TERMS AND CONDITIONS

WE RESERVE THE RIGHT TO CHANGE YOUR SITE AT ANYTIME.

GENERAL INFORMATION:

  • Registered guests have access to all amenities. Amenities, including the pool, bathhouses, and lodge are for the use of PAID guests only. Family or guest(s) must be accompanied by PAID guests.

  • All buildings and pool deck are smoke free/vape free.

  • There is to be NO cutting of any trees or plants in the resort.  No tree climbing.  Please do NOT deface any tree or plant in the resort with screws, bolts, nails, or chains. Hammocks, swings, clothes lines are prohibited.

  • Guests may use rope lights wrapped on trees.

  • Vehicles of any kind are not allowed to drive or park on any grassy areas inside the resort. 

  • Vehicles CANNOT be washed in park.  No oil changes or vehicle repairs in the resort.  No exceptions.

  • No uncontrolled vehicle leaks, oil, power steering, transmission, radiator, etc. If a leak starts take whatever action necessary to keep the fluid off the concrete.

  • Out of respect for your neighbors please do not cut/walk or ride bikes through the yards of occupied sites.

  • Management reserves the right to refuse or discontinue rental for any reason.

  • Only adults and teenagers (16+) can drive a golf cart or vehicle of any type within the resort. Golf Cart use only; NO ATV’S, DIRT BIKES, OFF ROAD VEHICLES, SCOOTERS

  • Motorized scooters are prohibited for children under the age of 16 yrs.

  • No use of skateboards or scooters after dark. No bicycles, skateboards, scooters or rollerblades allowed on pool deck or lodge ramps and patio area.

  • Parents must be present with their children at ALL times. Children are NOT allowed at/near the pool, or in the buildings without adult supervision.

  • The registered guest is responsible for the actions/behaviors of the children and other guests at their site.

  • Late fees will incur on the 6th day of the month in the amount of $35.00

  • Fireworks are prohibited on the property. 

  • Woodburning firepits are prohibited. Propane firepits are allowed on the concrete slab.

  • NO REFUNDS ON SITE FEES, OR EARLY DEPARTURES

  • Departure without 30-day notice will result in early departure penalty of $   250.00            (circumstances of departure may be considered as exception).

RV SITE GENERAL INFORMATION:

  • RV sites must always be kept clean, free of clutter and orderly.  There can be no changes or modifications of any kind to an RV site without prior consent of the resort management.

  • RVs may NOT back up over the grass at the end of the site, without prior approval of the maintenance supervisor.

  • Sewer hose connections and water hoses must be sealed tight and have NO leaks.  All hoses, electrical and satellite cords must be kept off the ground for our lawn maintenance crew to do their jobs.

  • Satellite dishes/poles cannot be permanently affixed to the ground.

  • RVs must have NO visible damage or be in disrepair at any time. There can not be any window AC units or torn awnings. RV’s must be manufactured and self-contained.

  • Do not place rugs, tents or anything else on the grass that may damage the grass.

  •  A small refrigerator or freezer is permitted on your RV site.

  WASTE DISPOSAL:

  • Our resort dumpsters are for household trash ONLY. Break down all boxes before disposal.

  • No trash cans are allowed outside at your site. Never leave any trash outside your RV site or outside of the dumpster. Non-trash items that are prohibited: Tires, Mattresses, Fire Pits, Furniture of any kind, RV parts.

PET POLICY & DOG PARK RULES

There is a limit of 2 Pets per RV – unless prior approval by management. No aggressive breeds will be allowed such as Pit Bulls, Chows, Rottweilers, Wolfs, Doberman Pinchers or German Shepherds.

Collect & dispose of your dog’s waste both INSIDE and OUTSIDE of the dog park.  Use designated waste containers.  Do not dispose of waste in laundry and pool containers.

 

You are responsible for your pets and any harm or damage they may cause.  This includes chewing on the fence at Dog Park. 

 

Always keep your pet on a leash.  Pets are unpredictable and can escape quickly.

 

ABSOLUTELY:  No Pets allowed in Club House, Laundry Rooms, Pool area. 

As a courtesy to your neighbors, do not walk your pet in grassy area directly behind their RV.  This space belongs to the person occupying that site. 

 

Dog Park Rules:

  • Please keep dogs leashed when entering and leaving Dog Park

  • All dogs must have current rabies shots and all other required vaccinations. You must provide documentation upon check in.

  • Puppies under 4 months of age are prohibited in the dog park due to Parvo.

  • Dogs must wear current license tags.

  • Never leave dogs unattended in Dog Park.

  • Dogs must be spayed or neutered if they are going to be in the dog park.

  • Use of the dog park is at your own risk.  Dog owners are responsible for the actions and behavior of their dogs at all times.

  • Dogs showing any signs of aggression must be immediately leashed and removed from the park.  Please use the designated area for smaller dogs to keep issues to a minimum. 

 

Management reserves the right to deny access to Dog Park

 

Disclaimer:  You and your party are responsible to comply with Rules and Regulations of S&J Egret Bay RV Resort.  If you choose not to abide by them, it can result in termination of your reservation.  Per our policies there will not be any type of refund upon termination.  You and your party agree to take all responsibility for any injuries/damage sustained by yourself or other guests caused by your pet regardless of the situation.

POOL:

  • Pool hours are 10 Am to 9 Pm

  • No lifeguard is on duty; children under 18 years of age in the pool area must have a parent present.

  • No glass containers at the pool. (Plastic containers are allowed) No smoking or vaping. No food in pool area.

  • Guests must leave the pool immediately when a resort representative request that they do so.

  • No pets at/in the pool.

 

FISH CLEANING:

  • No cleaning of fish at RV Sites.

  • Do not dump crawfish /or boil water on the ground.

PARKING:

  • Park at your site only. NO parking on the grass (this includes golf carts), roads, or in unoccupied RV site without PRIOR resort approval. Overflow provided at the expense of Site Guest. 

  • All Vehicles must have current registration and be in working condition.  NO Disabled Vehicles/Golf Carts on site. 

 

LAUNDRY/BATHHOUSE:

  • Absolutely no washing of pet bedding or blankets of any kind. No pets in the laundry room, bathhouse(s).

  • Please do not leave unattended items in the bathhouse(s) or laundry room.

BUSINESS & SUBLEASING:

  • No business can operate out of an RV within the resort.  No sub-leasing or renting of RV units while on resort property.

 

Resort’s Right to Terminate Agreement: Resort may terminate this Agreement for any or no reason by providing Guest a notice to leave the RV Site (“Agreement Termination Notice”). Guest agrees to render peaceful possession of the RV Site to Resort within three (3) days of the date provided on the Agreement Termination Notice. The three (3) day notice shall not be required if termination is the result of an Act of Default (as defined below). Upon Guest’s peaceful surrender of the RV Site to Resort, Resort will refund to Guest the proportionate amount of any unused amounts previously paid by Guest to Resort.

 

Default by Guest: The following acts constitute defaults by Guest (“Acts of Default”)

  • Police are called to RV Site for any disturbances or unlawful behavior.

  • Failing to timely pay the RV Site use rate or other lawful charges when due under this Agreement;

  • Giving false information on any application to Resort;

  • Guest and/or occupants failing to comply with this Agreement, such as violating provisions of this Agreement or committing serious misconduct or criminal acts;

  • Remaining on the Property after giving notice of termination and intent to vacate.

  • Remaining on the Property after Resort gave notice of termination at the end of the term or an Agreement Termination Notice.

  • NO REFUNDS ON SITE FEES, OR EARLY DEPARTURES

 

Condition of RV Site: By executing this Agreement, Guest acknowledges and agrees that the RV Site is in good condition and is adequate for Guest’s use. Upon termination or expiration of this Agreement, Guest agrees to surrender the RV Site to Campground in a similar, good condition. If Guest fails to leave the RV Site in good condition, Resort will assess reasonable charges to Guest for returning the RV Site to good condition.

 

Assignment: Guest shall not have the right to assign or sublet the RV Site hereunder to any person or persons without Management Approval.

 

Attorney’s Fees: In the event any legal proceedings of any kind are instituted to collect unpaid rates or electrical charges, Resort may collect from Guest all reasonable costs and attorney’s fees incurred by Resort in pursuing such action.

 

Waiver: Failure to insist on strict compliance with the terms or conditions of this Agreement shall not be deemed a waiver of that term or condition, nor shall any waiver or relinquishment of any right or power at any one time or times be deemed a waiver or relinquishment of the right or power for all or any other times.

 

Notices: All written notices and communications regarding this Agreement, including notices sent pursuant to TEX. PENAL CODE 31.04(c), should be sent to the designated undersigned persons at the addresses as set forth below unless notified in writing to the contrary by the receiving party. The notice shall become effective as of the date of hand delivery or mail date.

 

Credit Card on File: Guest will provide Resort with information for a valid credit card to keep on file. The credit card information will be used by Resort for monthly rent and electric charges and if Resort must charge Guest for cleaning or repairing the RV Site, or if Guest vacates the RV site without paying Resort the total amount due under this Agreement. If Resort uses the credit card information for the reasons described above, Resort will provide Guest a statement of account listing the charges.

Non-Compliance Violations of Resort Policies 

1. 1st notice of violation is a verbal warning 

2. 2nd notice of violation is a $25.00 fee 

3. 3rd notice of violation is a $75.00 fee up to and including eviction. 

 

Guests may be evicted without a refund if they fail to comply with resort rules and policies. 

 

THEFT OF SERVICE AND CRIMINAL TRESPASS ACCORDING TO TEXAS PENAL CODE SECTION 31.04, a person commits theft of service if, with intent to avoid payment for service that the actor knows is provided only for compensation, the actor intentionally or knowingly secures the performance of the service by agreeing to provide compensation and, after the service is rendered, fails to make full payment after receiving notice demanding payment. “Intent to avoid payment” is presumed if the actor absconded without paying for the service or expressly refused to pay for the service in circumstances where payment is ordinarily made immediately upon rendering of the service, as in recreational vehicle parks. That is, any guest who leaves without paying for site services or who refuses to pay for site services when due may be subject to criminal prosecution. We will prosecute any violations under the “THEFT OF SERVICE LAW”.

 

NOTICE TO GUEST:

ACCORDING TO TEXAS PENAL CODE SECTION 30.05, a person commits an offense if the person enters or remains on or in property of another, including a recreational vehicle park, without effective consent and the person had notice that the entry was forbidden or received notice to depart but failed to do so. That is, any guest who receives notice to leave and refuses to do so may be subject to criminal prosecution. If we ask you to leave, you must vacate Resort’s property. We will prosecute any violations under the “CRIMINAL TRESPASS LAW.”

RELEASE AND WAIVER OF LEGAL LIABILITY & POLICY ACCEPTANCE

This is your release and waiver of liability (The Release). You release S&J Egret Bay RV Resort, LLC its owner, directors, officers, employees, agents, workcampers and/or others acting on its behalf of any legal liability.  You agree that this Release is effective immediately upon signing.  Do not sign this until you have any questions answered.  If you wish to know more about the possible dangers and risks, please inquire at the Office prior to signing.

I provide this release freely and without duress under the following terms:

  1. General Release: I hereby release Egret Bay RV Resort, and hold them harmless from any, and all claims that may arise from activities that I may be involved in.  I am providing this Release and Waiver of Liability to Egret Bay RV Resort so that I may be allowed to participate in and use the facilities and equipment.

  2. Assumption of Risks:  I hereby expressly and specifically assume all risk of injury, illness, death, or property damage resulting from my activities while using or participating in any activities or function.

  3. Personal Property: I hereby release The Egret Bay RV Resort and hold them harmless for all claims of damage to any personal property (RV, Vehicles, Lawn furniture, etc.)

  4. Insurance: I understand I am expected to have my own health insurance and personal property insurance.  I am not relying on Egret Bay RV Resort to maintain insurance coverage should I be injured or become sick or damage to any personal property.

  5. Photographic Release: I consent to being photographed and to allow Egret Bay RV Resort to use photographs; please let the person know that is taking pictures if you do not approve.

I AGREE TO COMPLY WITH ALL OF THE Campground Rules and Regulations I have received and as posted in the office and/or on the grounds, including Pet Policy and Dog Park Rules.
