Terms and Conditions

Gap Mountain Retreat - Montgomery County, Virginia

General:

  1. Guests are responsible for any damage or injury caused by themselves and/or their children or members of their booking.

  2. Guests assume any and all risks arising from use. 

  3. To the fullest extent permitted by Virginia Law, guests agree to release and discharge Gap Mountain Retreat and its staff from liability and Indemnify and hold harmless the Retreat from claims arising from use. The Retreat is not responsible for personal injuries or damage, loss or theft of any personal property or vehicle.

  4. We reserve the right to evict any person(s) who does not comply with the rules and policies.

  5. The total number of guests in any space cannot exceed the maximum capacity for that site.

  6. Maintenance on and/or washing vehicles on property is not allowed.

  7. All spaces are to be kept neat and clean for the duration of your stay.

  8. Only 3 vehicles allowed per 2 bedroom cabin, unless stated otherwise.

  9. Only 2 vehicles allowed per studio cabin, unless stated otherwise. 

  10. DO NOT leave trash out overnight.

Safety:

  1. The use of Firearms of any kind is PROHIBITED in the Retreat.

  2. The use of archery, paintball, slingshots or air guns is PROHIBITED.

  3. Fireworks of any kind are PROHIBITED.

  4. Use of illegal drugs is PROHIBITED.

  5. Obnoxious behavior of ANY kind is PROHIBITED

  6. DO NOT climb/walk/play on landscaping rocks

  7. Do NOT sit on the deck railings or allow children to climb on the deck 

  8. The speed limit on Sourwood Lane is 5 mph.

  9. The speed limit on Gap Mountain Lane is 15 mph. 

  10. Vehicles may park in designated spaces only. No vehicles can block any portion of roadway.

  11. Only persons with a valid driver’s license may operate a motor vehicle in the Retreat.

  12. Vandalism of any kind by anyone in your group (regardless of age) may result in eviction from the Retreat.

  13. This is a natural outdoor property that guests must accept. Conditions may include uneven ground, gravel roads, limited lighting, rock ledges. 

  14. Guests are required to review the Emergency Response Plan provided in the cabin guest binder. 

Security:

  1. Management is not responsible for lost, stolen, or damaged articles. Keep your valuables locked up.

  2. Report any problems with your cabin to Management immediately.

  3. We adhere to and maintain all state, county, and local laws on property.

Quiet Hours:

  1. Quiet hours are from 10 PM to 9 AM.

  2. Please be courteous to other guests around you.

  3. Loud music or objectionable noise is not allowed at any time.

  4. Inconsiderate guests will be evicted from the Retreat.

  5. Profanity or violence towards other guests or Retreat staff will result in immediate eviction from the Retreat.

  6. Guests violating rules that result in eviction notice will not receive any refunds for their stay.

Pet Policy:

  1. We reserve the right to refuse service to anyone whose pet is NOT considered suitable to the serenity/safety of our guests or the Retreat.

  2. Pets must be kept on a leash under the control of someone who can always manage all animals.

  3. There is a 2 pet limit per cabin in the Retreat. 

  4. No exotic or oversized pets are permitted. This includes all reptiles or large birds.

  5. Pets may not be left outside unattended.

  6. Guests are responsible to “clean up” after their pets.

  7. Guests should carry proof of their pet's current vaccinations.

  8. Gap Mountain Retreat is not responsible for and will hold accountable pet owners for any injury or damage caused by pet(s).

  9. Service animals may accompany a disabled person without any proof of disability or certification for the service animal.

  10. Dog breeds not allowed on the property are Pit Bulls, Rottweilers, and German Shepherds

Booking Policy:

The full reservation total is required at the time of booking for all stays, regardless of length.

1. Agreement To Follow Directions.

I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Gap Mountain Retreat, or the employees, representatives, or agents of Gap Mountain Retreat.

2. Assumption of the Risks and Release.

I recognize that there are certain inherent risks associated with activities and use at Gap Mountain Retreat and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Gap Mountain Retreat for injury, loss, or damage arising out of my or my family's use of or presence upon the facilities of Gap Mountain Retreat, whether caused by the fault of myself, my family, Gap Mountain Retreat or other third parties. Gap Mountain Retreat shall not be liable for indirect or consequential damages. 

3. Indemnification.

I agree to indemnify and defend Gap Mountain Retreat against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Gap Mountain Retreat

4. Fees.

I agree to pay for all damages to the facilities of Gap Mountain Retreat caused by any negligent, reckless, or willful actions by me or my family or guests in my booking group. Gap Mountain Retreat may charge the credit cards on file for damages caused by me or anyone in my booking group.

5. Applicable Law.

Any legal or equitable claim that may arise from participation in the above shall be resolved under Virginia law.

6. No Duress.

I agree and acknowledge that I am under no pressure or duress to sign this agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this agreement if I so desire. I further agree and acknowledge that Gap Mountain Retreat has offered to refund any fees I have paid to use its facilities if I choose not to sign this agreement.

7. Arm's Length Agreement.

This agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this agreement or any of its provisions, the Parties explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either 'for' or 'against' a particular party based upon their status as the drafter of a specific term, language, or provision.

8. Enforceability.

The invalidity or unenforceability of any provision of this agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this agreement or of any other applications of such provision. Such invalid or unenforceable provision shall be deemed not to be a part of this agreement.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
