Guest Stay Agreement, Terms & Conditions 

 

Welcome to Brickhouse RV Resort, 

Thank you for choosing to stay with us. We are pleased to welcome you and are committed to providing a safe, clean, peaceful, and enjoyable environment for all guests. 

Please take a few moments to review this Guest Stay Agreement ("Agreement"). It explains the terms, conditions, and Resort policies that apply during your stay. By signing below, you confirm that you have read, understand, and agree to follow this Agreement. 

 

1. Parties 

  • This Agreement is entered into between Brickhouse RV Resort (the "Resort") and the registered guest (the "Guest"). 

  • For the safety and security of everyone on the property, all individuals staying with the Guest must be registered with Resort management. 

  • This Agreement is for temporary lodging and use of Resort accommodations only. It is not intended to create a landlord-tenant relationship. 

2. Reservation and Site or Cabin Assignment 

  • Your reservation guarantees an RV site or cabin within the category you selected for the dates of your reservation. Specific RV site numbers are not assigned or guaranteed prior to check-in. 

  • Upon check-in, Guests may choose any available RV site within their reserved site category, subject to availability and Resort management approval. 

  • The Resort reserves the right to assign, reassign, or relocate Guests to another site or cabin of the same or a comparable category at any time if necessary for operational, maintenance, safety, or other business purposes. 

  • The Resort reserves the right to refuse service or terminate a reservation as permitted by applicable law and this Agreement.3. General Resort Guidelines 

  • Guests must be at least 18 years of age to make a reservation. 

  • Quiet Hours are from 9:00 PM to 9:00 AM. During these hours, please keep music, televisions, conversations, and other noise at a respectful level. 

  • The Clubhouse is open daily from 9:00 AM to 9:00 PM. 

  • Fireworks are not permitted anywhere on Resort property. 

  • Please treat fellow guests, visitors, Resort staff, contractors, and Resort property with courtesy and respect. 

  • Threatening, abusive, harassing, disruptive, violent, or illegal behavior may result in immediate termination of the stay and removal from the Resort without refund. 

4. Mail and Packages 

  • Mail and package pickup is available during office hours. 

  • Although the Resort may accept deliveries as a courtesy, Brickhouse RV Resort is not responsible for delayed, lost, stolen, damaged, missing, or misdelivered mail or packages. 

5. Caring for Your Site or Cabin 

  • Please keep your RV site or cabin clean, safe, and orderly throughout your stay. 

  • Trash must be placed inside the designated dumpsters. Food, trash, furniture, boxes, or other items may not be left outside the RV, cabin, or site. 

  • Please maintain proper water, sewer, and electrical connections and promptly report leaks or unsafe conditions to management. 

  • At departure, please leave the site or cabin in substantially the same condition in which it was received. 

  • Reasonable cleaning, repair, replacement, disposal, or damage charges may apply when excessive cleaning or repairs are necessary or when property is abandoned. 

  • Guests may not assign this Agreement, sublease a site or cabin, or advertise or rent accommodations through Airbnb, VRBO, or any similar service. 

6. RV Site and Vehicle Policies 

  • Each RV site includes parking for one vehicle. A second vehicle is permitted only when it fits completely on the concrete pad without blocking the roadway, neighboring sites, or utility access. 

  • Parking on vacant RV sites, grass, marked areas, coned-off areas, fire lanes, or roadways is not permitted. Vehicles parked in violation of this policy may be towed without notice at the vehicle owner's expense. 

  • Boats, utility trailers, cargo trailers, storage trailers, box trailers, storage containers, and vehicle repairs are not permitted on RV sites unless management has given written approval. 

  • Washing a vehicle, boat, trailer or RV is permitted only after payment of the $50 water usage fee. 

  • RVs more than 10 years old require prior management approval. 

  • Please keep sewer connections secure, limit outdoor clutter, and do not install permanent structures or storage arrangements. 

7. Cabin Policies 

  • Cabins accommodate a maximum of two guests. 

  • To help keep our cabins clean and comfortable, smoking, vaping, and pets are not permitted inside cabins. 

  • Cabins may not be assigned, transferred, or sublet. 

  • Guests are responsible for damage, missing items, excessive cleaning, or other charges associated with their cabin stay. 

8. Pet Policy 

  • RV sites may have a maximum of two pets. 

  • Pets must remain on a leash no longer than six feet whenever they are outside the RV. 

  • Please clean up pet waste immediately and dispose of it properly. 

  • Pets must be supervised at all times and may not be left outside unattended. 

  • Guests must prevent excessive barking, aggressive behavior, or any disturbance to other guests. 

  • Animals displaying aggressive behavior are not permitted. 

  • Service animals are welcome in accordance with applicable law. 

  • Pet violations may result in the following charges or actions: first offense, $50; second offense, $100; third offense, removal of the pet from the property. 

  • Guests are responsible for all injury, damage, cleanup, or other loss caused by their pets. 

9. Wildlife and Outdoor Food 

  • For the health and safety of guests and animals, please do not feed ducks, birds, cats, or any other wildlife on Resort property. 

  • Food, pet food, garbage, or other items that may attract rats, snakes, raccoons, insects, or other wildlife may not be left outside. 

  • A violation of this policy may result in a $200 charge. Repeated or serious violations may also result in termination of the stay. 

10. Pool Rules 

  • Pool hours are 9:00 AM to 9:00 PM. 

  • The pool is for resort guests only. Guests use the pool at their own risk, and no lifeguard is on duty. 

  • Children under 18 must be actively supervised by a responsible adult. 

  • For everyone's safety, diving, running, horseplay, pets, glass containers, alcohol, food, and beverages are not permitted in the pool area. 

  • Please follow all posted pool rules and any instructions provided by Resort staff. 

11. Children and Guest Safety 

  • Parents and guardians are responsible for supervising children at all times. 

  • Children should not play in roadways, between or underneath RVs, around utility pedestals, or near electrical cords, water hoses, or sewer connections. 

  • Please drive slowly, obey posted signs, and remain alert for pedestrians, children, and pets. 

12. Rates, Rent, and Payments 

  • Rent is due in advance on the 1st day of each month. 

  • Accepted payment methods include credit cards, debit cards, and other payment methods approved by management. 

  • Rates may be changed with advance notice when permitted by law and the applicable reservation terms. 

  • If full payment is not received by the due date, a late fee of $20 per day begins on the 3rd day after the due date, including weekends and holidays. 

  • Partial payments are not accepted. 

  • RV Guests: A $150 electric deposit is required, and electricity is billed at $0.12 per kilowatt-hour. 

  • Cabin Guests: A $300 cabin security deposit is required. 

13. Returned Payments 

  • Returned, rejected, reversed, or dishonored payments are subject to a $25 returned payment fee, in addition to any other amount due. 

14. Credit and Debit Card Processing Fee 

  • Card payments are processed securely through Stripe. A 2.69% processing fee applies to credit and debit card transactions. 

15. Prorated Rent and Early Departure 

  • Prorated rent is available only when the current month's rent and the following full month's rent are paid as required by management. 

  • Rent is prorated only on first invoice at the time of booking. 

  • No refund or prorated credit is provided when a Guest voluntarily leaves before the end of the reservation or paid rental period. 

  • Guests remain responsible for unpaid charges due under this Agreement. 

16. Payment Authorization and Automatic Payments 

  • To simplify billing, the Guest authorizes Brickhouse RV Resort to maintain a valid credit or debit card or other approved payment method on file. 

  • The Resort may charge amounts authorized under this Agreement, including rent, electricity, cleaning charges, damage repairs, replacement costs, unpaid balances, late fees, and other applicable charges. 

  • An itemized statement will be provided for post-departure charges when applicable. 

17. Guest Satisfaction 

  • We genuinely want you to enjoy your stay. If you experience a concern, please notify Resort management as soon as reasonably possible so we have an opportunity to assist you. 

  • The Resort will make reasonable efforts to address legitimate concerns promptly. 

  • If management is unable to reasonably resolve a significant issue, the Guest may voluntarily end the stay without an additional early-termination penalty. Any refund will be provided only as stated in this Agreement or as approved. 

18. Default and Termination 

  • A Guest may be considered in default for failing to pay amounts due, providing false or misleading information, violating Resort rules, committing criminal acts, engaging in threatening or disruptive conduct, refusing to leave after notice, or remaining after the Agreement or reservation expires. 

  • The Resort may terminate this Agreement immediately for serious violations or when otherwise permitted under this Agreement or applicable law. 

  • A Guest who is instructed to leave must peacefully vacate the property and remove all personal belongings, vehicles, and pets as directed by management. 

  • Failure to vacate may result in law-enforcement involvement, criminal trespass proceedings, towing, or other available remedies. 

19. Liability and Assumption of Risk 

  • Guests are responsible for using reasonable care while on Resort property and voluntarily assume the ordinary risks associated with staying at and using the Resort and its facilities. 

  • To the fullest extent permitted by law, Guests agree to release and hold harmless Brickhouse RV Resort, its owners, employees, officers, agents, and representatives from claims relating to personal injury, death, theft, property loss, or property damage arising from use of the Resort or its facilities, except to the extent caused by conduct for which liability cannot legally be waived. 

  • The Resort is not responsible for damage or loss caused by severe weather, hurricanes, flooding, hail, wind, falling trees or branches, utility interruptions, power outages, voltage fluctuations, theft, acts of other guests, or other circumstances beyond the Resort's reasonable control. 

  • Guests park vehicles and place personal property on Resort property at their own risk. 

  • Please report emergencies or criminal activity directly to local law enforcement and notify Resort management as soon as safely possible. 

20. Electrical, Water, Sewer, and Utility Disclaimer 

  • Guests are responsible for ensuring that their RV electrical, water, and sewer systems are safe, properly maintained, and correctly connected. 

  • The Resort is not responsible for damage caused by improper connections, faulty RV equipment, defective surge protectors, voltage fluctuations, utility provider outages, water interruptions, sewer interruptions, or similar events beyond the Resort's reasonable control. 

  • Guests are responsible for damage, cleanup, or costs caused by leaking hoses, improper sewer hookups, electrical defects, or other unsafe equipment belonging to the Guest. 

21. Severe Weather and Events Beyond Resort Control 

  • The Resort is not responsible for delays, interruptions, closures, or inability to provide services due to hurricanes, flooding, severe weather, fire, governmental orders, utility failures, acts of God, or other circumstances beyond the Resort's reasonable control. 

  • Guests are responsible for monitoring weather conditions and following evacuation orders or safety instructions issued by public authorities or Resort management. 

22. Theft of Service and Criminal Trespass 

  • Failure to pay for services may constitute Theft of Service under Texas Penal Code Section 31.04. 

  • Remaining on Resort property after being instructed to leave may constitute Criminal Trespass under Texas Penal Code Section 30.05. 

  • Brickhouse RV Resort reserves all civil and criminal remedies available under applicable law. 

23. Refund Policy 

  • ACH or money order refunds are generally processed within 30 days. 

  • Credit or debit card refunds are returned to the original card and are generally processed within 15 business days. 

  • Financial institutions may require additional time to post a refund after the Resort processes it. 

24. Governing Law 

  • This Agreement is governed by the laws of the State of Texas. 

25. Entire Agreement and Changes 

  • This Agreement, together with the reservation confirmation and any written addenda, constitutes the entire agreement relating to the Guest's stay and supersedes prior verbal or written discussions on the same subject. 

  • Any exception or modification must be approved in writing by Resort management. 

26. Miscellaneous 

  • If the Resort does not enforce a provision at one time, that does not waive its right to enforce the same or another provision later. 

  • If any provision is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. 

  • To the extent permitted by law, the Resort may recover reasonable collection costs, court costs, and attorney's fees incurred in collecting unpaid balances or enforcing this Agreement. 

  • Brickhouse RV Resort reserves the right to refuse service as permitted by applicable federal, state, and local law. 

Guest Acknowledgment 

 

By signing below, I acknowledge that: 

  • I have read and understand this Agreement. 

  • I agree to follow all Resort rules and policies. 

  • I authorize payment of charges permitted under this Agreement. 

  • I understand that this Agreement is for temporary lodging and is not intended to create a landlord-tenant relationship.
