Official Rules for Campspot “Summer COO” Contest

No Purchase Necessary. A Purchase Will Not Increase Your Chances of Winning.

Sponsor:  The Campspot “Summer COO” Contest (“Contest”) is sponsored by RezPlot Systems, LLC d/b/a Campspot, 38 Commerce Ave. SW, Suite 200, Grand Rapids, MI  49503 (“Sponsor”)

Eligibility:  The Contest is open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia, excluding residents of Puerto Rico, all U.S. territories and possessions, and all overseas military installations who are at least twenty-one (21) years old, and is void where prohibited by law. Employees, independent contractors, interns, officers, directors and agents of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies and suppliers (collectively, the “Contest Entities”), as well as the immediate family (spouse, parents, siblings, and children) and household members of those individuals, are not eligible to enter. 

Entry Period:  The entry period begins on Tuesday, June 6 at 12:01 a.m. CT, and ends on Friday, June 30 at 11:59 p.m. CT (“Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the contest.

How to Enter:  Entrants must fill out the entry form by visiting https://www.campspot.com/camp-guide/summer-coo-contest and answer a series of questions. Entrants must provide the information requested. Entries that are incomplete or do not adhere to these Official Rules may be disqualified at the sole discretion of Sponsor.  

The use of an agency or any automated system to enter is strictly prohibited, and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion. By entering, entrant indicates their full agreement to these Official Rules and Sponsor’s decisions regarding the Contest, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Official Rules.

Limit:  Each entrant may upload one (1) entry per person during the Entry Period.  Entrants may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the Official Rules.  Entries received from any person in excess of the stated limit will be void. Entries generated by script, macro or other automated means will be void.  If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the submission.  Sponsor is not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected entries, all of which will be void. 

By submitting an entry, entrant agrees that their entry conforms to the Content Restrictions as defined below. Submitted materials will not be acknowledged or returned.  In the event of a dispute as to the entrant of any entry, the authorized account holder of the email address used to register for an account will be deemed to be the registrant for the purposes of entry to the Contest. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the authorized account holder. 

Odds:  The odds of winning a prize will depend upon the total number of eligible entries received. Sponsor cannot accurately predict the number of entries which will be made to the Contest. 

Entry Guidelines and Content Restrictions:  An entry must meet the following guidelines: (a) the entry must comply with these Official Rules, and Sponsor reserves the right to delete or disregard entries that are inappropriate or that do not comply with the foregoing; and 

(b) the entry must comply with the following restrictions (“Content Restrictions”): 

(i) the entry is original to the entrant; (ii) the entry does not violate any law, statute, ordinance or regulation; (iii) the entry does not contain material that violates or infringes another person’s rights, including but not limited to privacy, publicity or intellectual property rights, or infringe on any rights and/or interests of any third party; (iv) the entry does not contain material that is hateful, tortious, defamatory, slanderous or libelous toward any person living or deceased, or otherwise infringe upon any person’s personal or proprietary rights; (v) the entry does not contain material that is obscene, sexually explicit or pornographic or promote bigotry, racism, hatred or harm against any group or individual or promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or that is designed to annoy or harass; (vi) the entry does not make any references to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any depiction or representation thereof; (vii) the uploaded submission does not contain any virus, Trojan horses, hacks, spyware or malicious code of any type; (viii) the entry shall be suitable for audiences of all ages and be consistent with Sponsor’s reputation in the marketplace, including its reputation for quality and integrity; and (ix) the uploaded submission does not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where entry is created.

Failure of any entry to comply with the above entry guidelines and Content Restrictions, as determined by Sponsor in its sole discretion, may result in the deletion of the entry and disqualification from the Contest. No entry will be returned. Sponsor shall have the right to delete, edit, adapt and publish any or all of the entries, and may use them in any media without attribution or compensation to the entrant, their successors or assigns, or any other entity. As more fully explained below, SUBMITTING AN ENTRY IN THIS CONTEST CONSTITUTES A GRANT OF AN IRREVOCABLE, ROYALTY-FREE WORLDWIDE LICENSE TO SPONSOR AND ITS AFFILIATES AND AGENTS TO REPRODUCE AND DISPLAY THE UPLOADED ENTRY, OR ANY DERIVATIVE THEREOF, IN ALL MEDIA NOW KNOWN OR HEREAFTER DEVISED, INCLUDING, WITHOUT LIMITATION, THE INTERNET, IN PERPETUITY. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries. Such entries are void and will be disqualified. Sponsor is not responsible for entrant’s inability to connect to any website or to upload the entry. Sponsor, in its sole discretion, may feature any submission submitted in this Contest at any time during, or after, the Entry Period on any related websites, in any promotional materials, whether related or unrelated to the Contest, and at any other location, whether physical or online, that Sponsor, in its sole discretion, deems appropriate for the operation and promotion of this Contest.

Sponsor’s Rights to Entries:  By entering this Contest, entrant understands and agrees that Sponsor and anyone acting on behalf of Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, their entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this Contest, entrant represents and warrants that their entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. Entrant agrees to indemnify, defend and hold harmless the Contest Entities from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her entry (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related or other cause of action whatsoever. For greater certainty and the avoidance of any doubt, Sponsor reserves the right, in its sole and absolute discretion and at any time, to disqualify any entry (or any component thereof) if a complaint is received with respect to the entry, or for any other reason.  If such an action is necessary at any point during or after the Contest, then Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances, including, without limitation, disqualifying the entry and/or the associated entrant.

Winner Determination:  By July 14, 2023, one (1) winner will be determined by a panel of three qualified judges determined by Sponsor in its sole discretion based on the following judging criteria (“Judging Criteria”):  

Judges will score entries for entered category based on the following judging criteria:

-Creativity/Originality  

-Fit to Theme

-Engagement (Viewing Campspot’s Almanac page via Gleam contest page)

A 5-point scale will be used where 1 = Poor (the lowest score), 2 = Weak, 3 = Average, 4 = Strong 5 = Excellent (the highest score).

Scores will be averaged together to determine each entry’s overall score. The entrant with the highest score based on the Judging Criteria will be deemed a potential prize winner.  In the event of a tie, the entrant whose submission received the highest score for Fit to Theme, as determined by the qualified judges, in their sole discretion, will be deemed the potential winner.  

Notification and Requirements of Potential Winner: On or about July 14, 2023, Sponsor will send an email message to a potential winner’s email address stated on the entry submission with instructions on how to claim the prize. A potential winner will be required to respond via email to the notice within forty-eight (48) hours in order to win.  The potential winner will be required to execute and return to Sponsor a declaration of eligibility, a liability release and, where lawful, a publicity release within ten (10) days of date of issuance. If documents are not returned within the specified time period, prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Official Rules, the prize will be forfeited.  Unclaimed prizes may not be awarded.

Prizes:  Up to one (1) winner will receive a $10,000 travel stipend (fulfilled by Campspot credit available for use by contacting marketing@campspot.com and to be used by December 30, 2023), $6,000 “salary” (fulfilled by Visa gift card(s) that may be used toward travel costs), and a three-month membership to the virtual concierge service Yohana. The prize has a total approximate retail value (“ARV”) of up to $16,750.  Campspot reserves the right to substitute any prize with another prize of equal or great value in the event the foregoing advertised prize is not available. 

Actual/appraised value of prize may differ at time of prize award. Any difference between the indicated ARV and the actual value will not be credited.  The specifics of the prize shall be solely determined by Sponsor and/or the prize provider. No cash or other prize substitution shall be permitted except at Sponsor’s discretion. Sponsor reserves the right to substitute a prize with another prize of equal or greater value. The prize is non-transferable, with no cash redemption, equivalents, or substitutions except at Sponsor’s sole and absolute discretion. Any dispute as to the correct person to receive the prize will be decided by Sponsor at its sole discretion. The winner is responsible for all costs and expenses not set forth herein, as well as any federal, state, and/or local taxes imposed as a result of acceptance of the prize.  Sponsor and/or the prize provider will issue an IRS Form 1099 tax form in the amount of the prize retail value as stated herein for any prize with retail value of $600 or more. Sponsor will not replace any lost or stolen prizes or prize components. The prize is subject to and a winner must abide by Sponsor’s and the campground’s booking terms and conditions which are available on Sponsor’s website.

NO WARRANTY:  ALL PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).

General Conditions:  Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such cases, Sponsor may select a winner from eligible entries received before and/or after the action taken by Sponsor if appropriate. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to:  multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Entry materials that have been tampered with or altered are void. No responsibility is assumed for: (i) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, mobile device, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems; or (ii) any injury or damage to entrant’s or any other person’s mobile device or computer related to or resulting from participating in the Contest. 

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials, privacy policy or terms of use on Sponsor’s website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control, and the discrepancy will be resolved in Sponsor’s sole discretion. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained here. 

Release and Limitations of Liability:  By entering into and participating in the Contest, each entrant agrees to release, discharge, indemnify, and hold harmless the Contest Entities from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to: (i) entrant’s participation in the Contest; (ii) entrant’s acceptance, use or misuse of a prize (including, without limitation, any liability, illness, loss, damage, personal injury, death, litigation or claim that may occur, directly or indirectly, whether caused by negligence or not); (iii) unauthorized human intervention in any part of the Contest; (iv) electronic or human error in the administration of the Contest or the processing of entries; (v) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (vi) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vii) printing errors; and/or (viii) lost, late, misdirected, or undeliverable mail. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of a prize. 

Under no circumstances shall entrant be permitted to obtain awards for, and entrant hereby waives all rights to, punitive, incidental, and/or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e., costs associated with entering the Contest). Entrant further waives all rights to have damages multiplied or increased. Because some states do not allow the exclusion and/or limitation of liability for consequential or incidental damages, in such states, Sponsor’s liability is limited to the maximum extent permitted by law.

Collection and Use of Personal Information:  When an entrant submits an entry, such entrant is providing information to Sponsor. The Privacy Notice on Sponsor’s website (https://Campspot.com/about/privacy) also applies to this Contest. Sponsor will use personal information as necessary in order to conduct and manage the Contest, and where Sponsor has a lawful basis to do so, to send marketing communications to entrant. Sponsor may disclose personal information to its related companies, agents, and contractors to assist in conducting and managing this Contest, communicating with entrant, or storing data. This may include disclosures to organizations outside the United States.

Opt-Out from Contest:  After completing the entry steps, entrants that wish to be removed from the Contest entry list and decline the chance to win a prize can email support@campspot.com and include “Campspot Summer COO Contest” in the subject line along with their first and last names and email address in the body of the email.

Disputes:  The Contest and these Official Rules are governed by and shall be construed in accordance with the laws of the State of Michigan, without regard to the principles of conflicts of laws.  All disputes shall be resolved exclusively in the state or federal courts in the State of Michigan, and entrant expressly consents to the jurisdiction of said courts and waives any objection thereto. All applicable federal, state and local laws and regulations apply. By participating in this Contest, entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action.

No Endorsement:  This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, Google or any other social networks that are used to share the Contest. Entrant understands that entrant is providing their information to Sponsor and administrator of this Contest and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, Google or any other social network.

Results:  To request a copy of the winners list, please contact Sponsor. Requests must be sent within four (4) weeks of the end of the Entry Period.
