                                                                                Wind River RV Park Terms of Service

 

These Policies, Terms & Conditions (“Terms and Conditions”, and/or “Agreement”), together with any related camping equipment, any waivers, activities or animal(s) govern all aspects of the Park and Your stay. (Collectively, “Wind River RV Park”, “Park”, “Premises” “We,” “Us” “Our”), (Collectively “You,” “Your “Yourself,” and/or “Guests”).  These Terms and Conditions and the Agreement of which they are a part constitute a binding legal agreement between You, the holder of the reservation, on behalf of Yourself and Party or Visitors, (“Party, Visitors and Their” as defined in Section 3,) and the Wind River RV Park.

In consideration of the accommodations for Your reservation and Your visit, staying at and using the property, facilities, and amenities owned by the Park as well as participating in or accepting the events or services provided, You agree on behalf of Yourself and each of your Visitors as follows:

  1. Compliance with Rules and Regulations. You shall and shall cause all your Visitors to abide by these Terms and Conditions and the Agreement of which they are a part and all rules and regulations. The policies, Terms and Conditions of the Park, including, without limitation, those published at https://windriverrvparkandstorage.com, posted at the Premises, or otherwise communicated in any manner by Park personnel. Failure to adhere to any Park Rules may result in Your and your Visitors ejection from the Park without a refund.
  2. Cancellation Policy; Refunds. You MUST be 18 years old to make a reservation. By making a reservation You are guaranteeing the Park that You are at least 18 years of age or older. You explicitly understand and agree that we DO NOT give credit, or refunds due to the discomforts of nature, inclement weather, natural disasters, animals/insects etc.

Our refund policy and the timing of the cancellation notice in relation to the reservation date is as follows: All cancellations MUST be made at least 14 days prior to the initial date of the reservation. No refunds will be issued if the cancellation is made less than 14 days before the original reservation date. Additionally, no refunds will be issued if for failure to check-in on the reservation date and the remainder of Your reservation is subject to cancellation without communication to the Park and/or its Staff. Extenuating circumstances may be exceptions and are at the discretion of Park Administration.

3. Personal Responsibility for Your and your Visitors’ actions. (Visitors include all persons and/or animals not included in the reservation). As participants in a recreational activity, You accept responsibility for You and each of your Visitors acting within the limits of Your and Their respective abilities and heeding all warnings regarding participation within the activity.  You agree to, for Yourself and your Visitors to, (a) maintain control of Yourself and Themselves, (b) maintain control of any vehicles or other equipment operated on the Premises, and (c) refrain from acting in any manner that may cause or contribute to an injury to Yourself, your Visitors, or to others. Should anything happen, you will be held liable for any damages to the site and any necessary costs of repair.

4. Campsites. We adhere to and maintain all state, county, and local laws on Premises.

(a) You must adhere to Our specified and identical check-in and check-out time of 11:00 AM to ensure a smooth transition for new arrivals and allow Staff to inspect and prepare sites as needed.

(b) Tent camping is an option at Our Park as well. Please speak with the office if interested.

(c) You are allowed to have Visitors at Your sites. The maximum number of Visitors allowed per site in total will be no more than 4 at a time. If You will have more visitors, please check with the office, as additional fees apply. Visitors are welcome at Your site between the hours of 8:00 AM to 10:00 PM.  If You are hosting a family get together and require more room, please inquire with the office as We also have a meeting facility. Visitors are not allowed to stay overnight.

(d) Guests violating any rules will be asked to leave and will not receive any refund for Their stay. Each site is granted 4 Guests with the reservation, any additional people will have a $3.50 charge per Guest per day.

(e) Quiet Hours are from 10:00 PM to 8:00 AM and are enforced to maintain a peaceful environment for all guests. Excessive noise or loud activities during these hours may result in penalties and/or eviction from the Premises.

(f) You are responsible for understanding how many amps You are using on Your site. Please ensure that You are using the amount of amps You have told the office You will need, as We do regular inspections. Failure to do so could result in additional fees to You and possible eviction from the Premises.

(g) Please notify the office immediately at the time of check in if You have any electrical issues, or issues with Your site of any kind. This way Maintenance can address them for Your future stays and the stay of Our other guests. Do not attempt to fix any issues with Your site by Yourself even if You have the qualifications.

(h) Maintenance on RV’s or Vehicles on property is not allowed and is strictly prohibited.  We will be happy to provide you with a number for a local Mobile RV Repair service that will come directly to Your site and assist with any repairs that You may need. The Park is not liable for their workmanship, and/or any agreement that You enter into, and We will not assume any risk or liability for this third-party service.  In the event Your RV becomes immobile and requires service in the Park, You assume all risk and liability for all necessary clean up and removal of any parts and potential contamination (i.e. oil spills, oil marks, etc.).

(i) Any charcoal grills, wood fire pits, deep fryers and tiki torches are PROHIBITED. Propane grills and fire pits are allowed within Your campsite but cannot be left unattended at any time and are not to be placed on any picnic tables or flammable surfaces. Your full adherence and cooperation with this is mandatory.

(j) The use of area rugs on Your site is allowed. However, rugs cannot be placed on the grass or interfere with anyone else’s site or camping experience.

(k) All sites are to be kept neat and clean for the duration of Your stay.

(l) Site Changes. If You wish to move, please check with the Office. Due to reservations and maintenance, moving may not be possible. Please inquire before moving sites or an additional fee may occur.

(m) No Assignment. You shall not assign the site granted to You by Your reservation, sublicense any portion of the Premises, or share or rent out Your accommodations on the Premises through such services as AirBnB, VRBO, etc. Any violation of this provision will result in the immediate termination of Your reservation and ejection of You, your Party, and all unpermitted tenants from the Premises immediately and without a refund. We may also pursue any other loss, cost, liability or damage We incur from a violation of this provision against You under these Terms and Conditions as well as any other legal or equitable remedy available to Us.

5. Parking. As a courtesy, Our employees, if requested, may assist with directing You to Your designated campsite with acknowledgement and agreement of the Waiver release in Section 13. Regardless of the involvement of Our employees it is Your sole responsibility to:

(a) ensure safe driving to and from the campsite (5 mph speed limit);

(b) ensure safe parking on the campsite;

(c) confirm that the campsite will accommodate Your specific trailer/RV and your personal vehicle(s), and not hit any branches, bollards, trees, improvements, other persons or Their property, etc. when traveling to or from or positioning Your RV at the campsite;

(d) Please DO NOT park Your vehicle(s) or trailer in an adjacent site. Use of more than one site will result in additional charges. Additionally, DO NOT block Our storage units, gates, bathrooms, and laundry facilities. All motorhomes, RV’s or travel trailers must be in good working order and appearance. We reserve the right to refuse access to any Guests whose vehicle(s) is deemed to be unacceptable.  One RV vehicle and one additional vehicle is allowed per site.  A third vehicle may be added for an additional $30.00 charge.  All vehicle(s) must be contained within Your assigned Site per the guidelines stated in Section 5. c. and 5. d. of the Terms and Conditions. For the purpose of short-term Site rentals, boats, boat trailers, cargo trailers or car dollies shall be included in the definition of a “vehicle.”  For long-term Site rentals, boats, boat trailers, cargo trailers and/or car dollies shall not be allowed to be stored in the RV Park; and may be stored In Our Storage Lot for an additional fee.  Guest may also store and vehicles in Our Storage Lot for an additional fee;

(e) The washing and/or maintenance of RV’s or vehicles on the property is strictly prohibited and subject to Section 4 (h) above; and,

(f) The speed limit in the Park is 5 mph. Exceeding this speed limit will result in a warning. Multiple warnings will require Us to ask You to leave the Premises. Motorcycles must be in idle when traveling through the Park. No vehicles can block any portion of the roadway. Vehicles must park in designated spaces only. Only persons with a valid driver’s license may operate a motor vehicle in the Park.

6. Trash. All trash is to be disposed of in enclosed trash receptacles. These receptacles are placed to the West of the RV Park by the storage gate entrance, at the North and South ends of the Park by the dog walks and on either side of the building with the laundry and restrooms.

(a) Do not leave trash out overnight.

(b) Please tie all trash bags completely closed and put the trash completely in the containers.

(c) Do not leave any trash on the ground.

(d) Do not dispose of any motor oil, cooking oil, wires, furniture, mattresses, chemicals, toxic or hazardous waste on the Premises. Failure to do so will result in additional charges to You.

7.  Amenities.

(a) Laundry. The laundry room is open 24/7. Change and vending are available inside the service building, or the office can exchange rolled quarters for You. Please do not leave Your laundry unattended. The Park is not responsible for accidents, lost or stolen property.

(b) Restroom/showers. We strive to provide exceptional amenities and keep Our RV Rental prices affordable. There is a cost to us for these services, which include electricity, water, gas (hot water), cleaning and maintenance. Our showers are coin-operated and accept only quarters. Our charge for the showers is 50 cents = 5 minutes, 75 cents = 7 ½ minutes, $1.00 = 10 minutes and $1.25 = 12 ½ minutes. A change machine is located in the laundromat, and you can also ask the front desk for change. For the comfort of all Our guests, restrooms and showers are open 24/7. Please help keep the restrooms clean. No candles, lanterns, or other hazardous items are allowed within the restroom and shower areas. DO NOT use any kind of dye, chemicals or toxic substances within the bathroom and shower areas. Failure to comply could result in additional fees and possible eviction from the Premises.

(c) Guests under 18 years of age must always have adult supervision in the laundry, bathroom and shower areas. The Park is not responsible for unsupervised underage guests.

8. Animal Agreement. There is a $25.00 security deposit if You or any of your Visitors bring a dog or other permitted animal to the Premises. This security deposit is refundable if You abide by the following:

(a) Excluded Animals. Park Management has the sole discretion to exclude any animal. The basis for exclusion may include but is not limited to the following: breed-specific exclusions; health issues or the animal is showing signs of being aggressive, vicious, dangerous or potentially dangerous; requires muzzling; barking or other noises excessively made or made during quiet hours.  Exotic animals including but not limited to reptiles and birds of prey are prohibited.

(b) Supervision. In the interest of other guests at the Park; the animal must be on a leash or in a carrier while in all public areas of the Premises. The animal must be accompanied by You or an appropriately aged Guest at all times; and DO NOT leave the animal unattended in the Park or at the Campsite. The Park does not allow pens or portable fences on the grass.

(c) Vaccinations. You represent and warrant that the animal is up to date on all vaccinations.

(d) Assumption of Risk, Release and Indemnity. To assume all responsibility of risks, injury, death, damage, and other harm that may occur while the animal is at the Park or caused by the animal consistent with these Terms and Conditions, release and waive all claims related to Your animal, acknowledging that the animals presence is one of Your Assumed Risks in these Terms and Conditions, and agree to indemnify Us for any claim, damage or liability associated with the animal.

(e) Area Cleanliness. Please use the dog walk areas indicated and clean up after Your pet always. DO NOT let Your animal deposit waste on Your site or any of Our other guest sites without cleaning up after the animal. Failure to do so will result in Your being asked to leave without a refund.

(f) Allowable Animals. There is a 3-animal limit per site. Dogs and cats are permitted.  No exotic or oversized animals are permitted. This includes all reptiles and birds of prey. The Park is not responsible for and will hold accountable the animal owner for any injury or damage caused by the animal(s).

(g) Registration. ALL Animals must be registered upon arrival whether through Our online reservation marketplace or in-person in Our leasing office.

9. Rules and Regulations. Management is not responsible for lost, stolen or damaged items. Keep ALL valuables locked up. Children under 18 years of age MUST be supervised by an adult at all times. Riding bicycles without a parent and in Our main entrance area is prohibited for the safety of Your children and Our other Guests.

(a) The use of any paint products or chemicals is prohibited on the Premises.

(b) Guests must use appropriate sewer hoses with secure connections to prevent leaks or contamination.

(c) Washing RV’s and vehicles on property is only permitted with one bucket of water and a sponge. Hose washing is not permitted in order to limit water usage, and it can be messy and disturb other Park guests.

(d) Clotheslines are not allowed.

(e0 Guests may not hang any items from the trees.

(f) Drones or other remote-controlled machines may not be used at any time on the Premises without specific permission from the Staff or Management as they can be disruptive, raise privacy concerns, and pose risks to the Park and other guests.

(g) The use of firearms of any kind is prohibited.

(h) The use of archery, paintball, slingshots or air guns are prohibited.

(i) Fireworks of any kind are prohibited.

(j) Smoking inside the common areas is prohibited.

(k) The use of illegal drugs are prohibited.

(l) Vandalism of any kind, by anyone in Your group (regardless of age) may result in eviction from the Premises.

10. Severe Weather. In case of severe weather, seek shelter in the bathroom/laundry room building or office the areas. We love animals, so please bring them with You and do not leave them in Your RV or on Your site during severe weather conditions.

11.  Photographic Release. On behalf of Yourself and each of your Visitors, You consent and authorize Us (The Park) to photograph, video tape or otherwise record You and your Visitors and do grant Us and Our affiliated entities and promotional partners the right to use the photographs and/or motion pictures and video taken including Your and your Visitors names, likenesses and voice, as well as any testimonial statements made by You and your Visitors without any compensation.

12. Our Right to Refuse Service. The Premises are privately owned, and Park Management and staff reserve The Right To Refuse Service to anyone for any reason except for those prohibited by law. You and your Visitors are allowed on the Premises which may be revoked by the Park at any time, and You DO NOT have any rights as a tenant. Park Management Reserves the right to require any person or Party it deems necessary to leave the Premises based on violations of Park Rules and Regulations, or Terms and Conditions or behavior Park Management believes is unlawful, deems dangerous, threatening, offensive, harassing, inappropriate, disturbing, disruptive or inconsiderate to others. Harassment or mistreatment of Our Staff or other Park guests, including but not limited to racist comments or hate speech, will not be tolerated under any circumstances.

13.  Waiver and Release. Any assistance provided by the Park in parking vehicles, hooking up facilities, or general damage to Your property, is agreed upon by the Park and You and your Visitors that the Park is not liable for ANY injuries or damages. By signing this You are agreeing that the Park is free from any claims. The Park considers these acts to be “Assumed Risks” on Your behalf.

You, on behalf of Yourself and each of your Visitors, HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the Park and the Parks affiliates, owners, members, managers, officers, employees, contractors, agents, and representatives (collectively, “Park Management”), from and for any and all claims, damages, liabilities, injuries, demands, or causes of action, both present and future, whether known or unknown, anticipated or unanticipated, foreseeable or unforeseeable, to Your and your Visitors, and also for any loss, cost, liability or damage on account of injury to Your or Their person, or any third-party, including death, or loss or damage to Your, Their or any third-parties property, relating to or arising out of, incident to, or related to the use, occupancy and operation of (a) the Premises, trees, vegetation, landscaping, holes, or other topography and other natural or manmade features, (b) the Parks buildings, facilities, improvements, amenities, bathrooms, showers, septic or wastewater treatment system(s), wash areas, grills, firepits, sidewalks, roads, curbs, parking areas, gates, grates, and all other equipment and improvements, (c) any and all activities and events at the Premises, whether or not the Park is sponsoring, including, without limitation; parking and all actions and omissions of other Park guests and Park Management, (d) any dangers and hazards associated with acts of nature such as changing weather conditions, high winds, tornadoes, thunder and lighting, hail, flooding, temperature fluctuations, falling trees or tree limbs, ice, or encounters with insects, reptiles, or animals, including but not limited to cats, dogs, horses, snakes, and bears (e) any dangers and hazards associated with construction, repairs or work taking place at the Premises, including holes, trenches, equipment, tools, exposed work (including electrical or plumbing fixtures), debris and trash, (f) Force Majeure Event(s) (“Force Majeure Event(s)” Defined as:

(a)  acts of God,

(b)  flood, fire, earthquake, tornado, rainstorm, snowstorm, hurricane, pandemic, any other natural disaster, or explosion,

(c) war, invasion, hostility, terrorists’ threats or acts, riot or other civil unrest,

(d) government order, law, or action,

(e) national or regional emergency,

(f) strikes, labor stoppages, slowdowns, or other industrial disturbances,

(g) telecommunication breakdowns, power outages or shortages, inadequate transportation services, or inability or delay in obtaining supplies of adequate or suitable goods or supplies,

(h) and other similar events beyond Our control,

(i) and anything introduced to the Premises by You, your Visitors, other guests, or third parties, including animal(s), vehicle(s) equipment, hammocks, furniture, games and activities (individually or collectively: “Assumed Risks”), and weather arising from any act or omission, whether negligent or otherwise, of You, your Visitors, your animal(s), Park Management, and/or any other guests, third party or Their animal(s). You acknowledge that Your agreement to these Terms and Conditions and the above release is entirely voluntary and intended to be binding to You, each of your Visitors, and each of Your and Their respective personal representatives, executors, legal representatives, heirs, and assignees.

14. In case of a medical emergency, call 911.  Provide the “Wind River RV Park” name, the Park’s address of “1618 E. Park Avenue, Riverton Wyoming 82501” and Your Site Number.  Should You call 911 for any reason during normal business hours (8 AM to 5 PM) and if time permits, please inform the Office at (307) 857-3000 so the Park Staff can be prepared to escort emergency personnel to Your RV Site.

If there is an after-hour “park emergency”, please call (909) 526-6997.   In the event you reach a recording, please leave a message with your name, telephone number and RV site number so that we can respond as soon as possible.

If You observe any activity You believe to be of concern, please call the Office at (307) 857-3000 (No Soliciting calls allowed).  

Wind River RV Park is not responsible for damage, injury, or loss to either person(s) or property. Wind River RV Park, its Owners, and its Management absolves itself from any and all liability and responsibility pertaining to loss by fire, theft, weather, acts of God, property damage, accident, or any other cause.

15. By accepting the reservation, You represent and warrant to Us that You have read these terms and Conditions, including the Waiver of Liability, Assumption of Risks, and fully understand Their terms and understand that You are giving up substantial rights, including the right to sue Us and the Park Staff and the Park Management. You also understand that, in addition to Yourself, these Terms and Conditions apply to each of your Visitors, Your and Their heirs, personal representatives and permitted assignees. You acknowledge that You are agreeing to these terms and Conditions freely and voluntarily, and by that action intend for these Terms and Conditions to be a complete and unconditional release of all liability of the Park and Park Management to the greatest extent allowed by law. You further agree and acknowledge that You are free to have Your legal counsel review this agreement if so desired.

16. Arm’s Length Agreement. This agreement and each of its terms are the product of an arm’s length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this agreement or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either “for” or “against” a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.

17. Enforceability. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity of enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be. Such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.

18. Our Right to Charge Your Credit or Debit Card. You are and remain personally liable to pay the total amount of You reservation charges prior to check-in on the date of Your arrival. If You fail to pay the total due, You agree that the Park may charge any remaining balance (including any damages, indemnity charges or other amounts owed under these Terms and Conditions or the Agreement of which they are part) to any credit or debit card on file with Your reservation. Any amount remaining due after 30 days will be subject to the maximum late charge permitted under the law by the State of Wyoming. For reservations paid with a credit or debit card, refunds will be credited only to the card on file with respect to the reservation.

19. All cancellations must be made at least 14 days prior to the initial date of the reservation. No refunds will be issued if the cancellation is made less than 14 days before the original reservation date.

20. By signing below, You acknowledge that You have read this Agreement and all Terms and Conditions within and agree to it as well as to all other Park Rules and Regulations. In addition, You understand and agree that You are responsible for Your actions and the actions of all of your Visitors, including any invitees that visit the Park during Your stay.
