks or spills.
  • Generators aren’t allowed; our full-hookup sites provide the power you need for a comfortable stay.

Family First — Always

  • Kids have the most fun when a trusted adult is nearby, especially at the pool, lake, playground, and activities.
  • Our guests always keep an eye on their little ones! Children under 16 must be accompanied by an adult at water attractions.
  • If your child is biking or scootering around the campground, helmets are a must and traffic rules apply.
  • Respect for others is a big part of the camping experience — our guests are known for their friendly attitudes and family-centered fun.

Four-Legged Campers

  • All pets must be leashed and attended — no solo adventures, please. This applies to pets left outside at your site as well.
  • Remember to pick up after them to keep our park clean for all.
  • Limit two pets per site unless otherwise approved.
  • We do not allow pets on tent sites.
  • We kindly ask that pets remain outside of the pool and food service areas. However, they cannot be tethered without an attendant.

Service Animals

  • Service animals are permitted throughout the park, including in all public spaces.
  • While we love all pets, only animals that are individually trained to perform tasks for a person with a disability are considered service animals.
  • For everyone’s comfort, service animals should remain under control at all times — on a leash or harness, or under voice command if necessary.

Sites & Parking

  • For everyone's safety and enjoyment, please observe posted speed limits.
  • One RV or tent is permitted per site, with a maximum of 8 guests.
  • Park vehicles on the gravel pad if provided. Please don’t park in empty or neighboring sites.
  • Tents are only allowed in designated tent areas.
  • To keep things safe and serene, we don’t allow personal golf carts, fireworks, firearms, drones, metal detectors, or vehicle repairs.
  • Each site is only allowed 2 cars per site with the exception of the Lakeside Lodge, which is allowed 4 cars.

Arrival & Departure

  • Check-in starts at 4:00 PM, and check-out is by 11:00 AM.
  • Please no check-ins after 10 PM. If you need to arrive afterhours, call our front desk before closing time to make arrangements.
  • Prompt departures allow us to get each site clean and ready for the next guest.

Safety First in Emergencies

  • In the event of severe weather or emergencies, please head to a bathhouse or visit the Ranger Station for instructions. Please download the Jellystone Park app for up-to-date alerts.
  • Carry a flashlight when walking at night — it’s a helpful habit (and makes fireflies easier to spot!).

Fishing & Flags

  • You’re welcome to fish in our private lake without a license — just bring your gear and enjoy!
  • A valid Mississippi fishing license is only needed for the nearby public lakes, creeks, and the reservoir.
  • Guests may proudly display U.S., state, local, military, first responder, or Jellystone Park™ flags at their site.
