Blue Oak RV PARK 

RENTAL AGREEMENT

This rental agreement is made on the _________________________, for a term not to exceed 3 months.  It will be the tenant’s responsibility to visit the office at the end of this term and provide notification that they will be renewing the rental agreement.  Tenants are required to execute a new rental agreement every 3 months, between Blue Oak RV Park, with its principal office located at 103 Rowland Lane, Kerrville, Texas 78028, referred to herein as Lessor, and (Lessee-Guest) referred to herein as Lessee.

Lessor leases to Lessee and Lessee leases from Lessor, for the term of this rental agreement, RV Spot #___ of the Blue Oak RV Park and being hereafter referred to as RV Spot (whether one or more), and pursuant to the following terms and conditions:

  • Rent: Lessee agrees to pay as rental minimum $20.00 per day for RV spot(s) beginning ________________through____________________ payable without demand, either by cash or check on the FIRST of each month.  Monthly rental is $_____________. 
  • Utilities:  Lessor shall pay for all water, electricity, limited internet.  Utility use is restricted to one RV unit per site.
  • Assignment and Subletting: Lessee shall not sublet the RV spots, or any part of the Premises, or assign this rental agreement without Lessor’s prior express and written consent.
  • Default: Any failure by Lessee to pay rent or other charges promptly when due or to comply with any other term or condition of this agreement shall, at the option of Lessor, promptly terminate this tenancy and forfeit all rights of Lessee under this rental agreement.
  • Maintenance and Redelivery of RV Spot: Lessee shall keep and maintain the RV Spot in a clean and sanitary condition at all times, and on the expiration or earlier termination of the tenancy shall surrender the RV Spot to Lessor in as good condition as when received, ordinary wear and tear and damage by the elements excepted.
  • Effect of Holding Over: The parties agree that any holding over (if the renter fails to vacate the RV Spot after the expiration of the rental agreement, then they are considered a 'holdover' tenant) by Lessee under this rental agreement, without Lessor’s written consent, shall be a tenancy at will, which may be terminated by Lessor in accordance with applicable law. Lessee will receive a 3-day notice to vacate the premises; if Lessee does not vacate within the 3 days, eviction proceedings will be filed with the County Court for referral to the Sheriff’s Department.
  • Blue Oak RV Park has the legal right to refuse or revoke service at any time under Texas Penal Code 30.05(a).  Blue Oak RV Park reserves the right to re-evaluate up to one year of Extended Stay with us.  At the one-year time, Blue Oak RV Park will then make a decision upon reviewing the age and condition of the RV and that the outside site area is maintained.  BLUE OAK RV PARK RESERVES THE RIGHT TO ENFORCE THE RULES AND REGULATIONS IT HAS SET FORTH.  SHOULD YOU NOT ABIDE BY THE RULES AND REGULATIONS, IT MAY RESULT IN YOUR BEING ASKED TO VACATE YOUR RV SITE.
  • Indemnification: Lessee shall indemnify, defend, and hold Lessor harmless from any and all claims and damages (including reasonable attorney’s fees and costs) arising from Lessee’s use of the RV Spot or from any activity permitted by Lessee in or about the RV Spot unless caused by the gross negligence or willful misconduct of Lessor. Lessee shall further indemnify, defend, and hold Lessor harmless from any and all claims and damages (including reasonable attorney’s 

fees and costs) arising from any breach or default in the terms of this agreement or arising from any act, negligence, fault, or omission of Lessee and from and 

against any and all costs, reasonable attorney’s fees, expenses, and liabilities incurred on or about such claim or any action or proceeding brought on such claim. In case any action or proceeding shall be brought against Lessor by reason of any such claim, Lessee, on notice from Lessor, shall defend it at Lessee’s expense by counsel approved in writing by Lessor.

  • Mandatory Arbitration: Any dispute under this rental agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
  • Governing Law: This rental agreement shall be governed by, construed, and enforced in accordance with the laws of the state of Texas.
  • Waivers: Waiver by Lessor of any breach of any covenant or duty of Lessee under this agreement is not a waiver of a breach of any other covenant or duty of Lessee, or of any subsequent breach of the same covenant or duty.
  • Counterparts: If this rental agreement is executed in multiple counterparts, all counterparts taken together constitute this agreement. Copies of signatures to this rental agreement are effective as original signatures.

RV Park Rules

  • QUIET TIME: General quiet time for park residents is 10 p.m. to 7 a.m.  Tenant understands that an active restaurant with live entertainment and music is located on the property.  Accordingly, music and restaurant-associated noise levels are to be expected.  Please be considerate of others. No loud music at any time is permitted. Blue Oak RV Park reserves the right to conduct SPECIAL EVENTS within the entire complex. Event notifications will be posted on Facebook and on the restaurant’s marquee.
  • CHECK-OUT TIME IS 1:00 P.M. Due to previous reservations, if you plan on staying longer, the earlier you re-register, the better your chance of keeping your site. Lessor reserves the right to relocate the Lessee to another RV Spot in the event of service or construction/development plans that may occur during the term of this rental agreement.  All attempts will be made to maintain Lessee’s convenience. 
  • SPEED LIMIT: Please observe a speed limit of no more than 5 mph.
  • SEWER: Sewer connection – a positive sewer seal at both ends of sewer hose is required. Texas law requires that a sewer hose must be fastened using a connector or a rubber donut.
  • CHILDREN: We want children to be safe and have a good time, but always under the watchful eyes of a parent/guardian. We are not responsible for children’s safety or welfare. You are liable for their behavior. NO LIFEGUARD ON DUTY. Children must be accompanied by an adult at all times.
  • PETS: Please maintain control of your pets. The limit is for only 2 pets allowed on a leash. Owners must clean up after their pets. Do not leave pets tethered on a leash or chain or in a pen outside overnight or when you are absent. Absolutely no pets other than service animals are allowed in the office or laundry! The same rules apply for cats as well as for dogs. Cats are inside pets only. If outside, they must be on a leash with the owner at all times. These rules are for health reasons as well as respect for others. NO AGGRESSIVE-BREED DOGS ARE ALLOWED IN THE PARK including Pit Bulls, Rottweilers, German Shepherds, Huskies, Alaskan Malamutes, Doberman Pinschers, Chow Chow, Presa Canario, Boxers and Dalmations.
  • TRASH: Dumpster located in the park is for personal household trash only. Absolutely no construction trash allowed.  All trash must be bagged and tied.  Boxes are to be broken down. DO NOT leave trash outside by your RV. 
  • CLEANLINESS:  Cleanliness of the park is important to us. Sites are to be kept clean and orderly, as determined by management. Please leave the Laundry Facility as you would like to find it. If the Laundry Facility is in need of attention or repair, please notify the manager. 
  • VEHICLE REPAIR/MAINTENACE:  On any vehicle or RV, mechanical repair, (oil changes, etc.) or cosmetic alterations, (painting, striping, damage repair, etc.), are strictly prohibited.
  • WASHING OF RIGS OR VEHICLES:  NOT PERMITTED.  You may use a mobile washing company provided they supply their own water.  We ask that your rig and vehicle be kept as clean as possible.  You will be advised if drought restrictions apply; no washing of sidewalks, watering of yards, etc.
  • Internet:   Limited wireless Internet is for our guests’ personal use.  Blue Oak Park is not responsible for the operations of this Service. Please do not be a “Bandwidth Bandit.”  Blue Oak RV Park reserves the right to block access to streaming bandwidth.  We provide free limited basic Wi-Fi that is good for emails, shopping and surfing the net only.  We are in the country where our service is a co-op and it is all that is available.   For any extensive internet experience, you may want to bring your own hotspot.
  • NO FIREWORKS ALLOWED. 
  • NO OPEN FIREARMS DISPLAYED.
  • PARKING: Only two vehicles per RV spot is allowed, if  your spot is large enough.  Do not block any portion of or park in the road, on the grass or in vacant spots.  Additional parking is available against the upper rock retaining walls.  Any additional vehicle must be approved by management.  If approved, vehicles will be charged $2.00 per day for storage.  Please park in the designated general parking spaces in the RV Park.
  • No boats, jet skis or trailers are allowed to be parked on your RV spot.  These items must be placed in the storage area or as approved or otherwise.
  • Additional overnight guests will be limited to maximum two guests for maximum two nights in your RV spot UPON PRIOR MANAGEMENT APPROVAL.   Tents are strictly prohibited on RV Spot.
  • CLOTHES LINES ARE NOT ALLOWED. 
  • ELECTRIC SPACE HEATERS ARE NOT ALLOWED. 
  • NO CHEATER BOXES OR PIGTAILS ALLOWED. TRIPPING THE MAIN BREAKER DUE TO EXCESSIVE USE OF ELECTRIC AND/OR SPACE HEATING EQUIPMENT WILL NOT BE TOLERATED.  Each RV Spot has a designated amperage capacity for normal use.  Blue Oak RV Park is not responsible for any electrical components on RVs.  The rate of $160.00 per service call to reset breakers due to a violation of this agreement will be billed to the Lessee.
  • CONDUCT: Disorderly conduct, drunkenness, illegal drugs, obscene language, obnoxious, disruptive, or vulgar behavior will not be tolerated and will be subject to immediate eviction without a refund.
  • DRUGS: Illegal drugs of any form are prohibited on the property of Blue Oak RV Park. Persons violating this rule are subject to immediate eviction without a refund.  Persons with knowledge of any illegal activity are encouraged to notify the management immediately.  All reported information will be held in the strictest confidentiality.
  • LIABILITY: All park facilities and park equipment is intended for the convenience of the guests. Any and all people using the facilities do it at THEIR OWN RISK and consent. 
  • NO LIFEGUARD ON DUTY
  • Blue Oak RV Park is NOT RESPONSIBLE for accident due to fire, theft, wind, flood, personal negligence, acts of God or other unfortunate circumstances. 
  • Tenant agrees to carry his or her own liability and comprehensive insurance and vehicle registration during the term of this rental period on their trailer/motorhome. 
  • The registered guest is financially responsible for all individuals or pets at their site for any/all damage to the park.
  • Personal items are not permitted to be stored under your rig.  
  • No porches or steps are permitted in the park (unless medically required) and must be approved by management in advance.  
  • No stepping stones or rugs on grassy areas is permitted.  Indoor/outdoor rugs or Astroturf is acceptable.  Please check with management before you install or lay down products in your RV spot.

These rules are for health, cleanliness, legality, and welfare of all.

MANAGEMENT RESERVES THE RIGHT TO EVICT OR REFUSE SERVICE TO ANY PERSON OR PERSONS WHO BREAK OR DISREGARD ANY RULES WITHOUT REFUND. MANANGEMENT RESERVES THE RIGHT TO REFUSE ANYONE. MANAGEMENT RESERVES THE RIGHT TO MAKE CHANGES TO THE RULES, REGULATIONS AND FEES WHEN NECESSARY.

We know most RVers to be some of the most helpful, honest, and kind people in the world with good common sense, needing no written rules, as they already honor the welfare and rights of others. These rules are to guide those who do not yet respect the property and rights of others.

THIS PROPERTY IS UNDER 24 HOUR VIDEO SURVEILLANCE.  EQUIPMENT IN USE IS TO AID IN THE PROSECUTION OF ANY CRIMES COMMITTED AGAINST THIS BUSINESS.
