OUT & WEST LLC Guest Terms, Cancellation Policy & Campsite Rules

Effective Date: 9/25/2026

By making a reservation, completing the booking process, checking in, or occupying an OUT & WEST LLC accommodation, the booking guest agrees to these Terms and is responsible for ensuring that all members of the guest’s party and visitors comply with them.

These Terms apply in addition to all applicable West Virginia State Park rules, posted park regulations, reservation requirements, and applicable federal, state, and local laws. If an applicable State Park rule or law imposes a stricter requirement than these Terms, the stricter lawful requirement will apply.

Outdoor & State Park Experience

OUT & WEST LLC accommodations are located within operating West Virginia State Parks and are intended to provide an outdoor camping experience.

Guests should expect and be prepared for changing weather, temperature fluctuations, rain, wind, thunderstorms, wildlife, insects, uneven or natural terrain, falling limbs or branches, mud, dust, pollen, darkness, noise, and other conditions ordinarily associated with outdoor environments, wooded areas, and public campgrounds.

Park operations, roads, trails, bathhouses, utilities, recreational facilities, fire restrictions, burn bans, closures, construction, special events, neighboring campers, wildlife activity, and other conditions within the State Park may change before or during a guest’s stay.

Certain facilities, activities, utilities, roads, trails, bathhouses, recreational amenities, and services within the State Park are owned, operated, maintained, or controlled by the State of West Virginia or other third parties and are outside OUT & WEST LLC’s direct control.

OUT & WEST LLC does not guarantee weather conditions, wildlife activity, uninterrupted utilities or cellular service, or the availability or condition of any State Park amenity, trail, attraction, activity, facility, or third-party service.

Guests are responsible for monitoring weather and park conditions and arriving appropriately prepared for an outdoor stay.

Assumption of Outdoor Risks

Camping and outdoor recreation involve inherent risks that cannot be completely eliminated. These risks may include, among other things, changing weather, storms, heat and cold, wildlife, insects, falling trees or branches, uneven or slippery terrain, campfires, smoke, darkness, interaction with other park visitors, and other conditions ordinarily associated with outdoor camping and recreation.

To the fullest extent permitted by applicable law, each guest voluntarily assumes the ordinary and inherent risks associated with participating in an outdoor camping experience and is responsible for exercising reasonable care for their own safety and the safety of minors and others under their supervision.

Nothing in these Terms is intended to waive or limit liability that may not lawfully be waived or limited, including liability resulting from grossly negligent, reckless, willful, or intentional misconduct.

State Park Rules

All guests must comply with:

These OUT & WEST LLC Terms and campsite rules;

Rules and regulations of the applicable West Virginia State Park;

Instructions of authorized State Park or West Virginia Division of Natural Resources personnel;

Posted notices, burn bans, closures, emergency orders, and safety restrictions; and

Applicable federal, state, and local law.

OUT & WEST LLC rules may be more restrictive than generally applicable State Park rules where reasonably necessary for the operation, protection, or safety of an OUT & WEST LLC accommodation, provided such rules are consistent with applicable law and OUT & WEST LLC’s agreement with the State Park.

Check-In & Check-Out

Check-In: 3:00 PM

Check-Out: 11:00 AM

At least one guest 18 years of age or older must occupy the campsite and be responsible for the reservation and conduct of the group.

Early check-in and late checkout are available only with advance approval from OUT & WEST LLC and are subject to availability.

An unauthorized checkout after 11:00 AM may result in a $50 late checkout fee.

If a guest remains at the accommodation substantially beyond checkout without authorization and the delay prevents or materially interferes with cleaning, maintenance, or occupancy by an incoming guest, OUT & WEST LLC may charge up to one additional night at the then-current rate, to the extent permitted by applicable law.

Occupancy

The number of overnight guests may not exceed the stated capacity of the reserved accommodation:

Basecamp: Maximum 2 guests

Outpost: Maximum 4 guests

Expedition: Maximum 6 guests

Children and infants under the age of two do not count toward occupancy unless otherwise expressly stated during booking or required by applicable State Park rules.

The booking guest is responsible for the conduct of all persons occupying or visiting the site under the reservation.

Additional tents, sleeping structures, camping units, or similar accommodations may not be erected at an OUT & WEST LLC site without advance approval from OUT & WEST LLC and, where required, the applicable State Park.

General Campsite Rules

Guests must keep the campsite reasonably clean and orderly throughout their stay.

Only one vehicle per OUT & WEST LLC site is permitted unless OUT & WEST LLC or the applicable State Park expressly authorizes otherwise.

Vehicles must be parked only in designated parking areas and may not obstruct roads, emergency access, neighboring campsites, pedestrian areas, or State Park operations.

Vehicle repair, maintenance, or washing is prohibited at OUT & WEST LLC sites except for emergency repairs reasonably necessary to safely remove a vehicle.

Food, trash, coolers, and scented items should not be left unattended in a manner likely to attract wildlife.

Trash must be placed in designated waste receptacles or dumpsters.

Feeding, approaching, harassing, capturing, or disturbing wildlife is prohibited.

Guests may not damage, remove, cut, nail into, attach items to, or otherwise disturb trees, vegetation, rocks, signs, structures, equipment, or other State Park property.

Guests may not dig, trench, alter, or otherwise materially modify an OUT & WEST LLC campsite.

OUT & WEST LLC furniture, bedding, equipment, appliances, décor, linens, and other property may not be removed from the accommodation or campsite except as intended for normal use.

Commercial activity, organized events, parties, photography or video productions, sales activity, or organized gatherings require advance written approval from OUT & WEST LLC and, where applicable, the State Park.

Fires, Smoking & Safety

Fires are permitted only in designated fire rings, grills, or other areas authorized by the State Park.

All burn bans, fire restrictions, and instructions issued by State Park personnel or governmental authorities must be followed.

Fires must be attended at all times and fully extinguished before guests leave the campsite or retire for the night.

Smoking, vaping, candles, incense, and other open flames are prohibited inside all OUT & WEST LLC tents and accommodations.

Fireworks, explosives, incendiary devices, paintball equipment, slingshots, air guns, and similar recreational projectile devices may not be used at an OUT & WEST LLC campsite.

Firearms and other weapons must be possessed, carried, transported, stored, and handled in accordance with applicable federal and West Virginia law and applicable State Park rules. The unlawful discharge, threatening display, brandishing, or unsafe use of any firearm or other weapon is prohibited.

Guests may not engage in any activity that creates an unreasonable risk of injury, fire, property damage, or disturbance to other guests.

Children must be appropriately supervised by a responsible adult.

Drugs & Alcohol

Illegal drugs and the unlawful possession or use of controlled substances are prohibited.

Recreational marijuana is not lawful in West Virginia. Medical cannabis may only be possessed and used as permitted under West Virginia law.

Smoking medical cannabis is prohibited by West Virginia law. In addition, smoking or vaping of any substance is prohibited inside OUT & WEST LLC accommodations.

Guests consuming alcoholic beverages must comply with applicable laws and State Park rules.

Alcoholic beverages may not be consumed or displayed in any manner prohibited by the applicable State Park.

Intoxication does not excuse unsafe, disruptive, threatening, destructive, or unlawful conduct.

Quiet Hours & Guest Conduct

OUT & WEST LLC Quiet Hours are 9:00 PM to 6:00 AM.

Guests must also comply with any additional or longer quiet-hour restriction imposed by the applicable State Park.

During quiet hours, music, televisions, conversations, vehicles, generators, and other noise must be kept at a level that does not disturb neighboring guests.

At all times:

Guests must respect neighboring campsites and other State Park visitors.

Loud, excessive, or unreasonable noise is prohibited.

Threats, fighting, violence, harassment, abusive behavior, vandalism, or conduct creating an unreasonable disturbance or safety risk will not be tolerated.

Guests must comply with reasonable safety instructions from OUT & WEST LLC staff and authorized State Park personnel.

Interference with OUT & WEST LLC operations, State Park operations, emergency personnel, maintenance personnel, or other guests is prohibited.

A material violation of these Terms, illegal activity, threatening or dangerous conduct, intentional property damage, substantial disturbance of other guests, exceeding occupancy limits, or refusal to comply with lawful safety instructions may result in termination of the stay and removal from the accommodation, subject to applicable law.

Guests removed because of their violation of these Terms are not entitled to a refund for unused nights.

Emergencies

For any emergency involving an immediate threat to life, health, fire, crime, or public safety, call 911 first.

OUT & WEST LLC’s guest-support contact is not a substitute for emergency services.

Maintenance issues, accommodation problems, or other non-emergency concerns should be reported promptly to OUT & WEST LLC at:

Phone: (304) 520-3305

Email: stay@wvglamping.com

Guests should also follow emergency instructions issued by State Park personnel, law enforcement, fire departments, emergency management officials, or other authorized governmental personnel.

Security & Personal Property

Guests are responsible for reasonably securing their vehicles and personal belongings.

OUT & WEST LLC is not an insurer of guest property and, to the fullest extent permitted by applicable law, is not responsible for lost, misplaced, stolen, or damaged personal property unless the loss or damage results from conduct for which liability may not lawfully be disclaimed.

Guests should not leave cash, valuables, electronics, medications, or other valuable property unattended at a campsite.

Nothing in these Terms is intended to waive any responsibility imposed on OUT & WEST LLC by applicable West Virginia law.

Damage, Missing Property & Excessive Cleaning

The booking guest is financially responsible for damage caused by the guest, members of the guest’s party, visitors, or pets beyond ordinary wear and tear.

This may include damage to:

Tent canvas, doors, windows, screens, or structural components;

Furniture and bedding;

Linens and towels;

Appliances;

HVAC equipment;

Refrigerators;

Electrical equipment;

Decks and platforms;

Landscaping;

State Park property; or

Other OUT & WEST LLC equipment or property.

Guests may also be responsible for reasonable costs associated with:

Missing or removed property;

Excessive cleaning;

Smoking or vaping inside an accommodation;

Unauthorized pets;

Pet damage;

Stains, odors, or damage requiring specialized cleaning;

Intentional or negligent damage; and

Damage resulting from a violation of these Terms.

OUT & WEST LLC may charge the payment method associated with the reservation for documented and reasonable repair, replacement, remediation, or excessive-cleaning costs as authorized by these Terms and permitted by applicable law.

Payment Method & Authorization for Additional Charges

The booking guest must maintain a valid payment method associated with the reservation through completion of the stay and resolution of any authorized post-stay charges.

By making a reservation, the booking guest authorizes OUT & WEST LLC and its authorized payment processor to charge the payment method associated with the reservation for:

The reservation amount and applicable taxes and fees;

Approved reservation modifications;

Applicable late-checkout charges;

Documented damage caused by the guest or the guest’s party;

Missing OUT & WEST LLC property;

Reasonable excessive-cleaning or remediation costs;

Pet-related charges disclosed in connection with the reservation; and

Other amounts expressly authorized under these Terms.

OUT & WEST LLC will not use this authorization to impose arbitrary penalties or charges unrelated to the reservation.

Where reasonably practicable, OUT & WEST LLC will provide the guest with notice and a description of material post-stay charges.

The guest remains responsible for amounts properly owed under these Terms even if those amounts exceed a temporary authorization or deposit.

Responsibility for Guest Conduct

Guests are responsible for injuries, damages, losses, fines, charges, or third-party claims resulting from their own negligent, unlawful, or intentional conduct or from a material violation of these Terms by themselves or members of their party.

To the fullest extent permitted by law, the booking guest agrees to indemnify and hold OUT & WEST LLC harmless from third-party claims arising from the negligent, unlawful, or intentional acts or omissions of the guest or members of the guest’s party, except to the extent the claim was caused by OUT & WEST LLC or otherwise may not lawfully be subject to indemnification.

Pet Policy

Unless otherwise stated for a particular accommodation, OUT & WEST LLC permits one pet per accommodation.

All pets must be disclosed and registered with the reservation before arrival, and any applicable pet fee must be paid prior to check-in.

Only pets permitted by the applicable West Virginia State Park may be brought onto the property.

Pets must be appropriately leashed or otherwise restrained and under the control of a responsible person capable of managing the animal at all times.

Pets may not be left unattended inside or outside an OUT & WEST LLC accommodation.

Guests must promptly clean up after their pets and properly dispose of all pet waste.

Pets should be current on all required vaccinations, and guests should carry appropriate vaccination information during their stay.

OUT & WEST LLC does not impose breed-specific restrictions unless required by applicable law, State Park rules, or insurance requirements. However, OUT & WEST LLC reserves the right to prohibit or require the removal of any pet that:

Displays aggressive, threatening, destructive, excessively disruptive, or uncontrolled behavior;

Has a known history of biting or attacking people or other animals;

Cannot be safely controlled by its handler; or

Otherwise presents a reasonable safety risk to guests, staff, other animals, wildlife, or property.

Guests must immediately remove or secure a pet if directed to do so by OUT & WEST LLC staff or authorized State Park personnel because of a legitimate safety, behavior, or rule-compliance concern.

The booking guest is responsible for any injury, loss, or property damage caused by their pet.

Guests may be charged the reasonable cost of repairing, replacing, or professionally cleaning property damaged or soiled by a pet, including damage to tent canvas, screens, bedding, furniture, flooring, decks, equipment, or other accommodation components.

Significant rips, tears, stains, odors, or similar damage may result in charges of up to $500, or another documented amount where the reasonable repair, replacement, or remediation cost is greater or lesser and the charge is permitted under the reservation agreement and applicable law.

Undisclosed Pets

Failure to disclose and register a pet before arrival may result in assessment of the applicable pet fee, reasonable additional cleaning or remediation charges, and, where the presence or conduct of the animal creates a material safety, operational, or rule-compliance issue, termination of the stay as permitted by law.

Service Animals

Service animals are not pets and will be accommodated in accordance with applicable law.

Pet fees, pet limits, breed restrictions, and other pet-specific requirements do not apply to qualifying service animals where prohibited by law.

A service animal must remain under the control of its handler and may only be excluded or required to leave in circumstances permitted by applicable law, including where the individual animal is out of control and the handler does not take effective action to control it, the animal is not housebroken, or the animal otherwise presents a direct threat that cannot reasonably be mitigated.

Guests remain responsible for actual damage caused by a service animal on the same basis that guests are responsible for other damage they cause.

Booking & Payment Policy

Full payment is required at the time of booking unless a different payment schedule is expressly disclosed during the reservation process.

A reservation is not confirmed until payment has been successfully processed and the guest receives a reservation confirmation.

Rates, taxes, fees, occupancy limits, accommodation type, dates, park location, and cancellation terms stated on the confirmed reservation are incorporated into these Terms.

If a payment is declined, reversed, charged back, or otherwise not successfully collected, OUT & WEST LLC may contact the booking guest to obtain a valid payment method.

If required payment is not received within the period communicated by OUT & WEST LLC, OUT & WEST LLC may cancel the reservation subject to applicable law and the cancellation terms associated with that reservation.

Reservation Changes

Requests to change reservation dates, park location, accommodation type, or other material reservation details are subject to availability and are not guaranteed.

A requested change may be treated as a cancellation of the original reservation and creation of a new reservation and therefore may be subject to the cancellation policy applicable to the original reservation.

Any approved reservation change may result in a different nightly rate, taxes, fees, minimum-stay requirement, or other pricing applicable to the newly selected dates or accommodation.

OUT & WEST LLC is not required to move a reservation to different dates in order to avoid an otherwise applicable cancellation charge.

Reservation Transfers

Reservations may not be sold, advertised for resale, or transferred to another person without OUT & WEST LLC’s prior approval.

OUT & WEST LLC may permit a reservation to be transferred to another responsible adult at its discretion, provided:

All amounts owed have been paid;

The new booking guest meets applicable reservation requirements;

The new booking guest provides required reservation information; and

The new booking guest agrees to these Terms.

Approval of a guest substitution does not constitute approval of a date change or other modification to the reservation.

Cancellation & Refund Policy

Unless a different cancellation policy was expressly disclosed and accepted at the time of booking:

31 or More Days Before Scheduled Arrival

The reservation may be cancelled for a refund, less a cancellation fee equal to 3% of the reservation total.

7–30 Days Before Scheduled Arrival

The guest will receive a refund equal to 50% of the reservation total.

0–6 Days Before Scheduled Arrival

The reservation is non-refundable.

No-Shows

No refund will be issued.

Early Departures or Late Arrivals

No refund will be issued for unused nights resulting from a guest’s voluntary early departure or late arrival.

How to Cancel

Cancellation requests must be submitted through the applicable booking platform or in writing to:

stay@wvglamping.com

A telephone call alone does not constitute cancellation unless OUT & WEST LLC subsequently confirms the cancellation in writing.

The effective cancellation date is the date OUT & WEST LLC or the applicable booking platform receives the cancellation request.

If a reservation was made through a third-party booking platform and the cancellation terms expressly presented and accepted through that platform differ from these Terms, the cancellation terms applicable to that confirmed reservation will control.

Group Reservations

A reservation involving three or more OUT & WEST LLC accommodations may be treated as a group reservation.

Group reservations may be subject to separate:

Deposit requirements;

Payment schedules;

Cancellation policies;

Minimum-stay requirements;

Site-use rules;

Event or gathering restrictions;

Security deposits; and

Group agreements.

Any special group terms must be disclosed to and accepted by the booking guest or group organizer.

Where accepted group-reservation terms conflict with the standard cancellation or payment provisions in these Terms, the accepted group-reservation terms will control.

The group organizer is responsible for communicating applicable rules to the group, but each individual guest remains responsible for complying with these Terms.

Weather & Outdoor Conditions

Rain, thunderstorms, heat, cold, insects, wildlife activity, muddy conditions, wind, ordinary utility interruptions, and other normal or reasonably foreseeable outdoor conditions are part of the camping experience and, by themselves, do not entitle a guest to cancel outside the applicable cancellation policy or receive a refund.

Guests are encouraged to review weather forecasts before arrival and plan accordingly.

Guests who voluntarily elect not to travel, arrive late, or leave early because of ordinary weather or outdoor conditions remain subject to the applicable cancellation policy.

This provision does not apply where the specific reserved accommodation is unavailable for occupancy because OUT & WEST LLC or an authorized State Park or governmental authority has closed the site or determined that it may not safely or lawfully be occupied.

Park Closures, Emergencies & Events Beyond OUT & WEST LLC’s Control

A State Park or governmental authority may restrict access, order an evacuation, close facilities, issue a burn ban, restrict activities, interrupt utilities, close roads or trails, cancel events, or otherwise modify park operations because of weather, emergencies, maintenance, public safety, construction, natural events, or other circumstances.

If the specific OUT & WEST LLC accommodation remains open and reasonably available for occupancy, the closure or unavailability of unrelated State Park amenities, trails, attractions, facilities, events, or activities does not automatically entitle the guest to a refund.

If the reserved OUT & WEST LLC accommodation becomes unavailable for occupancy due to a mandatory park closure, governmental order, emergency, significant damage, or another circumstance that prevents OUT & WEST LLC from providing the reserved accommodation, OUT & WEST LLC may offer:

An equivalent available accommodation;

Relocation to another available OUT & WEST LLC site;

Rescheduling;

A future-stay credit; or

A refund of affected lodging charges.

Any relocation, rescheduling, or credit must be accepted by the guest.

If OUT & WEST LLC cannot provide the reserved accommodation or an alternative accepted by the guest, OUT & WEST LLC will refund lodging charges attributable to affected unused nights.

Except where required by law, OUT & WEST LLC is not responsible for consequential or incidental expenses resulting from a closure or interruption, including transportation, alternative lodging, missed activities, or other travel expenses.

Maintenance, Safety & Access

Outdoor accommodations occasionally require maintenance, repair, pest treatment, safety inspection, or other operational attention.

Guests must promptly report unsafe conditions, maintenance problems, electrical issues, utility interruptions, damaged equipment, water intrusion, or other accommodation concerns.

OUT & WEST LLC personnel, contractors, and authorized State Park personnel may enter or access a campsite or accommodation when reasonably necessary to:

Respond to an emergency;

Address a health or safety concern;

Perform necessary maintenance or repairs;

Investigate reported damage;

Protect OUT & WEST LLC or State Park property;

Address a suspected material rule violation affecting health or safety; or

Carry out another legitimate operational requirement.

Where circumstances permit, OUT & WEST LLC will make reasonable efforts to respect guest privacy and minimize disruption.

Equipment, Rentals & Optional Add-Ons

Certain OUT & WEST LLC locations may offer optional equipment or recreational rentals, including equipment provided directly by OUT & WEST LLC or by third parties.

Use of certain equipment or participation in certain activities may require acceptance of a separate equipment rental agreement, activity waiver, or safety acknowledgment.

Where separate terms are required, a guest may not use the equipment until those terms have been accepted.

Guests using rented equipment must:

Use the equipment only for its intended purpose;

Follow manufacturer, OUT & WEST LLC, State Park, and applicable safety instructions;

Inspect equipment before use and promptly report any apparent damage or defect;

Stop using equipment if it appears damaged or unsafe;

Exercise reasonable care;

Not permit unauthorized persons to use rented equipment;

Return equipment in substantially the same condition in which it was provided, ordinary wear excepted; and

Not use recreational equipment while impaired by alcohol, illegal drugs, or any substance that makes use unsafe.

Guests may be responsible for documented loss or damage occurring while rental equipment is in their possession, except for ordinary wear, preexisting damage, or damage for which the guest is not legally responsible.

Any activity-specific assumption of risk or release of liability will be contained in a separate agreement where appropriate.

No Guarantee of Specific Park Amenities

The reservation is for the OUT & WEST LLC accommodation and amenities expressly identified as included with that accommodation.

Unless expressly included in the reservation, OUT & WEST LLC does not guarantee the availability of:

Trails;

Overlooks;

Swimming areas;

Restaurants;

Stores;

Bathhouses;

Recreational activities;

Rentals;

Events;

Wi-Fi;

Cellular service;

Attractions; or

Other State Park or third-party amenities.

Temporary unavailability or modification of a park amenity does not constitute unavailability of the OUT & WEST LLC accommodation itself.

Rates, Taxes & Fees

Guests are responsible for the nightly rate, applicable taxes, and fees disclosed during the booking process.

Optional add-ons, pet fees, rental equipment fees, or other optional charges will be disclosed when applicable.

OUT & WEST LLC may change future rates and fees at any time, but changes will not retroactively alter the confirmed lodging rate of an existing reservation except where the guest subsequently modifies that reservation or where a change is required by law or governmental tax or fee adjustment.

Acceptance of Terms & Electronic Agreement

By completing a reservation or affirmatively accepting these Terms electronically, the booking guest acknowledges that they:

Have had an opportunity to review these Terms;

Agree to be legally bound by them;

Understand that the accommodation is an outdoor camping experience located within an operating State Park;

Accept responsibility for complying with applicable State Park rules;

Accept responsibility for the conduct of members of their party;

Agree to the applicable payment, cancellation, damage, occupancy, and campsite policies; and

Have authority to make the reservation and accept these Terms.

Electronic acceptance through OUT & WEST LLC’s website, reservation system, or an authorized booking platform constitutes the guest’s agreement to these Terms to the extent permitted by applicable law.

Governing Law

These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles.

Nothing in these Terms is intended to waive or limit any right, duty, remedy, or protection that cannot lawfully be waived or limited.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

OUT & WEST LLC’s failure to enforce a provision on one occasion does not waive its right to enforce that provision on another occasion.

No employee or representative of OUT & WEST LLC may waive or modify these Terms except through a written agreement authorized by OUT & WEST LLC.
