2.1 AGREEMENT 

**Please note, this Agreement is not effective until Campground has also signed the Agreement and returned the fully executed version to User. 

1. Parties. This is a site service agreement ("Agreement") between U1022 ("Campground") and <<Tenants (Financially Responsible)>>("User"). 

2. RV Site. Campground hereby provides services on Lot No. <<Property Address>> ("RV Site") of Campground's property. Campground has the right upon twenty-four (24) hours' notice to relocate User to a substantially equivalent Lot on Campground's property. 

3. Term. The term of this Agreement shall commence on the date written below <<Lease Start Date>>("Effective Date") and end on: <<Lease End Date>> (the "Initial Term"). Unless terminated by either party, after the expiration of the Initial Term, this Agreement shall automatically continue (check applicable box below): 

Park Rates and Other Charges. User shall pay Campground for use of the RV site $395 per month. This rate shall be paid in advance and without demand beginning on the Effective Date of this Agreement and thereafter: per week or per day or extended stay. All payments are due and to be made payable to Campground at the address provided below. The rate for use of the RV Site may be increased by giving advance notice to User. If, on the day after the due date, User has not paid the total amount due under the terms of this Agreement, User will pay Campground an initial late fee charge equal to $40.00 Flat Fee on the 5th of the month and additional late charges of $15.00 per day thereafter until rent and late charges are paid in full. Campground will not accept partial payments. 

Failure to pay will result in your RV being towed off the American RV Park Premises. 

4. Electric Utility. Users shall pay Campground, in accordance with schedule for payment of a rate checked in Paragraph 4, above, all electrical power charges used by User in connection with the use of the RV Site. This amount is $0.11/kWh plus tax and is calculated by Campground according to TEX. UTIL. CODE § 184.034.

Should electric company increase their rates, Campground has the right to match the rates and charge guest accordingly. Monthly rates do not include electric and will require a $75.00 refundable electricity deposit that will be applied to last month's electric bill. If, at any time during the term of this Agreement, User becomes delinquent in the payment of electric services, Campground shall withhold electric services until User pays the delinquent amount, pursuant to TEX. UTIL. CODE § 184.036. 

All utility payments are due upon receipt of bill. Payment is considered late after 3 days. Notices will be posted on your door the 4th & 5th day. Electricity will be turned off on day 6. No Exceptions. There will be a $15 fee to turn the electricity back on. 

Failure to pay will result in your RV being towed off the American RV Park Premises. 

5. Rules and Regulations. User and their guests, invitees and all occupants shall comply with the written rules and regulations provided to User. User agrees to comply with all state and federal laws, rules, ordinances, and regulations applicable to Campground's property. 

6. Campground's Right to Terminate Agreement. Campground may terminate this Agreement for any or no reason by providing User a notice for User to leave the RV Site ("Agreement Termination Notice"). User agrees to render peaceful possession of the RV Site to Campground within three (3) days of the date provided on the Agreement Termination notice. The three (3) days' notice shall not be required if termination is the result of an Act of Default (as defined below). Upon User's peaceful surrender of the RV Site to Campground, Campground will refund to User the proportionate amount of any unused amounts previously paid by User to Campground. 

7. Early Termination by User. Campground may recover as damages for User's early termination of this Agreement an amount equal to the amount that remains outstanding for the term of this Agreement. 

8. Default by User. The following acts constitute defaults by User ("Acts of Default"): 

a. Failing to timely pay the RV Site use rate, outlined in Paragraph 4, above, or other lawful charges when due under this Agreement; b. Giving false information to Campground; 

c. User, User's guests and/or occupants failing to comply with this Agreement, such as violating provisions of this Agreement or committing serious misconduct or criminal acts; 

d. Remaining on the Property after giving notice of termination and intent to vacate; and/or 

e. Remaining in the Property after Campground gave notice of termination at the end of the term or an Agreement Termination Notice, outlined in Paragraph 7, above. 

9.Condition of RV Site. By executing this Agreement, User acknowledges and agrees that the RV Site is in good condition and is adequate for User's use. Upon termination or expiration of this Agreement, User agrees to surrender the RV Site to Campground in a similar, good condition. If User fails to leave the RV Site in good condition, Campground will assess reasonable charges to User for returning the RV Site to good condition. 

10. Assignment. User shall not have the right to assign or sublet the RV Site hereunder to any person or persons. 

11. Attorneys' Fees. In the event any legal proceedings of any kind are instituted to collect unpaid rates, as outlined in Paragraph 4, above, or electrical charges. Campground may collect from User all reasonable costs and attorneys' fees incurring by Campground in pursuing such action. 

12. Waiver. Campground's failure to insist on strict compliance with the terms or conditions of this Agreement shall not be deemed a waiver of that term or condition, nor shall any waiver or relinquishment of any right or power at any one time or times be deemed a waiver or relinquishment of the right or power for all or any other items. 

13. Notices. All written notices and communications regarding this Agreement, including notices sent pursuant to TEX. PENAL CODE § 31.04(c), should be sent to the designated undersigned persons at the addresses as set forth below unless notified in writing to the contrary by the receiving party. The notice shall become effective as of the date of mailing by certified mail.

14. Pets. If Campground allows User to have pets on the property, User is responsible for the pet's behavior, waste, and noise level. User agrees to clean up after his or her pet and to be considerate of other RV park guests. User is liable for any damage or injury caused by his or her pet. Pets must be on leash at all times and cannot be left outside unattended. 

15. Credit Card on File. User will provide Campground with information for a valid credit card to keep on file. The credit card information will be used by Campground in the event that Campground must charge User for cleaning and repairing the RV Site, as outlined in Paragraph 10, above, or if User vacates the RV site without paying Campground the total amount due under this Agreement. If Campground uses the credit card information for the reasons described above, Campground will provide User a statement of account listing the charges at the address noted below. 

16. Severability. If any provisions of this Agreement is held illegal, void, or unenforceable in judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Agreement shall remain operative and binding on the parties. 

17. NO PUBLIC SEX OFFENDERS 

NO LIABILITY. TO THE EXTENT PERMITTED BY LAW, USER HEREBY INDEMNIFIES, RELEASES AND AGREES TO PROTECT, AND HOLD HARMLESS CAMPGROUND, ITS OFFICERS, OWNERS, EMPLOYEES, AND AGENTS ("CAMPGROUND PARTIES"), FROM AND AGAINST ALL CLAIMS CAUSES OF ACTION, AND/OR LIABILITY ARISING OUT OF OR RELATED TO USER'S USE OF THE RV SITE, CAMPGROUND'S PROPERTY, AND/OR ANY CONDITION THEREON, WITHOUGH LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF OR THE GROSS NEGLIGENCE OF CAMPGROUND PARTIES. 

19. This Agreement provides User with a revocable license to the property, which may be revoked at any time for any reason 

20. This Agreement becomes effective only when Campground has signed the Agreement and returns it to User. By initialing below, you acknowledge and agree to the terms in Section 2.

3. Part C 

3.1 THEFT OF SERVICE AND CRIMINAL TRESPASS 

ACCORDING TO TEXAS PENAL CODE SECTION 31.04, a person commits theft of service if, with intent to avoid payment of service that the actor knows is provided only for compensation, the actor intentionally or knowingly secures the performance of the service by agreeing to provide compensation and, after the service is rendered, fails to make full payment after receiving notice demanding payment. "Intent to avoid payment" is presumed if the actor absconded without paying for the service or expressly refused to pay for the service in circumstances where payment is ordinarily made immediately upon rendering of the service, as in recreational vehicle parks. That is, any guest who leaves without paying for site services or who refuses to pay for site services when due may be subject to criminal prosecution. We will prosecute any violations under the "THEFT OF SERVICE LAW." 

ACCORDING TO TEXAS PENAL CODE SECTION 30.05, a person commits an offense if the person enters or remains on or in property of another, including a recreational vehicle park, without effective consent and the person had notice that the entry was forbidden, or received notice to depart but failed to do so. That is, any guest who received notice to leave and refuses to do so may be subject to criminal prosecution. If we ask you to leave, you must vacate Campground's property. We will prosecute any violations under the "CRIMINAL TRESPASS LAW."

4.1 RANCH RULES AND GUIDELINES 

American RV Park 

Ranch Rules and Guidelines 

Please read the information below carefully and sign this form acknowledging you have read, understand, and agree to the rules outlined below. Guests of the American RV Park, including tenants in the rental homes and tiny homes, are responsible for their visitors follow the rules also. 

PARK 

• Your “yard” is the area directly outside your RV entry door. Please do not put anything in the area behind your RV or in the grass on the side you hook up. 

• Sites must remain neat and tidy. No cigarette butts on the ground. Do not use clear totes to store items outside your RV. We do not want to see your closet, pantry items, cases of soda/water, totes with shoes/ clothes, laundry detergent, dog food, etc. 

• Please do not dig holes of any kind without permission from management. Our sites have shallow lines for the sewer, cable, etc and you could cause serious damage by hitting one of these lines. • Pole mounted, in-ground satellites or cable systems are strictly prohibited. You may use temporary mounts on the site pad/pedestal pad or mount to your RV. 

• Clotheslines are prohibited. 

• No smoking in any of the buildings. 

• Fireworks are prohibited everywhere in the ranch and surrounding fields. 

• We strongly recommend you do not put up any structure like a canopy or pergola due to the excessive wind we experience here at the park. Same for outdoor decorations. Please be aware that any damage caused to a vehicle or RV by these objects are solely your responsibility. Most RV insurance will not cover this since it is outside the RV and not connected to the RV. We reserve the right to not allow any structure/decoration that is not aesthetically complimentary to the park or is found offensive in a family friendly park. 

• Anything placed in grass may prevent us from property mowing/weed eating. In that event, you will be responsible for maintaining the grass area of your site. 

• Keep bicycles, toys, and miscellaneous items stored in a tidy manner. Cigarette butts, bottle caps, etc should be placed in trash. 

• Generators are not allowed at any time, unless there is a power outage. 

• Quiet hours are from 10 PM to 8 AM, 7 days a week. Please monitor the sound level of your children and pets as well as no playing of games like corn hole or others that create a loud noise. Wind chimes should be put away during this time as well. 

• At dark or 9 PM, whichever comes first, all bikes, scooters, and children must be on their own site. • Children must be supervised at all times. 

• Children are not allowed to loiter in any buildings without an adult. Not in the laundry rooms, vending machine room, etc. 

• Please do not walk or drive through and/or between RV sites that are not assigned to you. • Charcoal and gas grills are permitted on pad site. 

• Fire pits/Chimineas must be extinguished properly before retiring inside your RV. • A/C Window units are not allowed 

• No hot tubs allowed. 

• Holiday decorations must be removed within 2 weeks of the holiday.

MAIL 

• You should not use the American RV Park address as your primary address to receive mail. Please set up a PO Box at the post office or use an alternative address. (Rental Houses use your street address.) Do not give this address to family and friends to mail you items and always provide an alternate mailing address when someone need a physical address such as an insurance carrier, etc. 

• UPS, Fed Ex and Amazon Prime will deliver directly to your lot. Always include your lot number. • If any mail is received at the office, we will hold it until your come to the office to retrieve it during office hours each day. Mon-Fri 8:30AM-5PM 

TRASH 

• Trash bags are not to be left outside at any time. Please dispose of your trash in the dumpsters located directly west of the front gate at the 98th Street location and located directly south of entrance at the 1585 location. 

• Please use trash bags and not throw loose garbage inside the dumpster. 

• Glass bottles MUST be inside trash bags. 

• Please break down all boxes 

• The dumpsters are for the American RV Park guests and not for the general public. Throwing away materials and trash from your job site is prohibited. 

• Do not place any furniture, mattresses, appliances, etc in or near the dumpsters. 

SPEED LIMIT, VEHICLES, TRAILERS AND PARKING 

• The speed limit in the park is 10 mph. Please watch for children. 

• No parking on any sites other than the one assigned to you. 

• All vehicles must fit on the site pad and may not be parked on the grass or protrude into the flow of traffic. • All vehicles must have current registration and be in working order. 

• No repair work is to be done on any vehicles in park excluding RV contractors 

• No Non-RV trailers are allowed in the ranch. This includes boats on trailers, flat bed trailers, etc. • Car dollies pulled by motor homes can be on lots but must not block the road nor be pushed into the grass areas 

• Only electric golf carts are permitted in the park. Gas powered golf carts, ATV/UTVs are not allowed at any time. Golf cart drivers must be licensed and the golf cart must be insured for liability. 

LAUNDRY ROOM/SHOWERS 

• DO NOT wash pet blankets or towels in the laundry room. Many people are allergic to pet hair and we ask for your consideration in this matter. If your pets sleep in your bed, please wash the bed linens at another location. 

• Do not leave clothes in washer or dryers longer than the cycle run time. Contents of washers/dryers may be removed if owner has not unloaded 20 minutes after the cycle time has ended. Set your alarm! • Please wipe out the washers and remove lint from the dryers after you use them. 

• Do not overload washers 

• Report any issues with washers/dryers at the office. 

• No animals are allowed in Laundry Room 

PETS/DOGS 

• DOGS, (and any other pet) while outside, MUST BE ON A LEASH AND UNDER THE CONTROL OF THE 5

OWNER/HANDLER AT ALL TIMES. (Children must be able to maintain control of the dog and pick up the dog waste if they are walking a dog.) 

• Dogs are NEVER to be left outside tethered or in a kennel, unattended. 

• YOU MUST CLEAN UP AFTER YOUR DOG IMMEDIATELY AFTER THEY POOP. DOG WASTE STATIONS ARE LOCATED AROUND THE PARK FOR YOUR CONVENIENCE. 

• No dog should disturb others with barking, inside or outside the RV 

• Do not feed stray cats, dogs, or other animals. 

• No pets of any kind are permitted in the buildings. 

SECURITY 

• For an EMERGENCY please call 911 before contacting park staff. 

• If law enforcement is called to a disturbance at your site, you will be evicted with no refunds. WHEN IN DOUBT, PLEASE CALL US AND ASK. (806) 407-2106

5. Part E 

5.1 RULES AND REGULATIONS 

Payment Policy: You must have deposit and first month payment paid prior to moving into your lot. You will be able to set up your credit card in the Tenant Portal. Everything must be paid through the tenant portal, money order, or cash pay slip. Money orders payable to U1022 can be brought to the office or put in the drop box on the east side of the office building. No personal checks are accepted. Failure to pay will result in your RV being towed off the American RV Park Premises. 

Late Payment Policy: Rent is due on the 1st of every month. You have until the 4th of every month to pay, then your electric boxes will be locked. After that if account is still delinquent on the 6th, a towing company will be called, and your RV will be towed away at your own expense. All utility payments are due upon receipt of bill. Payment is considered late after 3 days. Notices will be posted on your door the 4th & 5th day. Electricity will be turned off on day 6. No Exceptions. There will be a $15 fee to turn the electricity back on. Failure to pay will result in your RV being towed off the American RV Park Premises. 

RV Policy: There is no age restriction on the RVs, however, if it is an older RV, it must be approved by Park Staff. Unit must be street legal. The following items may result in an RV not being permitted into the park. Damage to the exterior of the unit, broken windows, rust holes, mold, mildew, offensive graphics, makeshift repairs using tape, 30/50-amp plug must be in safe working condition, sewage lines must be connected properly with no leaks. 

Lot Cleanliness and Appearance: RV Park Staff will perform and inspection prior to move in, and periodically throughout your stay. Lot cleanliness is required for aesthetic, sanitary and safety purposes. Your site must be kept litter free including cigarette butts. All trash is to be placed in Park dumpsters immediately. No fences at all. Decorations for holidays are permitted if they are not disruptive to other campers and are within the site perimeters. Items that are permitted at assigned lots include: lawn chairs, picnic table, Barbecue Grills, and decoration

if agreed on by Park Staff. Everything else will have to be approved by Park Staff. Staking into gravel is not permitted. It is at the discretion of the Park Staff to determine whether a Lot complies. DO NOT MAKE ANY CHANGES TO THE RV SITE WITHOUT PRIOR WRITTEN CONSENT FROM PARK STAFF. 

Campsite Occupancy: Each Lot is limited to (1) camping unit and 2 additional units (Vehicles, motorcycles, trailers, etc.) Guests are to park away from Park. 

Campground “quiet time”: A period of quiet time will be from 10pm-8am. This includes no loud vehicles, no loud music, no loud generators. 

Campground Guests: Guest must park their vehicles away from the park if the lot already has 2 other units parked. Campers will be held Responsible for the actions, behavior, and damage caused by guests. 

Notice to Vacate: Park Staff reserves the right to refuse camping and to have any guest removed with or without prior notice for violation of rules. Failure to comply with a demand of vacating will result in RV being towed off at the guest’s expense. 

Parking: Vehicles must be parked in parking area assigned to your specific lot. 

Firearms: No display, discharge, or possession of a firearm, knife, or any other weapon in any way that may alarm others is allowed. 

Behavior/ Public Intoxication and illegal drugs: Illegal drugs and public intoxication will NOT be tolerated under any circumstances and will result in the notification of police and immediate notice to vacate without any refund of fees paid. Loud, obnoxious, disorderly, or unlawful conduct or conduct that disturbs or threatens the rights, comfort, or convenience of others in or near the park will NOT be tolerated. Violence or threat of violence will not be tolerated. 

Move Out: After moving out, your property will be assessed for any damages and trash, if Park Staff finds any damages or trash an additional Clean up Fee could be charged to your account. 

Prorated Move Out Rent: If you chose to move out in the middle of a month, your original payment of rent will not be prorated and refunded. 

FAILURE TO COMPLY WITH ALL RULES WILL RESULT IN THE TERMINATION OF THE SITE SERVICES AGREEMENT AND WILL REQUIRE YOU TO VACATE THE RESORT AND PROPERTY IMMEDIATELY, refunds will not be given.
