Camp Tails & Trails RULES AND POLICIES

The following Rules and Policies apply to all guests to Camp Tails and Trails RV and Tent Campground. These Rules and Policies are in addition to and incorporate herein by reference the terms of the Assumption of Risk, Waiver, and Release each guest must sign before entering the Campground. Camp Tails and Trails reserves the right to remove from the Campground any guests whose conduct is deemed improper or in violation of these Rules and Policies. Your cooperation with these Rules and Policies is appreciated and will help make Camp Tails and Trails a fun and safe environment for all guests. Thank you.

RVs, Campers, Trailers & Vehicles

  • One recreational vehicle (RV/Camper) and one regular vehicle (car or regular size truck) OR trailer are permitted per campsite
  • All RVs, Campers, Trailers and accompanying vehicles of any type must be in safe, working condition. There may not be any mechanical issues with your equipment that cause damage to the campground, utilities, or other guests or their property.
  • Golf Carts are permitted for use around the campground. Please be respectful of other guests and their dogs. Some dogs may be fearful of or reactive towards moving vehicles. Please go slow, drive safely, and give everyone plenty of space.
  • Motorcycles, mopeds, scooters, and other such vehicles may be used to enter and exit the campground, but we ask that guests keep speed slow and noise to a minimum and refrain from using these types of vehicles to travel around the campground.
  • ATVs, dirt bikes, go carts, and the like may not be driven on the property.
  • Bicycles are welcome, as long as ridden safely and with respect for space of other guests and their dogs.
  • You are responsible for any damage caused by you or your vehicle while on campground property, to the campground, other guests, and other guests’ property.
  • You are responsible for the safety of your own vehicle. Camp Tails and Trails is not responsible for any damage that may occur to your vehicle.
  • All vehicles must be operated safely and responsibly. If any guest is seen driving recklessly or not following these rules, we may ask them to leave or refrain from using their vehicle for the remainder of their stay.

Campsites

  • Tent and RV/ Camper / Van camping is permitted in designated areas only. All sites are tent compatible. Designated tent only sites may only be used by tent guests.
  • Guests may bring solar showers to use at their campsites.
  • You are responsible for cleaning up your campsite daily. Leftover food and trash will attract bears and other unwanted wildlife to your campsite. There are dumpsters located near the campground exit for guests to use. If excessive trash is found at your campsite once you have checked out, Camp Tails and Trails reserves the right to apply a $50.00 cleaning fee to your final charges.
  • Quiet time is from 10:00pm until 7:00am. Please be respectful of others, and help us maintain a quiet, peaceful, relaxing environment for everyone.
  • DO NOT enter another guest’s campsite without being invited.
  • DO NOT approach another guest’s dog without being invited.
  • Children 12 and under must be accompanied by an adult at all times. Children are certainly welcome, but please make sure your children respect appropriate boundaries and personal space when near other guests’ dogs. Not all dogs are comfortable being approached by strangers, and we want to make sure all of our guests are safe and comfortable at all times. Children are not allowed to taunt, tease, or yell at campers or their dogs, or otherwise cause disruption for fellow guests. Guests are responsible for the actions and safety of any children in their custody, care, or keeping.
  • Any aggressive behaviors towards humans or dogs (verbal or physical) will result in termination of your stay. No refunds will be given.
  • There is wildlife around the campground. Do not leave out food or trash. Please place in designated dumpster. Do not approach or feed wildlife. Do not let your dogs or children harass, feed, approach, or kill the wildlife.
  • The campground is in the woods, there are trees, roots, branches, and uneven ground. Please watch your step and stay on the cleared paths.
  • Guests shall be solely responsible for any damage, intentional or accidental, they cause to the campsites or other property or equipment on the campground.
  • In case of bad weather, it is your responsibility to store or secure all belongings.
  • Guests shall observe common courtesy at all times, and shall conduct themselves in a civilized, polite, and orderly manner at all times. As such, use of profanity or abusive language, loud behavior, or offensive activity including public intoxication beyond reasonable expectations may result in termination of your stay..
  • Neither Camp Tails and Trails, or any of its employees or agents are responsible for any fire, theft, or acts of God causing damage to property belonging to guests, nor shall Camp Tails and Trails be liable for any personal injuries to any guests on the campground.
  • Any signs or flags that are vulgar, offensive, or contain any suggestive material are prohibited in the campground. Camp Tails and Trails reserves the right to require the removal of anything that might be deemed unsafe or inappropriate.

Pets

  • All dogs are welcome. There are no breed or size restrictions. However, unruly or aggressive dogs are not permitted. We ask for everyone’s help in keeping our campground safe and free of dangerous incidents that may compromise the safety of the campground.
  • Dogs must be kept on a 6′ leash when not inside your RV or a fenced enclosure. Guests must be able to control their dogs at all times.
  • Dogs may not enter other guests’ campsites, unless invited by the guests.
  • Dogs may not show aggressive behavior towards other guests or their pets. Camp Tails and Trails reserves the right to ask guests to leave if their pets are aggressive and pose a threat to other guests. No refund will be provided.
  • Dogs must be accompanied by their owners at all times.
  • Dogs may not be left outside when owners are not present.
  • Dogs may not be loose at any time.
  • It is the responsibility of the owners to clean up after your dogs. Dog owners shall immediately clean up all animal waste and dispose of it in an appropriate and sanitary way. There are dog waste receptacles placed around the campground for your convenience.
  • Owners must be able to provide proof of current rabies vaccination if asked. By signing, you agree that your dog is up to date on their rabies vaccination.
  • Cats are welcome, but must stay inside your RV or camper while at the campground, for their own safety. We ask that you do not walk cats around the property or let them loose outside of your vehicle as this can be unsafe around unknown dogs.
  • No other animals are permitted, unless they stay inside your camper at all times. This must be discussed with Camp Tails and Trails ownership before your reservation is approved.
  • Exotic animals are not permitted.
  • Any damage done to persons, property, or pets by any animal belonging to you or in your care or keeping may result in termination of your stay. No refunds will be given. You are responsible for any monetary expenses that may result from damage caused by any animal belonging to you or in your care or keeping.
  • Any animal that attacks, threatens, or bites any person or other pet, must be removed from the campground immediately.

Alcohol, Firearms, Fireworks & Video Recording

  • Alcohol is permitted within your campsite and common areas. Please use responsibly and be considerate of other guests. Loud, unruly, or dangerous behavior may result in you and your party being asked to leave the campground.
  • Firearms: Discharging of any firearm is prohibited in the campground.
  • Fireworks are prohibited in the campground.
  • Illegal drugs are prohibited on campground property.
  • Professional video recording for the use of publication or reproduction to be used for news, promotional purposes, webcasts, and/or advertising is prohibited unless granted permission by owner.

These Rules and Policies are subject to change at any time, in Camp Tails and Trails sole and absolute discretion. Camp Tails and Trails decisions regarding the interpretation and enforcement of these Rules and Policies are final and are not subject to review. Failure to follow these rules may end in termination of your stay.

 

Camp Tails and Trails Libility Waiver

This Assumption of Risk, Waiver, and Release Agreement (the “Agreement”) is made on the date signed below by the undersigned Releasors on behalf of himself/herself, any minor in the custody of the Releasor, their heirs, executors, administrators, and assigns (collectively, the “Releasors”). In consideration for being permitted to enter upon and use the facilities, premises, and equipment (the “Facilities”) owned and/or operated by Camp Tails and Trails, LLC (hereafter referred to as the “Releasee”) and/or to engage in various recreational activities (the “Activities”), the Releasors agree as follows:

1)  ACKNOWLEDGEMENT OF RISKS.  The Releasors agree and understand that use of the Facilities and taking part in the Activities provided by the Releasee can be HAZARDOUS AND MAY INVOLVE THE RISK OF PHYSICAL INJURY AND/OR DEATH. The Releasors acknowledge and understand that the Facilities and the Activities are inherently dangerous and fully realize the dangers of using the Facilities and participating in the Activities. The risks and dangers of the Facilities and/or Activities may arise from, but are not limited to: dogs; cats; vehicles; bicycles; motorcycles; golf carts; trees; actual or alleged transmission of a communicable disease such as COVID-19; wind; impacts with other individuals and/or equipment; contact with manmade and natural objects and debris; weather conditions; exposure to the elements; slips and falls; equipment failure and/or defects; perils and hazards arising from wildlife, including but not limited to, snakes, bears, deer, possums, raccoons, foxes, rabbits, and insects; imperfect conditions; road and surface hazards; inadequate safety measures; situations beyond the control of the Releasee; other undefined harm or damage which may not be readily foreseeable; latent and patent defects; other presently unknown risks and dangers; mental distress from exposure to any of the above; and the negligent acts or omissions of other guests, the operator of the various Facilities and/or Activities, and the Releasee, together with their respective agents, employees, and/or contractors as the case may be. The Releasors acknowledge and understand that the description of the risks and dangers of the Facilities and/or Activities provided herein is not complete and that use of the Facilities and/or participating in the Activities can be dangerous and may include other risks both known and unknown.

2)  PERSONAL RESPONSIBILITY.  The Releasors certify that Releasors have no physical or mental condition that precludes them from using the Facilities or participating in the Activities, and that they are not doing so contrary to medical advice. The Releasors understand that Releasors’ use of the Facilities and participation in the Activities is voluntary and further understand that they can inspect Releasee’s Facilities before any participation. The Releasors understand that Releasors are obligated to follow the rules of the Releasee and that they can minimize risk of injury by doing so, by utilizing personal safety equipment, and through the exercise of common sense by being aware of their surroundings. If, while using the Facilities or participating in the Activities, the Releasors observe any unusual hazard or condition that they believe jeopardizes the personal safety of the Releasors or that of others, Releasors will remove themselves from use of those Facilities and/or from participation in the Activities and immediately bring said hazard or condition to the attention of the Releasee. Releasors agree to be solely responsible for the safety and wellbeing of themselves. Releasors agree that the Releasee is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

3)  RULES AND LAW.  The Releasors acknowledge receipt and/or review of the Releasee’s Rules and Policies and agree to follow them. The Releasors acknowledge and agree to follow any and all laws applicable to them, including, without limitation, laws prohibiting the operation of equipment/vehicles while intoxicated, public intoxication, harassment, disorderly conduct, and the like. The Releasors understand that the Releasee may immediately end the Releasors’ use of the Facilities and/or engagement in Activities and remove the Releasors from the premises in the event the Releasors fail to strictly adhere to the Releasee’s Rules and Policies or applicable law, or to follow the instructions of its owners, agents, employees, or operators. 

4)  ASSUMPTION OF RISK.  The Releasors acknowledge that use of the Facilities and participation in the Activities is voluntary and, as such, Releasors knowingly and freely assume all risk of injury, loss, expense, or damages arising from their use of the Facilities and engagement in the Activities, even those caused by latent or patent defects and/or the negligent acts or conduct of the Releasee, its owners, affiliates, operators, employees, agents, officers, directors, members, and/or any entity to which the Releasee owes a contractual indemnification obligation. The Releasors understand that there are inherent risks of using the Facilities and participating in the Activities which may be both foreseen and unforeseen and include serious physical injury and death. The Releasors understand that the risks may be caused in whole or in part by their own actions or inactions, the actions or inactions of others, or the actions, inactions, or negligence of the Releasee and hereby expressly assume all such risks and responsibility for any damages, liabilities, losses, or expenses which Releasors may incur.

5)  WAIVER OF CLAIMS.  The Releasors hereby waive and agree to hereafter waive any claims for injury, loss, expense, or damages which the Releasors have or may have against the Releasee arising out of the Releasors’ use of the Facilities and/or participation in the Activities provided by the Releasee.

6)  RELEASE.  The Releasors hereby release the Releasee, its owners, affiliates, operators, employees, agents, officers, directors, members, and/or any entity to which the Releasee owes a contractual indemnification obligation from all liability for any injury, loss, expense, or damage that the Releasors may suffer arising out of, resulting from, or relating to their use of the Facilities and/or participation in the Activities. The Releasors specifically understand that they are releasing any and all claims that arise or may arise from latent or patent defects on the premises and/or any negligent acts or conduct of the Releasee, its owners, affiliates, operators, employees, agents, officers, directors, members, and/or any entity to which the Releasee owes a contractual indemnification obligation, to the fullest extent permitted by law. Nothing in this Agreement shall be construed as a release for conduct that is found to constitute gross negligence or intentional conduct on behalf of the Releasee.

7)  INDEMNITY.  The Releasors agree to hold harmless, defend, and indemnify the Releasee, its owners, affiliates, operators, employees, agents, officers, directors, members, and/or any entity to which the Releasee owes a contractual indemnification obligation from all liability for any loss, damage, injury, death, or expense, including, but not limited to, that caused by latent or patent defects on the premises and/or the negligent act or omission, in whole or in part, of the Releasee, its owners, affiliates, operators, employees, agents, officers, and/or any entity to which the Releasee owes a contractual indemnification obligation, that the Releasors may suffer, arising out of the use of the Facilities and/or participation in the Activities.

8)  ANIMALS.  The Facilities accommodate animals. Releasors hereby acknowledge and agree that Releasee shall not be liable for any injury or damage to any person or thing caused by any animal in, on, or about the premises. Releasors further acknowledge and agree that the animals on the premises are not owned by Releasee, are not in the care or keeping of Releasee, that Releasee accepts no responsibility for the care or keeping of the animals, that Releasee has no control over the animals, and that Releasee has no knowledge of the propensities of the animals.

9)  PROPERTY DAMAGE.  The Releasors hereby acknowledge and agree that Releasors are solely responsible for any and all damage to property owned by the Releasee which is caused by the Releasors’ own acts or omissions. Releasors agree to reimburse the Releasee the cost and expense the Releasee, in its sole discretion, determines it will incur in repairing the damage immediately upon the conclusion of the use of the Facilities and/or participation in the Activities undertaken by Releasors. To secure payment or partial payment of any such damage, Releasors shall place a security deposit with the Releasee in the amount of Five Hundred Dollars ($500.00) either in cash or by way of a pre-authorization hold with the credit or debit card used by the Releasors in this transaction. Releasors hereby authorize the Releasee to charge against the security deposit any costs or expenses incurred or to be incurred by the Releasee in repairing or replacing the damage caused by the Releasors. If the security deposit is insufficient to cover the cost of the damage, the Releasee will send the Releasors an invoice for the balance, and Releasors shall pay the invoice within thirty (30) days of receipt thereof.  

10)  CONSENT TO JURISDICTION AND WAIVER OF JURY TRIAL.  Any action commenced by the Releasors against the Releasee, its owners, affiliates, operators, employees, agents, officers, members, and/or directors, arising from any injury, loss, expense, or damage alleged to have been sustained upon the premises or Facilities of the Camp or while participating or engaging in any of the Activities, shall be brought exclusively in the Horry County Court of Common Pleas and tried without a jury. The Releasors hereby knowingly and voluntarily waive their right to a trial by jury in any such action. The Releasors hereby submit and consent to the exclusive jurisdiction and venue of the Horry County Court of Common Pleas and waive their right to bring an action in any other jurisdiction or venue. This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina, without giving effect to its conflicts of law provisions. To the extent that any portion of this Agreement is deemed to be invalid under applicable law, the remaining portions of the Agreement shall be severable and binding upon the Releasors. In any action commenced by the Releasee against the Releasors to enforce any term of this Agreement, the Releasors agree to pay the Releasee’s attorney’s fees and costs as an additional element of damages.
