THEFT OF SERVICES LAW
According to Texas penal code section 31.04 (b), any guest who leaves without paying for site services rendered or who refuses to pay for site services when customarily due is subject to criminal prosecution. We are providing service hook-ups for your RV. We require payment in advance and will prosecute any violators under the “THEFT OF SERVICES LAW.”
PRIVATE PROPERTY
This property is privately owned. We reserve the right to refuse service to anyone. The camper & all associated guests accept camping privileges with the understanding that they hereby release the Campground, its Officers and employees of all liability for loss damage to property and injury to his/her person arising out of the use of the camping facilities, and agrees to indemnify the Campground, its officers and employees, against claims resulting from loss or damage to property or injury to the person of any member of the family or guest of registered camper arising out of the use of its camping facilities. GUEST ACKNOWLEDGES AND/OR WAIVES ALL STATE AND FEDERAL TENANT/LANDLORD RELATIONSHIPS/RIGHTS.
INDEMNITY AND WAIVER OF LIABILITY
Guest(s) shall indemnify and hold owner harmless from and against any and all claims, demands, costs, and expenses, including reasonable attorney’s fees, arising from any and all damaged or injuries caused by fire, water, wind, civil strife, or acts of God, owner and / or guest(s) actions or inactions (or those of their employees, agents, or invitees), or any other related to Customer’s use or occupation of the RV site, regardless of whether such loss was caused by negligence of any of the Campground parties.
MONTHLY RENT & DEPOSIT/FEES
Rent and electric bills are due on the 1st of the month, with a late fee of $30.00 on the 4th and $5.00 per day additional until rent is paid in full.
We do require a $150.00 security deposit prior to moving in for our long-term guests. Monthly Rates cover up to four people at each space, there will be a $25.00/month fee for each additional child over 3 living in the space and $50.00/month fee for each additional Adult over 18 with a maximum of 6 people allowed at a single site. For each pet we will either require a $100.00 non-refundable deposit for specific parks or a $10.00 per month charge for other parks.
TERMINATION OF STAY
If a Guest does not pay their rent after 3 days from when the rent is due, or has otherwise broken the rental agreement, the owner or manager of the RV Park can issue a Notice of Termination allowing 72-hour notice to the defaulting occupant, stating that the occupant has 72 hours to remove themselves and their recreational vehicle from the property. If, at the end of that 72 hour period, the Guest has not removed their recreational vehicle, it can legally be towed for impound.
REFUND POLICY
If you decide to leave early within your reservation there will be NO PRORATED REFUND. ie: you book a 10 day reservation and stay for 6 you will not get a 4 day refund. No exceptions.
For monthly stays- Any Cancelations will result in forfeiture of deposit.
For weekly and daily stays- Cancellations with 7 day notice will receive a 50% refund.
PET POLICY
The Campground management has sole discretion on allowing any/all pets on the property and has the right to revoke prior approval at any time. Absolutely no aggressive dogs or aggressive animals are allowed on the private property of the Campground at any time. Maximum weight allowed on premises is 30 lbs. Management has the right at any time to terminate the guest or camper reservation without refund and remove the guest and pets from the property if any animal acts aggressive towards any guest, camper or other animals on the property. All pets must always be on a leash in the owner’s hand. Guests are responsible for any damage, physical harm, or injury to another guest in the park. Guests are responsible to clean-up after their pet and dispose of the waste properly or may be subject to a fine or asked to leave the property. Pets are not to be left unattended and barking or disruptive behavior is strictly enforced. Pets are NOT allowed in any public area including but not limited to the pool, laundry, kitchen or bath houses. Pets are limited to two (2) pets per space. Pet deposits are non-refundable and required to be paid upfront. Safety of our guests, campers and pets are of utmost priority.
GENERAL RULES
Guests are responsible for all actions of their visitors and guests. Parents are responsible for the conduct of their children under the age of 18 and must be accompanied by an adult at all times. Guests assume all risk of loss or damage and are advised to carry their own insurance. Any damages to the park property will be billed directly to the guest. Treat others how you would want to be treated as we have zero tolerance for harassing or disruptive behavior to Park staff or other guests. Help us keep the park clean by maintaining a clutter free space with no additional appliances/unauthorized additions.
ARRIVALS & DEPARTURES
Check-in time is 12PM or after. Check-out time is by 12PM. First month’s rent, security deposit, and any applicable pet deposits are due prior to hook-up.
PARKING & SPEED LIMITS
Speed limit is 5 MPH at all times. All vehicles must be in good working condition and registered with the park. No more than 2 vehicles at any time. No mechanical repairs will be allowed at any time. Parking in vacant RV sites or grass will result in the vehicle being towed.
SEWER AGREEMENT
In order to provide you with GREAT service we require all of our campers to only put human waste in toilets. Absolutely no toilet paper, biodegradable or otherwise included. TEXAS STATE LAW REQUIRES ALL SEWER HOSES TO BE CONNECTED WITH A SEWER GASKET.
GENERAL RULES
• No prorating or refunds for early departure!!!
• Children under the age of 12 must be accompanied by an adult while in the communal areas of the park.
• All visitors must check-in at the office and pay daily fee if necessary and all must comply with parks rules/policies.
• YOU are responsible for the actions of your children and your visitors.
• The Speed Limit is 5 mph. If seen speeding, you will receive one warning and if speeding persists you will be asked to leave with no refund.
• ALL buildings in the resort are SMOKE-FREE.
• NO illegal drugs.
• No BB gun, pellet gun, air gun, and or paintball gun use is allowed in the park. All weapons shall be kept in compliance with state/federal laws.
• Common courtesy shall prevail between all persons in the park. Respect people’s privacy. Profane, abusive, harassing, threatening language or actions directed at personnel or other guests is unacceptable and you will be asked to leave.
• Do Not walk through occupied or unoccupied sites. Please use the roads and paths provided.
• Not following the rules can result in being asked to leave.
• No generators, fireworks, or loud music.
• Should the Sheriff be notified regarding a disturbance at your site, you will be required to vacate the park.
• Guests use the resort’s facilities at their own risk. Please act safely and secure your valuables.
• Management assumes no liability for loss or damage to guest property and/or injury to a person, pet, or visitors due to the use of resort facilities or caused by other pets or persons on the premises.
• The resort is not responsible for loss or damage due to fire, flood, accident, theft, weather, or catastrophic events.
• No pets inside any resort facility.
• Please leave resort facilities as you would like to find them. Please clean up after using the facilities such as rinsing the shower, sink, etc...
• Any guest or visitor that willfully or negligently damages or destroys resort property, landscaping, or equipment will be held liable for the value to repair or replace damaged items or property.
• Our resort operates on septic systems. Please do not place feminine products, grease/fats, diapers, cat litter, paper towels, wet wipes, “flushable wipes”, hazardous substances, syringes, or plastics down the drain/sewer.
• Subletting or renting an RV is prohibited.
• No sheds, porches, decks, tents, tarps, hot tubs, or utility buildings allowed unless approved by management.
• RV’s older than 10 years will require a picture of the rig sent into the office before check in. We want to see pride-of-ownership of the RV, so age is not a deterrent if the rig is in good condition.
• Cutting of trees and plants is prohibited. No screws, bolts, or nails in park trees.
• Do not feed wild or stray animals. Unless you are adopting them, taking them to the vet and making them your pet. Then all pet rules apply.
• Management will not fix anything on your side of the connection, we will ensure our hookups and connections are functional and it is the guest's responsibility to ensure their connections and hook ups are in working condition.
• No peddling, soliciting, or business enterprise is allowed in the park. Signs for the sale of products, services, and RV’s are not allowed.
• Mission Live Oaks RV dba Shady Oaks RV Park reserves the right to charge all reimbursements, fees, or charges to the Guest’s credit card or debit card, even if damage is discovered only after the guest has left the premises.
VEHICLES AND SITE OCCUPANCY
• One RV per site.
• Please do not park on the grass or on vacant sites.
• No vehicle repairs or maintenance may be done in the resort unless approved by management.
• RV washing requires approval from management and is a $25.00 extra water fee.
• No clotheslines or hanging laundry outdoors.
• No indoor items outside RV and all outdoor items can be asked to be removed.
• Outdoor items should be neat and orderly.
• Personal items, lawn chairs, a potted plant or rugs may not be kept on the grass or gravel to allow for our lawn maintenance.
• Hazardous materials must be discarded properly. No dumping of anything on the ground that may harm the grass or landscaping.
• Portable gas and charcoal grills are allowed.
• NO go carts allowed.
• We allow no wood fires on any site. Small gas fire pits are allowed.
- Any mess from guests are to be cleaned up immediately.
WASTE DISPOSAL
• There is a dumpster for our guests to dispose of trash on site.
• Please do not leave any trash or trash cans outside of the dumpster.
• ONLY household trash in dumpsters.
RV SEWAGE
• Texas law mandates the use of a sewer hose seal (threaded connector/rubber donut) – this is Mandatory.
• Our resort operates on septic systems. Please do not place feminine products, grease/fats, diapers, cat litter, paper towels, wet wipes, “flushable wipes”, hazardous substances, syringes, or plastics down the drain/sewer.
• In sites without sewer hookups, only grey water can be released, all black water must be dumped at dump station or in sewer connection.
• ALL water hoses and connections should be leak-free. All hoses, electric cables, and cords must be coiled neatly and kept off the grass.
PET RULES
• All pets (cats and dogs) must be on a leash (6ft or shorter) at all times when outside, unless in designated pet areas.
• Excessive barking is not allowed.
• Pet owners must immediately pick up after their pet and deposit waste in a bag and into the designated receptacles.
• Pet fences are not allowed.
• Pets may not be left outside unattended.
• No pet bedding in our washers and dryers.
Mission Live Oaks LLC dba Shady Oaks RV Park is a privately-owned park. Management reserves the right to refuse services, ask visitors to vacate, or deny access to anyone under any circumstances it deems necessary. There will be no refunds if asked to leave the resort. As well as the right to refuse or require the removal of any animal at any time. Management reserves the right to make changes deemed necessary to these rules and regulations at any time without prior notice. The absence of a particular policy from these published rules and regulations is not grounds for the granting of an exception.
I HAVE READ AND AGREE TO COMPLY WITH ALL OF THE CAMPGROUND RULES AND REGULATIONS LISTED IN THE TERMS AND CONDITIONS. MANAGEMENT HAS THE RIGHT TO REMOVE ANY GUEST AT THE PARK AT THEIR SOLE DISCRETION. TERMS AND CONDITIONS ARE SUBJECT TO CHANGE AT ANY TIME WITH OR WITHOUT NOTICE.
THESE RULES AND REGULATIONS WERE ESTABLISHED TO MAINTAIN HIGH STANDARDS OF CLEANLINESS, SAFETY, AND MAINTENANCE, AND WITH A “GOOD NEIGHBOR POLICY” IN MIND. YOUR COMPLIANCE IS VERY MUCH APPRECIATED AND WILL ENSURE A PLEASANT STAY FOR ALL GUESTS.
