RULES AND REGULATIONS

CHECK-IN is at 1:00pm. Payment is due at or before check-in.

CHECK-OUT is at 11:00am.

Long term stays: (30 days or more) You are REQUIRED to give move-out notice 30 days in advance of moving out or you will be charged a full month payment of the following month. To give notice you can email mhillsidervpark@gmail.com or text message the park phone and the team will see it.

Clean your space and document it. If there is ANY trash or items left in your space you will be charged a fee on your credit card. To confirm your space is clean upon leaving, please send a photo of your space to the park phone (sms text) or email it to mhillsidervpark@gmail.com.

Payment for MONTHLY GUESTS is due each month on the same day as the initial check-in. MONTHLY GUESTS may be required to complete a background check for $25/adult (Waived for Military ID, TWIC or CHL holder).

RETURNED CHECKS will incur a $35 fee.

A LATE FEE of $20 with an additional $20.00/day will be assessed. If rent is not paid within 3 days of your due date, the Service Agreement will be terminated and the camper must vacate immediately.

QUIET TIME is 10:00 pm to 8:00 a.m. daily during the week. 11:00 pm to 8:00 am on the weekends. THESE TIMES WILL BE STRICTLY ENFORCED.

PARENTS ARE RESPONSIBLE for the conduct of their children and financially responsible for any damages incurred by their children. Children under the age of 12 must be accompanied at all times.

SPEED LIMIT in the park is 7 mph.

TWO VEHICLE LIMIT on each site. All vehicles must have current registration, inspection and license plates. You are required to send photos of your vehicles with a visible license plate to our park phone or email upon check it.

We PREFER RV's LESS THAN 15 YEARS OLD to be in the park. Exceptions will be made at the discretion of the Manager. Please contact us directly.

All RV’s are expected to be kept CLEAN and in GOOD CONDITION. Washing of any cars or RV’s on Montgomery Hillside RV Park property is NOT ALLOWED however we will allow the occasional cleaning of RV for long term stay occupants.

CABLES, CORDS, WATER HOSES, SEWER LINES, ETC. are to be kept neat and orderly and in good working condition. Leaking water hoses MUST be replaced immediately.

It is MANDATORY that your sewer hose have a sewer connection (sewer collar/donut) attached to prevent sewer gases from escaping. If you do not have one, one may be purchased at check-in.

Please DO NOT FLUSH paper towels, tissues, diapers, feminine products, etc.

OUTDOOR ITEMS should be neat and orderly.

NO PERMANENT STRUCTURES are to be built without the manager’s permission.

Keep your space clean or you will receive additional charges on your account.

AGGRESSIVE DOG BREEDS are not permitted at any time on Montgomery Hillside RV Park property and excessive barking is grounds for being asked to leave the park.

ALL PETS must be on a leash at all times and there must be someone IN ATTENDANCE so that the pet does not get loose. Please put your PET INSIDE if you will be away for the day, or for any extended length of time.

IT IS MANDATORY that Pet Owners pick up and properly dispose of their pet’s feces.

ALL GARBAGE must be bagged and deposited into the dumpsters. Do NOT leave items outside the dumpster or your will be charged a cleaning fee.

Any type of PUBLIC DISTURBANCE such as disorderly, ill-mannered conduct, or drunkenness will not be tolerated.

A PUBLIC DOMESTIC DISTURBANCE will immediately terminate the Service Agreement of the site which must then be vacated IMMEDIATELY.

ILLEGAL SUBSTANCES and abuse of controlled substances are grounds for termination of the Service Agreement.

If the Sheriff has to be called for any disturbance, the campsite must be vacated IMMEDIATELY--NO REFUND. All occupants and guests must comply with all federal, state & local laws and park rules.

Use of FIREARMS is not permitted in our park. FIREWORKS are also not permitted.

All guests are considered TRANSIENT. This is NOT A LEASE.

SITES MUST BE CLEANED before leaving to avoid being charged a $425 clean up fee to the credit card on file.

Although not anticipated, Montgomery Hillside RV Park is not responsible for any loss due to fire, accident, falling trees, flood, theft, electrical surges, natural or unnatural terrain etc. or theft during your stay.

Montgomery Hillside RV Park is not liable for any injuries that may occur on Montgomery Hillside RV Park property.

GUESTS of paying guests are required to be approved by the office staff.
If for any reason the rules and regulations are not being followed, Montgomery Hillside RV Park reserves the right to ask you to leave without reimbursement. Montgomery Hillside RV Park also reserves the right to refuse service to anyone.
HOLD HARMLESS AGREEMENT
The signee, (hereinafter called “Camper”), jointly and severally, in consideration of being permitted to enter onto, use or occupy properties or facilities belonging to or under the control of BJZ Interest, LLC (hereinafter called “Montgomery Hillside RV Park”) and such other consideration, such consideration acknowledged as received and sufficient, does hereby agree to waive, release absolutely, indemnify and save harmless Montgomery Hillside RV Park, it’s employees, officers, directors, contractors and agents from and against all claims, demands, awards, judgements, costs (including legal costs) actions causes of action and proceeding by whomever made or brought in respect of any personal or bodily injury (including death) to any person, and any loss of or damage to any property caused directly or indirectly by or as a result of the Camper, or it’s family, friends, guests, acquaintances, agents, servants, contractors, employees or any person connected with the Camper, directly or indirectly, expressly or implied, regardless of whether the Camper related person was invited or not, and regardless of whether the Camper is not at Montgomery Hillside RV Park.
The terms of this Agreement form shall be construed as the entire agreement and may not be altered, amended or modified except in writing and signed by all parties hereto. The terms of this Agreement shall be governed by the Laws of Texas. This Agreement shall continue to be in full force and effect for each and every visit to Montgomery Hillside RV Park by the Camper, their family, friends, guests, acquaintances, agents, servants, contractors, employees, or any person connected with the Camper, directly or indirectly, expressly or implied, regardless of whether the Camper related person was invited or not, and regardless of whether the Camper is not at Montgomery Hillside RV Park.
MONTHLY SITE SERVICE AGREEMENT
This site service agreement is made and entered into to be effective as of the last date written below (the “Effective Date”) by the undersigned parties (defined below).
1. RV Site. Montgomery Hillside RV Park hereby provides services (electric, septic, water) on your RV Site (the “RV Site”) of the Campground operated by agents of Montgomery Hillside RV Park at 3877 Spring Branch Rd, Montgomery, TX 77316 (the “Property”), which has the right upon twenty-four (24) hours notice to relocate Camper to a substantially equivalent Lot at the Property.
2. Term. The initial term of this Agreement shall commence on the Effective Date and end one (1) month after the Effective Date. Unless terminated by either party, after the expiration of the Initial Term, this Agreement shall automatically continue on a month-to-month basis.
3. Park Rates, Other Charges, and Late Fees. Camper shall pay Campground montlhy. Fees shall be paid in advance and without demand beginning on the Effective Date of this Agreement and thereafter on the same day as initial check-in. All payments are due and to be made payable to Campground at the address provided below. The Fee amount may be increased by giving advance notice to Camper. Campground will assess a late fee of $20 with an additional $5.00/day the payment is late. If rent is not paid within 3 days of your due date, the Service Agreement will be terminated and the renter must vacate immediately.
4. Rules and Regulations. Camper and their guests, invitees and all occupants, including pets shall comply with the written rules and regulations provided to Camper (a copy of which are attached hereto and incorporated herein for all intents and purposes). Camper agrees to comply with all state and federal laws, rules, ordinances and regulations applicable to Property.
5. Campground’s Right to Terminate Agreement. Campground may terminate this Agreement for any or no reason by providing Camper a notice to vacate the RV Site (“Notice to Vacate”). Camper agrees to render peaceful possession of the RV Site to Campground within three (3) days of the date provided on the Notice to Vacate. The three (3) days notice shall not be required to terminate if termination is the result of an Act of Default (as defined below).
6. Default by Camper. The following acts constitute default by Camper (“Acts of Default”):
a. Failure to timely pay Fees or other lawful charges when due under this Agreement;
b. Giving false information on any application to campground;
c. Camper, Camper’s guests and/or occupants fail to comply with any rule or regulation or term, covenant or condition of this Agreement;
d. Camper has materially breached out the terms of this Agreement by any action such as violating provisions under this Agreement; or committing serious misconduct or criminal acts;
e. Camper holds over after giving notice of termination and intent to vacate; and/or
f. Camper holds over after Campground gives notice of termination at the end of the Term or a Notice to Vacate during the Term in accordance with paragraph 6 of this Agreement.
7. Condition of RV Site. By execution of this Agreement, Camper acknowledges and agrees that the RV site is neat and clean and adequate for Camper’s use. Upon termination or expiration of this Agreement, Camper agrees to surrender the RV Site to Campground in a neat and clean condition.
8. Assignment. Camper shall not have the right to assign or sublet the RV Site hereunder to any person or persons.
9. Governing Law. This Agreement is governed and construed in accordance with the laws of the State of Texas.
10. Attorney Fees. In the event any legal proceedings of any kind are instituted to collect unpaid Fees, electrical charges or for possession of the RV Site, Campground may collect from Camper all reasonable costs and attorney fees incurred by Campground in pursuing such action.
11. Waiver. Campground’s failure to insist on strict compliance with the terms, covenants, or conditions of this Agreement shall not be deemed a waiver of that term, covenant or condition, nor shall any waiver or relinquishment of any right or power at any one time or times be deemed a waiver or relinquishment of the right or power for all or any other times.
12. Notices. All written notices and communications regarding this Agreement should be sent to the designated undersigned persons at the addresses or via facsimile as set forth below unless notified in writing to the contrary by the receiving party. The notice shall become effective as of the date of mailing by regular or certified mail or the date a facsimile transmission is received.
13. NO LIABILITY. CAMPER HEREBY INDEMNIFIES, RELEASES AND HOLDS CAMPGROUND, ITS OFFICERS, OWNERS, EMPLOYEES AND AGENTS (THE “CAMPGROUND PARTIES”) HARMLESS FROM ANY PROPERTY DAMAGE, PERSONAL INJURY, CLAIMS, CAUSES OF ACTION, DAMAGES, LOSS, EXPENSES, AND/OR LIABILITIES (HEREAFTER COLLECTIVELY “LOSS”) ARISING OUT OF OR RELATED TO Camper’S USE OF THE RV SITE, THE PROPERTY AND/OR ANY CONDITION THEREON, REGARDLESS OF WHETHER SUCH LOSS WAS CAUSED BY THE NEGLIGENCE OF ANY OF THE CAMPGROUND PARTIES.
14. Sales Tax. **Texas state and local sales and use tax is included in the sales price**
THEFT OF SERVICE LAW
ACCORDING TO TEXAS PENAL CODE SECTION 31:04 (b), any guest who leaves without paying for site services or who refuses to pay for site services when due is subject to criminal prosecution. We are providing service hook-ups for your RV. We require full payment in advance and will prosecute any violations under the “THEFT OF SERVICES LAW”.

ADDITIONAL INFO
Septic System: All RVs and structures are on a septic system. Please help us care for our septic system so that it can take care of you.

Conserve Water. Please try to spread showers and laundry out throughout the day so as not to overload the system.

Please repair any leaks that occur inside your rig, and report any leaks or strange sewage odor to Management or Maintenance immediately.

Do not drive or park over septic tanks, septic lids, or the leach fields.

Please avoid flushing, draining, or dumping the following into the septic system by way of sinks, drains, outlets, and toilets:
Bleach Antibacterial soaps & cleansers Coffee Grounds
Disposable Diapers Sanitary napkins Cigarette butts
Fats, greases, & oils Paints Paint thinners
Antibiotics Kitty litter Dental floss
Tampons Condoms Paper towels Varnishes Pesticides Gasoline Antifreeze Chemical drain cleaner Excessive toilet paper
Winter Precautions: During your stay in the colder winter months, Campers are responsible for disconnecting hoses from the parks water lines during freezing temperatures. Campers will be held responsible for any damage done to the water lines at the site for failure to properly disconnect. A $50 fee may be assessed for failure to protect our water supply. It is recommended that you use an insulated hose and drain your lines to protect your RV as well. Montgomery Hillside RV Park is not responsible for frozen pipes inside of your RV or any damage that may occur to your RV in the event of freezing temperatures.
Canceling your reservation on the day of or 30 days in advance of your stay will result in a forfeit of all money paid in. Cancellations 31 or more days will receive a full refund minus a $20 processing fee.
- Discharge plug/cap is the responsibility of the tenant from check-in to check-out. The discharge cap must be re-installed on discharge upon any disconnection of tenant's RV in order to ensure our septic system stays sealed from groundwater during weather events and other debris. Failure to do so will result in a fee up to $250.
Long Term Guest: Are required to give a 30 days notice prior to move out or will be charged the following month's full fee.
