TERMS AND CONDITIONS
CITY OF DUNCAN LAKE CAMPGROUNDS
Terms and Conditions
All guests, visitors, and other occupants must adhere to the Rules and Regulations, posted rules, as well as instructions provided by City of Duncan Staff. Staff reserves the right to remove anyone violating these guidelines, Rules and Regulations, or posted rules. Please note, no refunds will be issued for voluntary departure, acts of nature, or removal due to violations, law enforcement, or court orders.
Payment Policies
· Payments are due in full at time of booking.
All Reservation Policies
· Guests must be 18 years of age or old older to book.
· Refunds will not be issued for no shows.
Booking Policies
· A credit card is required to be on file for any reservation.
· Any damages to the camping area, whether caused by myself, my children, my guests, or my pets, must be reported to the City of Duncan Public Works Office immediately or upon checkout. Any damages that occur during my stay will be charged to my credit card.
Check In/Check Out Times
· Check-in Time: 2:00 PM
· Check-out Time: 12:00 PM
Cancellation Policy
· Cancellations made 30 days or more prior to arrival will receive a full refund minus the service/credit card fees.
· All refunds will be made in the same form of payment used to secure the reservation.
Defaults and Removal
· Failure to pay fees when due, abide by campground rules, or respond to official communications from City of Duncan constitutes a default under this agreement. Upon default, City of Duncan may revoke Guest’s permit to occupy the premises. If Guest fails to vacate, City of Duncan reserves the right to remove Guest and any property remaining on the site in accordance with applicable law.
Pets
· Pets must always be kept on a leash, Pets cannot be left unattended at campsites, tie-outs are not permitted per City of Duncan ordinance.
· Guests must ensure their pets do not disturb other campers – excessive barking, howling, or aggressive behavior will not be tolerated.
· Guests are responsible for cleaning up after pets.
· All pets must be up to date on vaccinations, and proof of vaccination must be available upon request.
· Pets, with the exception of service animals, are not permitted in any City of Duncan buildings.
· Guests assume full responsibility for the pets and agree to release the City of Duncan, employees, and agents from any and all liability arising from pet related injuries, damages, or accidents.
Child Safety
· Children 14 and under must be supervised by an adult (18+) at all times.
Waste Disposal
· Ground disposal of any gray or black water is strictly prohibited and must be disposed into the sewer.
· Trash must be placed in the appropriate trash receptacles.
Guest Responsibility for Damage & Conduct
· Guests are financially responsible for any damage to the campground, including but not limited to electrical pedestals, water and sewer connections, buildings, roads, landscaping, picnic tables, fire pits, grills, or other park property whether caused by their RV, vehicles, equipment, campfires, pets, or actions of themselves, their family members, invitees, or visitors. The City of Duncan may charge the credit card on file or otherwise bill the Guest for the full cost of repair, replacement, cleanup, or remediation.
Release and Waiver of Liability
In consideration of City of Duncan, including its directors, officers, members, managers, employees, representatives, volunteers, and agents (collectively referred to hereinafter as “City of Duncan”), allowing Guest(s) to use the Premises and Rental Site, which includes various recreational activities/amusements offered by City of Duncan, Guest, including all signatories hereto and any children, including minors, other family and visitors of Guest(s) (“Guest Parties”), hereby acknowledges, understands, and agrees to the terms of the following release of all liability waiver (“Release”):
Guest Parties hereby freely, voluntarily, and without duress execute and agree to this Release and acknowledge the forfeiture of a legal right in accordance with the following terms:
Guest Parties waive, release, and discharge City of Duncan Parties from all claims and liability for personal injury, accidents, property damage, or any other claim arising from Guest Parties’ use of the Rental Site and Premises, including Guest Parties’ use of Guest Parties’ personal property thereon. Guest Parties relinquish all rights to file a claim, including for ordinary or gross negligence, and assume all risks associated with Guest Parties’ use of the Rental Site and Premises.
Guest Parties’ release and agree to hold harmless City of Duncan Parties from all liability related to damage to Guest Parties’ vehicle(s), Unit(s), boats, golf carts, automobiles, trucks, trailers, or other personal property, including equipment, and assume all risks associated with Guest Parties’ stay while on the Premises, whether caused by accidents, negligence (ordinary or gross), weather conditions, rocks slung from mowing equipment, machinery used by maintenance crews, falling trees, limbs, animals, or any other inherent risks of camping and outdoor activities.
As a courtesy, City of Duncan employees may, upon request, assist with directing Guest Parties to their designated campsite. However, Guest Parties remain solely responsible to ensure that the site will accommodate their specific trailer or RV and that no branches, bollards, trees, or other obstacles are struck when positioning the unit. Guest Parties agree to release, waive, discharge, indemnify, defend, and hold harmless City of Duncan Parties from any and all liability, loss, damage, or expense (including attorney’s fees) arising from or related to any assistance provided by an employee in directing or assisting them to their campsite.
Guest Parties voluntarily assume and understand that camping and recreational activities inherently involve risks, including but not limited to exposure to natural elements, wildlife, uneven terrain, and other outdoor conditions, which may result in personal injury, property damage, or death.
Guest Parties understand that staying in a public campground may expose Guest Parties to contagious diseases, including but not limited to COVID-19, and Camper Parties voluntarily assume all risks associated with potential exposure during Guest Parties stay on the Premises.
Guest Parties also acknowledge that Guest Parties are responsible for all medical expenses that may arise from injuries sustained during Guest Parties stay on the Premises.
Guest Parties agree to indemnify, defend, and hold harmless City of Duncan Parties from any claims, actions, damages, costs, or expenses, including attorney's fees, arising out of or relating to any injury, damage, or loss suffered by Guest Parties while on the Premises.
Guest Parties acknowledge they are not tenants but licensees of City of Duncan. City of Duncan may terminate Guest Parties license to enter the Premises at any time for any reason, and Guest Parties agree to leave the Premises upon request by City of Duncan.
This Release shall be binding upon Guest Parties, their heirs, next of kin, executors, administrators, and assigns.
This Agreement shall be governed by the laws of the state where the City of Duncan is located. Any dispute arising out of or relating to this Agreement shall be brought exclusively in a court of competent jurisdiction located in the same county as the City of Duncan. Guest irrevocably submits to such jurisdiction and waives any claim of forum non conveniens.
City of Duncan shall not be liable for any failure or delay in performance or access to the premises due to acts of God, fire, flood, government orders, war, civil unrest, utility failure, pandemic, or other causes beyond its reasonable control.

By acknowledging below, Guest Parties acknowledge having received, read, and understood this Release, Agreement, the City of Duncan Rules and Regulations, and all incorporated terms. Guest Parties voluntarily agree to abide by these terms as a condition of occupancy.
