CHINOOK RV PARK

TERMS AND CONDITIONS

A.        General:

  1. Prior to entering the Chinook RV Park (“the Park”), all Tenants must sign an RV rental agreement and agree to the Rules and Regulations of the Park (which, includes these Terms and Conditions). All Tenants and their Guests must be identified in the RV rental agreement. Any Tenant or Guest that are not “Vacation Occupants” shall be subject to a criminal and credit background check. There shall be one RV rental agreement per space (“the Space”). Visitors are welcome at the Space between the hours of 9 am & 10 pm, but they must first register at the office.
  2. Tenant shall not give accommodation to any guests for greater than fifteen (15) days in a sixty (60) day period without Management's prior written consent; any guest stays which exceed this timeframe must apply and be approved for occupancy prior to continuing their stay. For longer term tenants, no Space shall remain unoccupied by a Tenant for longer than (30) days without the approval of Management.
  3. For long term tenants, Management must be supplied with a copy of Tenant's ownership title of the recreational vehicle/trailer occupying the Space at Management's request along with the name of any lending institution(s) (or other entity or persons) who has a secured interest in the recreational vehicle/trailer Check-In Time: All Sites: 4:00 PM
  4. Check-Out Time: 11:00 AM. The front desk may be able to arrange a late checkout, if available. Additional fees may apply. In order to ensure availability for incoming guests, please plan prompt departures.
  5. Quiet hours are from 10:00 PM to 8:00 AM.
  6. Please be courteous to other guests around you.
  7. Loud music or objectionable noise is not allowed at any time.
  8. Inconsiderate guests will be evicted from park.
  9. Profanity or violence towards other guests or Resort staff will result in immediate eviction from park.
  10. Guests violating rules that results in eviction notice will not receive any refunds for their stay.

B.        Maintenance & Improvements.

  1. Tenant must maintain the Space and all vehicles, trailers at Tenant's sole expense in an orderly and clean manner and in good condition and repair, free from the hazards of fire and other casualty. Any damage or deterioration must be promptly repaired by the Tenant.
  2. Flower beds must be kept clean and free of weeds. Management maintains common areas.

 

  1. Tenant may not allow the accumulation of items on the Space. All trash, debris, garbage cans, brooms, ladders, furniture not intended for outdoor use, toys, and similar items must be properly stored and kept out of sight.
  2. Trash must be promptly placed in designated trash containers and may not be permitted to accumulate on the Space or anywhere in the Park.
  3. Tarps are strictly prohibited and may not be used anywhere on the Space or in the Park. Tent camping is not permitted (without written permission from Management).
  4. No types of pools are permitted on the Space or in the Park.
  5. Excessive yard decorations and flower pots are not permitted. Long-term Tenants may have up to two (2) well-maintained exterior flower pots in per space unless otherwise approved in writing by Management.
  6. Domestic water may not be used for irrigation purposes or for any exterior use such as car washing or filling containers.
  7. Gas grills are permitted but must be well maintained and turned off with gas off when not in use. Use of charcoal is prohibited.
  8. Tenant must immediately notify Management of any needed repair or damage to common areas.
  9. Management provides garbage containers and regular collection service. Do not recycle plastic bags, batteries, clothing, textile or fabric, Styrofoam, or frozen food boxes.
  10. Clothes lines are not permitted. Tenants should not hang anything from trees.
  11. Drones or other remote controlled machines may not be used at any time at the Park.
  12. Tenant may not permit the use of the Space for any purpose other than as a residence/vacation Space and as the location of one recreational vehicle or trailer. No business or commercial enterprise of any nature may be conducted by Tenant in the Park nor may advertising materials be distributed or posted with the Park without Management's prior written approval. However, community organized groups may distribute social news or materials of a non-commercial nature provided the material is also given to Management.
  13. Any product containing hazardous substances including, but not limited to petroleum products, oil, gasoline, paints, solvents, fertilizers, pesticides, and herbicides, shall be stored in closed containers that are in good condition and kept in manner to prevent leaking. Tenant shall not allow disposal of any hazardous substance on the Space or within the Park.

C.        Motor Vehicles.

1.         All recreational vehicles must be 10 years old or newer. One (1) vehicle is permitted per Space. For clarification, Tenant may have one vehicle (such as a car, van or truck) in addition to an approved recreational vehicle or trailer.

 

  1. Tenant must provide a license plate number for their vehicle. All other vehicles are subject to towing without warning.
  2. Vehicles must be operable with current registration and in good condition. Vehicles may not have a broken window, flat tire, or excessive or unsightly damage as determined by Management.
  3. Vehicles must be parked in specific areas as designated by Management. It is prohibited to park vehicles on grass, yards, common areas, fire lanes, storage areas, or any place that obstructs traffic or is unsafe.
  4. All drivers must observe speed limits and stop signs as posted, and may not exceed 10 miles per hour within the Park.
  5. Vehicle repairs may not be performed in the Park. Any oil, gas or other fluid drips must be repaired and cleaned immediately by Tenant.
  6. Recreational Vehicles may not be reasonably noisy or disruptive to others. No mechanical component of a RV may exceed 60 decibels when at the Community.
  7. Recreational vehicles, including trailers, RVs, and boats, may not be parked or stored in the Park unless preapproved in writing by management and subject to a separate agreement. Management may impose a $150.00 fee per month per recreational vehicle stored on the Park. Such fee is not a part of this rental agreement, but a separate, commercial agreement.
  8. The use of exterior generators is not permitted in the Park.
  9. Lighting shall not directly illuminate adjoining properties. Lighting sources shall be shielded and arranged so as not to produce glare in any public right of way, with a maximum illumination at the property line not to exceed an average horizontal foot-candle of 0.3 for non-cut-off lights, and 1.0 for cut-off lights

D.        Animal Policy.

Tenants are permitted to have up to one (1) well behaved domestic animal with Management's prior written approval and subject to the following rules and regulations:

  1. Animals are not permitted in the Park without Management's prior written approval. Temporary animal sitting or care of animals not owned by Tenant is not permitted without Management's prior written consent.
  2. Tenant is responsible for the immediate removal of all animal waste.
  3. Animals must be on a leash at all times when outside of Tenant's home. Animals may not be outside without the direct supervision of a responsible person.
  4. The following Breeds are not allowed in the Park: Pitbulls, Rottweilers, Chow, Akita, or any Wolf hybrid or mix.

 

  1. Animals shall not cause any sort of nuisance, injury, damage, or disturbance to other persons in the Park. Tenant shall be liable for any loss, damage claims, or liability, including attorney fees, directly or indirectly caused by Tenant's animal.
  2. All animals must be immunized and licensed according to the law.
  3. No animals may exceed 25 pounds.

E.        Safety.

  1. The use of firearms of any kind is prohibited in the Park.
  2. The use of archery, paintball, slingshots or air guns is prohibited.
  3. Fireworks of any kind are prohibited.
  4. Use of illegal drugs is PROHIBITED.
  5. Motorcycles must be in idle speed when traveling through the Resort.

F.         Property Loss, Insurance & Crime.

  1. Management shall not be liable for damage, theft, vandalism, or other loss of any kind to Tenant's personal property, unless such is due to Management's negligence or intentional misconduct. Management shall not be liable to Tenant for crimes, injuries, loss or damage due to criminal acts of other parties.
  2. Tenant is strongly encouraged to purchase an insurance policy that provides liability insurance for negligent or accidental acts and omissions for which the Tenant may be liable in causing injury or damage to Management or others. Tenant is also strongly encouraged to purchase property insurance for loss of or damage to Tenant's own personal property. Management is not liable for any loss or damages to Tenant's personal property due to theft, vandalism, bursting or leaking pipes, fire, windstorm, hail, flooding, rain, lightening, tornadoes, hurricanes, water leakage, snow, ice, running water, or overflow of water or sewage. Management shall not be liable for any injury or damage caused by such occurrences, and Tenant agrees to look solely to their insurance carrier for reimbursement of his losses for such events.
  3. Management does not market, advertise, represent, offer, or provide security or law enforcement services which will prevent crime or protect Tenant or Tenant's personal property. Management and the owner do not represent or guarantee that the Tenant is safe from crime in the Community. Tenant agrees to look solely to public law enforcement, emergency services, or fire services for police, emergency, fire, security, or protection services. Tenant acknowledges that he or she has an obligation to exercise due care for his or her own safety and welfare at all times and that Management is not liable to Tenant for the criminal acts of other persons. Tenant agrees that he or she will not and cannot rely on the existence or absence of security equipment or personnel as a representation of safety from crime and understands that he or she must be vigilant and exercise caution for their personal safety at all times. Tenant waives and releases Management for any liability, injury, loss, or damages related to crimes committed by other persons against Tenant or related to allegations that the Management was negligent or failed to provide security or protection to prevent crime.
