IMPORTANT

THIS DOCUMENT CONTAINS A RELEASE OF LIABILITY AT SECTION 24. IT INCLUDES A RELEASE ON BEHALF OF ANY CHILD IN YOUR PARTY, AND SECTION 25 EXTENDS IT TO ANYONE WHO VISITS YOU HERE.

THESE RELEASES AFFECT YOUR LEGAL RIGHTS. YOU ARE GIVING UP THE RIGHT TO SUE US, INCLUDING FOR OUR OWN NEGLIGENCE.

Read Sections 24 and 25 before you accept.

These Rules apply to every guest, occupant, and visitor at Grand West RV Park. They are the terms of your stay. Booking a site, checking in, or entering the property means you have received them, agree to follow them, and agree to the releases in Sections 24 and 25. You are responsible for everyone in your party, your visitors, and your pets following them too. Report any concern to the office at 970-548-8898.

"The Park" means Grand West RV Park, the entity that owns it, the entity that operates it, and each of their owners, members, managers, officers, directors, employees, agents, contractors, property managers, and insurers.

Stays of 30 nights or more are also governed by the Grand West RV Park Extended Stay Agreement, signed at the office. Where that agreement and these Rules differ, the agreement governs.

These Rules apply only to things that happen on or after the date you accept them.

1. The park right now

  • The community building with the showers, restrooms, and laundry is not finished and is not open. Every RV on an RV site must have a working bathroom on board. That is permanent and does not change when the community building opens.

  • Parts of the park are under construction, with open ground, equipment, materials, and areas with no lighting. Barricaded areas are closed. Stay out of them.

  • Any facility may close temporarily or permanently, with no change to your rate.

  • Tent and car camping are not offered yet. They will be available once the restrooms open.

2. Booking, check in, and check out

  • Check in is after 2:00 PM Mountain Time.

  • Check out is 11:00 AM Mountain Time.

  • Early check in, if available, is $30.

  • Late check out, if available, is $30 and extends the stay to 1:00 PM.

  • Minimum stay on Memorial Day, July 4 and Labor Day is 2 nights.

  • Minimum stay for the JUCO World Series, May 28 to June 5 2027, is 3 nights.

  • Third vehicle, if approved: $5 per night.

  • Reservation change, after the first: $50.

Office hours are Monday through Friday, 9:00 AM to 5:00 PM, and Saturday and Sunday, noon to 5:00 PM. After hours, call 970-548-8898.

Total price. The price shown at booking is the total price for your stay, including every mandatory fee. Only government taxes are added, and we itemise them. Every fee above is optional: you pay it only if you choose the service or break a rule.

Card authorization. You authorize us to charge the card on file for your rate and taxes, any fee in these Rules, any cancellation, change or no show charge under Section 2A, and any damage charge under Section 21, subject to the limits in that Section. This stays in effect until you check out and all charges are settled. We email a receipt for every charge on the day we make it, and we give you a cancellation number when you cancel.

Online check in is sent 24 hours before arrival. Finish it before you arrive. It is where we collect every occupant name, your photo ID, your vehicle plates and the dog declaration in Section 7. If it is not done, we cannot complete those steps after hours.

  • Arriving after office hours is fine. Follow the instructions in your online check in.

  • A government issued photo ID is required.

  • Parking permits are issued at check in and must be displayed on every vehicle at all times.

  • Your site rate includes up to six people, which is our maximum. If your household is larger, tell us at booking and we will accommodate you where site capacity allows, including by assigning a second site.

  • Every person staying must be registered. Unregistered occupancy is grounds for removal.

  • The speed limit throughout the park is 5 miles per hour and is strictly enforced.

  • We reserve a site category, not a specific site. We may move you to another site of the same category for operational reasons.

  • A valid credit card must stay on file for the whole stay.

2A. Cancellation

This section applies to stays under 30 nights. Cancellation of a stay of 30 nights or more is governed by the Extended Stay Agreement.

Our Cancellation Policy is also published as a separate document. The two are identical.

All deadlines are 1:00 PM Mountain Time. A $25 cancellation fee applies to every cancellation.

  • Stays of 1 to 3 nights. Cancel 3 or more days before arrival for a full refund less the $25 fee. Inside 3 days, one night is charged. Inside 48 hours, one night is charged.

  • Stays of 4 to 9 nights. Cancel 7 or more days before arrival for a full refund less the $25 fee. Inside 7 days, one night is charged. Inside 48 hours, two nights are charged.

  • Stays of 10 to 29 nights. Cancel 14 or more days before arrival for a full refund less the $25 fee. Inside 14 days, two nights are charged. Inside 48 hours, three nights are charged.

Holiday and named event periods carry a 14 day window and a two night minimum. Two nights are charged inside the window. These dates are shown when you book.

No show. A guest who has not arrived, has not completed online check in, and has not contacted us by 10:00 AM the day after arrival is a no show. One night plus tax is charged, capped at the total value of the reservation. The $25 fee does not apply to a no show. If we re-let the site for that night, we do not charge you for it. The rest of the reservation is canceled. Completing online check in prevents no show status regardless of arrival time.

Early departure. No refund or credit for unused nights after check in.

Changes. One date change is free outside your window. Each additional date change is $50. A change requested inside the window is a cancellation and a new reservation. Nights removed inside the window are charged as a cancellation of those nights.

Refunds are issued to the original payment method within 10 business days and include applicable tax.

Park credit. Where circumstances warrant we may issue a credit of up to seven nights. It expires 6 months after issue, has no monetary value, and cannot be redeemed for cash or refunded to a card. Cash refunds outside this policy require owner approval.

Group and promotional rates may carry separate terms, stated at booking. The cancellation policy in effect when you book governs your reservation.

Weather, access, and emergencies

  • We do not refund for weather, road or pass closures, air quality, or travel conditions. You are responsible for monitoring weather and road conditions and for securing your RV and belongings.

  • If the park closes or is evacuated by order of Grand West RV Park, Mesa County, or the State of Colorado, unused nights are refunded in full.

  • If a road or pass closure stops you from reaching us, call the office before 1:00 PM on your arrival date and we will move your dates at no charge.

  • Illness: credits, not refunds.

3. Guests and visitors

  • Guests are the people listed on your reservation. A visitor is anyone on the property who is not a registered guest, whether or not they stay overnight. Section 25 applies to every visitor.

  • You are responsible for the conduct of your guests and your visitors.

  • Visitor hours are 9:00 AM to 9:00 PM.

  • Every adult visitor registers at the office before entering. Call ahead and we will pre register them. By entering the property a visitor agrees to Section 25, whether or not they register.

  • This is an open property with no gate. That does not make it public. Anyone here who is not a registered guest or a registered visitor is here without permission.

  • Visitors park in the designated overflow area only, and may be restricted during holidays and peak periods.

  • Visitors may not bring pets. A service animal accompanying a person with a disability is not a pet and is always welcome.

4. Site rules

  • Obey all posted signs. Do not walk or drive through occupied sites.

  • Keep your site clean and uncluttered. No storage of tires, parts, equipment, appliances, or furniture outside the RV.

  • Sewer connections must have an airtight seal using a donut or threaded fitting, and a supported hose. No hose lying on the ground.

  • Dumping gray or black water on the ground is prohibited. You are responsible for the cost of cleanup, including biohazard cleanup, caused by your connection.

  • Household bagged trash goes in the designated dumpsters only. No appliances, mattresses, batteries, motor oil, hazardous materials, or bulk items. Break down boxes.

  • No glass containers outside your site or in common areas.

  • Pedestal power is for your RV only. Charging a car or truck anywhere in the park is strictly forbidden. A registered electric golf cart may be charged at your own site under the Golf Cart Agreement.

  • Subletting or re-renting a site or an RV is prohibited.

  • No washing RVs or vehicles on site.

  • No RV repairs, oil changes, or mechanical work on site by you. An approved local mobile RV service may work on your rig and must check in at the office first.

  • No formaldehyde or bronopol in your holding tanks. Use an enzyme or bacteria based product. You are responsible for any damage or cleanup your tank chemicals cause.

  • Satellites and solar panels are permitted if attached to the RV. Nothing on the ground.

  • Under the RV you may keep two plastic storage totes, no larger than 27 gallons each. Nothing else stored under, behind, or beside the RV.

  • One patio table and up to six chairs per site.

  • Do not dig anywhere on the property. Ask the office and we will have utility lines located.

  • No private business may be operated from a site, and the park's name or address may not be used for advertising or sales. No door to door soliciting.

5. Outdoor living space

Allowed

  • Outdoor patio and lawn furniture

  • Drying racks, for swimwear and towels only

  • Bicycles. Helmets recommended. Lights required after sunset

  • LP gas or electric grills, fire pits and heaters. See Section 6

  • Outdoor griddles and grills such as a Blackstone

Not allowed

  • Tents, tarps, screen rooms, or FEMA trailers, unless approved by the office

  • Pools or hot tubs

  • Indoor furniture used outdoors, outdoor refrigerators or freezers

  • Clotheslines, perimeter fencing, decks, porches, sheds, or permanent structures of any kind

  • Excessive decor. Attaching anything to trees or landscaping

With limits

  • Flags. One United States flag and one state flag, no larger than 36 by 60 inches. No permanent flagpoles. No other flags, signs, or banners.

  • Exterior lighting. Aimed at your own site only, and off during quiet hours. Decorations are subject to our approval.

  • Awnings, canopies, and umbrellas must be closed when the RV is unattended, when you are away from the park, and whenever wind is forecast above 25 miles per hour.

  • A ramp, handrail, or other modification for a disability requires office approval, which will not be unreasonably withheld. Request it in writing. Work is at your cost and the site is restored on departure.

6. Fire and LP gas

  • Allowed: LP gas or electric grills, LP gas or electric fire pits with a screen, LP gas heaters.

  • Prohibited: all open ground fires, wood fires, charcoal, and fireworks.

  • Keep any flame at least 10 feet from any RV, awning, vehicle, or propane cylinder, and away from your neighbor's site.

  • Never leave a flame unattended. Extinguish everything by quiet hours.

  • Keep a means of extinguishing at your site whenever a flame is lit.

  • Propane cylinders are stored upright, secured, outside, never under an awning or inside a storage compartment with an ignition source. No more than two spare cylinders per site.

  • Fire restrictions issued by Mesa County or the State of Colorado supersede these rules. During a restriction, all flames may be banned with no notice and no refund.

7. Pets and assistance animals

Service animals and assistance animals are not pets. They do not count toward the animal limit and are not subject to any breed, size, or weight limit. We do not charge for any animal at this park. Any guest may ask the office for a reasonable accommodation. A handler stays responsible for the animal's control and for any damage it causes, and an animal that is out of control or poses a direct threat may be asked to leave.

We are a pet friendly park. We do not restrict by breed, size, or weight. We restrict by behavior.

Declare this at check in. You must tell us if any dog in your party has ever bitten a person or another animal, has ever been the subject of a conviction or court order under C.R.S. 18-9-204.5, or has ever been declared dangerous, potentially dangerous, or vicious under any local ordinance or the law of any state. A dog in any of those categories is not accepted. Failing to tell us is grounds for immediate removal with no refund.

  • Three pets per site, listed on your reservation.

  • Pets must be leashed at all times outside the RV, on a leash no longer than six feet. There is no dog park and no off leash area.

  • Clean up after your pet immediately, every time.

  • Pets are never left outside unattended, and are never tied or staked at a site.

  • A small temporary enclosure is allowed, no larger than 4 by 8 by 4 feet high, only while you are with your pet. It comes down when you leave the site.

  • Have proof of your pet's vaccinations available, and comply with state, city and county licensing and leash laws.

  • Do not feed or water stray or wild animals. Breeding animals is prohibited.

  • Any animal that behaves dangerously or aggressively must leave the property. Management makes that determination in its sole and unfettered discretion. Aggressive behavior includes lunging, snapping, growling, biting, or sustained threatening barking.

  • One documented incident of aggression ends the stay for that animal, with no warning and no refund.

  • We keep a written log of every animal complaint and every action we take on it.

  • Only pets belonging to registered guests may enter the property.

  • You are responsible for any injury or damage your pet causes. Please carry liability insurance that covers your pet.

There is no pet fee at this park. The charges below are not fines. They are our reasonable estimate of the staff time, cleanup and disturbance response each event causes, agreed in advance because that cost is hard to measure event by event. We charge them only after we log the incident and tell you, never more than once per event, and never for a service or approved assistance animal.

  • Pet off leash: $50

  • Pet waste not picked up: $50

  • Excessive noise, including barking: $75

8. RV requirements

  • All RVs must be registered, maintained, and in good running condition.

  • Rig age. RVs under 15 years old are accepted. RVs 15 years and older are accepted on three photographs sent to the office and approval against the condition standard below, which is our entire criteria. There are no unpublished criteria. We decide within 2 business days.

  • Condition standard, every RV regardless of age: functioning holding tanks, no visible structural damage, roadworthy, current registration. Photos may be requested at booking. RVs with broken windows, significant rust or damage, or excessive dirt will not be allowed.

  • Allowed: Class A, B, and C motorhomes, fifth wheels, hard sided travel trailers, and toy haulers. Every RV on an RV site must have a bathroom in the unit.

  • Not permitted on an RV site: any unit without a bathroom, including car trailers, cargo trailers, and cab over truck campers.

  • All RVs must be properly leveled and supported.

9. Vehicles and parking

  • Two vehicles per site, including a tow vehicle or towed vehicle, provided they fit within the site. Additional vehicles park in the designated overflow area.

  • No parking on grass, on empty sites, or on the roadway. Illegally parked vehicles may be towed at the owner's expense.

  • No vehicle may infringe on a neighboring site.

  • Golf carts. Electric only. No gas powered carts, ATVs, UTVs, or off road vehicles anywhere in the park. Before you operate a cart here you must sign the Golf Cart Registration, Release, and Operating Agreement and give us a certificate of insurance naming Grand West RV Park as an additional insured. Licensed drivers 21 and older only, seated passengers in factory seats only, 5 mph, lights after dark, none during quiet hours, no towing, never off the property. Privileges are revoked on the first violation, with no warning and no refund. Full terms are in that agreement. You are fully responsible for your cart, its operators, and anyone it injures.

  • Boats and trailers require written approval and are subject to storage fees. RV, boat, and vehicle storage is a separate product under a separate storage agreement.

10. Utilities

  • Sites are full hookup. You supply your own hoses, sewer connections, and electrical cords, in good condition. Do not modify park utilities.

  • We recommend an RV surge protector or electrical management system rated for your service. We are not responsible for damage to your RV or its contents.

  • If your RV, cord, or equipment damages our pedestal, wiring, or service, you pay the repair cost including the electrician.

  • We test our pedestals before opening and on a regular schedule and we keep the records. If our pedestal or wiring damages your RV and we failed to use reasonable care, we are responsible up to the cost of repair. We are not responsible for damage caused by utility company power events or weather, or for indirect or consequential loss, lost business, spoiled food, or lost data.

  • Report any electrical problem to the office immediately. Do not open, diagnose, or work on a pedestal, even if you are an electrician.

  • If site water is shut off for more than 24 consecutive hours, you may depart and receive a full refund of unused nights.

  • We may shut off utilities for repairs, safety, or freeze protection only, with as much notice as circumstances allow. We will never shut off a utility to make a guest leave. We are not responsible for loss during planned or emergency shutdowns.

  • We may enter your site for utility work, repairs, inspection, or an emergency. Except in an emergency we give you notice first.

11. Roadway and site safety

  • Our roadway is shared with large RVs backing into sites whose drivers cannot see behind them, and parts of the park are under construction and unlit. There is no playground, no fenced area and no designated play area.

  • No one under 12 may be on a park roadway, in a construction area, or near a utility pedestal unless accompanied by someone 16 or older.

  • Not allowed on park roads, at any age: minibikes, go karts, skateboards, hoverboards, roller skates, or remote control vehicles.

  • Bicycles must be ridden cautiously. Lights are required from sunset to sunrise.

12. Code of conduct

  • Keep music and noise at respectful levels.

  • Quiet hours are 10:00 PM to 8:00 AM. No loud talking, radios, or televisions during quiet hours.

  • Alcohol is permitted at your own site only. No open containers elsewhere in the park. Do not serve alcohol to anyone under 21 and do not allow anyone under 21 to consume alcohol at your site.

  • No smoking or vaping in any building or common area. Smoking is permitted at your own site only, in a container, fully extinguished.

  • Cannabis may not be used in any building, in any common area, or anywhere it is visible from the roadway or another site. Growing, cultivating, or processing cannabis anywhere on the property, including inside an RV, is prohibited.

  • Generators are not permitted except in an emergency, at management discretion.

  • Disturbances or threatening behavior will result in removal from the park.

  • Harassment or mistreatment of guests or staff, including racist comments or hate speech, will not be tolerated.

  • Report any injury, accident, or incident to the office the same day it happens, even if no one appears hurt.

13. Mail and packages

  • We do not offer mail service. USPS mail is refused and returned to sender.

  • We accept non perishable packages from UPS, FedEx and Amazon, addressed as: your name, c/o Grand West RV Park, 123 30 Rd, Grand Junction, CO 81503, with your site number.

  • Packages over 3 feet in any direction, heavier than 30 pounds, or perishable, will be refused.

  • We do not notify you when a package arrives. Anything unclaimed after 30 days is returned to sender.

14. Winter

  • The park is open year round and Grand Junction winters are hard.

  • Snow removal covers the roads and the entry, not individual sites. We clear the entry, then the loop, then the office apron, once accumulation reaches 2 inches, and we treat ice at the entry and office. Conditions between clearings will be icy. Please walk and drive accordingly.

  • A heated water hose and heat tape on your water connection are required from November 1 through March 31.

  • Keep your sewer hose sloped and supported. A flat hose freezes.

  • Space heaters are permitted inside the RV only, never outside, never under an awning, never on an extension cord.

  • Move your vehicle when we are clearing snow. We will tell you the day before where we can.

  • Water to individual sites may be reduced or shut off during a hard freeze.

15. Emergencies

In an emergency, call 911. Give the address as 123 30 Rd, Grand Junction, CO 81503, and your site number.

If you smell gas, leave the area and call 911.

There is no building on this property to shelter in. In severe weather, shelter in a hard sided vehicle or leave the park.

16. Internet

The park does not provide Wi-Fi. Plan on your own cellular data.

17. Cameras

We operate cameras at the entry, the office and the dumpster. Recordings are kept for 30 to 90 days and then overwritten. Cameras are for our own operational purposes. They are not a promise of security and you may not rely on them.

18. Laundry and restrooms

These facilities are not yet open. When they open, these rules apply.

  • Registered guests only, and any person assisting a guest with a disability.

  • No smoking or vaping in any indoor facility.

  • Personal belongings left behind may be discarded.

19. Health and safety

  • All posted laws and safety signs must be followed.

  • No hazardous materials may be stored or dumped on the property.

  • Barricaded and marked construction areas are closed. Do not enter them.

Firearms. Sworn law enforcement officers are exempt. Everyone else:

  • may carry a firearm in a personal vehicle, and store one in a locked vehicle, if it is not visible from outside;

  • may keep a firearm secured inside the RV, with the RV locked;

  • may carry a firearm between the vehicle and the RV in a case, holster, or other device that does not display it;

  • may not wear or openly display a firearm anywhere in the park, bring one into the office, threaten anyone with one whether displayed or not, or unlawfully discharge one anywhere on the property.

Nothing in this rule limits any lawful act of self defense.

20. Wildlife and outdoor conditions

  • The land around us is home to wild animals including deer, coyotes, snakes, rodents, and birds of prey. These animals are not fenced in or fenced out and we cannot control them.

  • Do not feed, approach, or handle wildlife. Do not leave food, trash, or pet food outside. Shake out shoes and check under your RV before you reach.

  • Weather here changes fast. Expect wind, dust, sudden temperature swings, hail, extreme summer heat, and hard freezes. You are responsible for securing your RV, your awning, and your belongings.

21. Damage

You are responsible for damage to the Park's property caused by you, anyone in your party, your visitors, your contractors, your vehicles, or your pets. This includes broken water lines, damaged or missing sewer connections, sewage or gray water spills, cut utility lines, damaged pedestals or meters, landscaping and tree damage, damage from fire or LP gas, and the cost of removing excessive debris or abandoned property.

Before we charge your card, we will email you an itemized statement describing the damage and the amount, include photographs and any third party invoice or written estimate, and give you 10 days to respond in writing. If you dispute the charge, we will review your response and reply in writing before charging you.

We will not charge more than $500 to the card on file without your written approval. Above that amount we will bill you. We do not send notice for amounts under $100.

22. Right to refuse service and removal

Grand West RV Park is privately owned and reserves the right to refuse service to anyone for any reason not prohibited by law, and to require any person to leave for violating these Rules or for behavior management considers inappropriate or disturbing to others. Removal does not entitle you to a refund.

Removal of a guest on a stay of 30 nights or more is governed by the Extended Stay Agreement and Colorado law.

Barring a person from the property. We may bar anyone who is not a registered guest, including someone previously removed, someone who has materially violated these Rules, or someone we consider objectionable. A bar is communicated to the person directly. Returning after that is criminal trespass.

23. General

  • We may revise these Rules prospectively. The version in effect on your booking date governs your stay, except for changes required by law or by a government fire or emergency order, which take effect immediately. We keep an archive of every version.

  • These Rules are governed by the laws of the State of Colorado. Venue is Mesa County, Colorado.

  • If any provision is found unenforceable, the remaining provisions stay in effect.

  • Sections 24 and 25 are a release of liability and are not narrowed by anything else in this document.

  • Order of precedence. Where these documents conflict, this is the order, highest first: (1) Sections 24 and 25 of these Rules; (2) the Extended Stay Agreement or the Golf Cart Agreement, where one applies; (3) the rest of these Rules.

24. RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISK

READ THIS SECTION. IT AFFECTS YOUR LEGAL RIGHTS.

24.1 Conditions here

An RV park is an outdoor working environment, not a hotel. I understand and accept that being here carries real risk of injury, illness and damage to my property, including:

  • Construction. Active work, open ground, equipment, trenching, uneven surfaces, and areas with no lighting.

  • Roadways. Shared by vehicles and people. Large RVs back into 52 of the 55 sites and their drivers cannot see behind or beside them. Surfaces may be gravel, uneven, dusty, wet, muddy, snow covered, icy, or unlit.

  • Utilities. Live 30 and 50 amp pedestals, water and sewer connections, sewage, gray water, power surges, outages, and voltage faults that can damage my RV and its contents.

  • Fire and LP gas, mine and my neighbors'.

  • Animals. Wildlife the Park does not control, and other guests' dogs, which are not restricted by breed, size, or weight.

  • Weather. Snow, ice, hard freeze, wind, hail, dust, extreme heat, flooding, lightning, and wildfire smoke.

  • Other people, and their acts, omissions, vehicles, equipment and animals.

I accept these risks whether they are obvious to me or not, whether I know about them or not, and whether or not they result from the Park's own negligence.

24.2 My release

IN EXCHANGE FOR BEING ALLOWED TO ENTER AND USE GRAND WEST RV PARK, I RELEASE, WAIVE, AND DISCHARGE THE PARK FROM ALL CLAIMS, DEMANDS, LAWSUITS, DAMAGES, COSTS, AND EXPENSES OF EVERY KIND FOR PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR ECONOMIC LOSS THAT I SUFFER ON THE PARK'S PROPERTY.

THIS RELEASE COVERS CLAIMS CAUSED BY THE PARK'S OWN NEGLIGENCE.

IT INCLUDES ANY CLAIM UNDER THE COLORADO PREMISES LIABILITY ACT, C.R.S. SECTION 13-21-115, AND ANY CLAIM BASED ON THE CONDITION OF THE PROPERTY OR ON ACTIVITIES OR CIRCUMSTANCES ON THE PROPERTY.

IT APPLIES EVERYWHERE ON THE PROPERTY, including the entry and exit, all roadways, all sites, the office and every building, all common areas, all utility pedestals and connections, all construction areas, all parking and overflow areas, the storage areas, and the Park's driveway and approach.

I AGREE NOT TO SUE THE PARK FOR ANY CLAIM I HAVE RELEASED.

This release binds me, my heirs, my next of kin, my personal representative, my estate, and anyone claiming through me. If I die, my heirs and wrongful death beneficiaries are bound to the fullest extent Colorado law permits.

24.3 What this release does NOT cover

I am NOT releasing the Park from gross negligence, willful and wanton conduct, reckless conduct, any duty Colorado law does not allow it to contract out of, or anything else Colorado law does not permit to be released.

If a court decides any part of this section goes further than Colorado law allows, that part is narrowed to the maximum extent Colorado law permits and the rest stays in full force.

24.4 My property, and my responsibility for others

The Park is not a bailee of my RV, vehicle, boat, or belongings and does not take custody or control of them. The Park does not insure my property. I am responsible for insuring my own.

I will defend, indemnify, and hold the Park harmless from any claim brought by another person arising out of my acts or omissions, or those of anyone in my party, my visitors, my contractors, my vehicles, or my pets. This includes any claim arising from a bite, attack, knockdown, or injury caused by my pet. It includes reasonable attorney fees and costs. This does not require me to indemnify the Park for its own gross negligence, willful and wanton conduct, or reckless conduct.

24.5 Children in my party

If anyone under 18 is with me, I am that child's parent, legal guardian, person with legal custody, or physical custodian, and I have authority to agree to this for them. I cannot agree for a child who is not mine. That child's own parent must agree separately.

I understand the specific risks to a child here: there is no playground, no dog park, no fenced area and no designated play area, so children share the roadway with RVs backing into sites; the park is under construction and parts are unlit at night; every site has live electricity and a sewer connection; other guests' dogs are not restricted by breed or size; and fire and propane are permitted at every site. Supervising my child is my job at all times.

AS PERMITTED BY C.R.S. SECTION 13-22-107, I RELEASE AND WAIVE, ON BEHALF OF EACH CHILD UNDER 18 IN MY PARTY, THAT CHILD'S PROSPECTIVE CLAIM FOR NEGLIGENCE AGAINST THE PARK, INCLUDING ANY CLAIM UNDER THE COLORADO PREMISES LIABILITY ACT. COLORADO LAW DOES NOT ALLOW ME TO WAIVE, AND I AM NOT WAIVING, MY CHILD'S CLAIM FOR A WILLFUL AND WANTON, RECKLESS, OR GROSSLY NEGLIGENT ACT OR OMISSION.

I also agree not to bring my own claim arising from an injury to my child that I released above. If a court finds that last sentence unenforceable, it does not affect the release of my child's claim.

25. VISITORS

A visitor is anyone entering the park who is not staying overnight on a reserved site. Visiting hours are 9:00 AM to 9:00 PM. Every adult visitor registers at the office before entering.

By entering Grand West RV Park, a visitor accepts the conditions in Section 24.1 and agrees to Sections 24.2, 24.3, 24.4 and 24.5 as if they were written about the visitor, whether or not the visitor registers at the office.

Visitors park in the designated visitor and overflow area, observe the 5 mph limit, do not walk or drive through occupied sites, leave by 9:00 PM, bring no pets, and follow posted signs and staff directions.

The registered guest is responsible for the conduct of the visitors they invite.

26. Photographs and video

By staying at or visiting Grand West RV Park, you agree that the Park and its marketing partners may use photographs or video taken on the property that include you, and the children in your party, in any medium including social media, the Park website, and advertising, without payment or further notice.

If you do not want your image used, tell the office and we will not use it.

27. How you accept this

Accepting these Rules at booking or at online check in is your agreement to all of them, including the releases in Sections 24 and 25. You agree to transact electronically and that your electronic acceptance has the same effect as a handwritten signature.

You are accepting for everyone staying with you. By accepting, you confirm that you are at least 18, that you have authority to accept these Rules and the releases in Sections 24 and 25 on behalf of every adult and every child in your party, that you have told them what this document says, and that they have agreed to it. Every person staying must be named on the reservation.

You confirm that no one rushed you, that you had the chance to ask questions or take this to a lawyer, and that you understand you may not enter or stay at the Park if you do not agree.

Colorado law governs. Venue is Mesa County, Colorado.
