RULES AND REGULATIONS
OF
WOODALL’S VILLAGE
EFFECTIVE: October 20, 2022
STATEMENT OF PARK POLICY
Woodall’s Village shall attempt to provide a near carefree style of living for older persons. All reasonable means have been taken to ensure that your stay here is safe, pleasant, and enjoyable. Consideration and courtesy to others plus your cooperation in maintaining an attractive home will help sustain the high standards of Woodall’s Village.
Because this property is privately owned, we are required by law to abide by certain standards. Many of our Rules and Regulations are based on what is required of us by law. The remainder are published to additionally protect life, property, and your privacy.
The following Rules and Regulations are intended for the comfort, welfare and safety of yourself and your visitors and to maintain the appearance and reputation of our community. They may be amended from time to time to achieve this purpose. Your cooperation will be greatly appreciated.
REQUIREMENTS OF ENTRY
1. Community is intended to operate as housing for persons fifty-five (55) years of age or older. In order to be approved for tenancy by Community Management, at least one (1) prospective occupant of each unit must be fifty-five (55) years of age or older, provided, however, all other occupants of the mobile home must be at least forty-five (45) years of age. Notwithstanding the foregoing, Community Management reserves the right to permit a person younger than forty-five (45) years of age to reside in a mobile home in order to reasonably accommodate the disability of a resident over fifty-five (55) years of age or to otherwise comply with provisions of the Americans with Disabilities Act, the Fair Housing
Amendments Act of 1988 or Florida Fair Housing Act. Any such person younger than forty-five (45) years of age shall apply for residency as any other prospective resident and shall provide, with their application, documentation from the handicapped resident’s physician stating whether such resident is able to care for themselves and their home if living alone. A person under the age of forty-five (45) living with and assisting another individual with a disability fifty-five (55) years of age or older shall not continue to reside in the mobile home for more than thirty (30) days after the termination of residency of such disabled resident and any such continuation of residency beyond said thirty (30) day period shall be deemed a violation of this rule.
2. Only a person or person with legal title to a mobile home located within the community may rent a lot within the community. In addition, all mobile homes shall have displayed the mobile home decal for the current year that is issued by the State of Florida. It shall be deemed a violation of these Rules and Regulations for a mobile home located in the community not to have a mobile home decal for the current year appropriately displayed.
3. Previously approved non-owner occupants of a mobile home must vacate the mobile home within thirty (30) days if the mobile homeowner no longer resides in the mobile home, dies, takes up occupancy at another location or vacates the mobile home for any reason whatsoever.
4. Each mobile homeowner is responsible for their own well-being and welfare and will not be permitted to remain in the community if they become physically unable to care for themselves or the home and becomes a burden on other mobile homeowners.
GUESTS
1. Guests staying with a homeowner for more than fifteen (15) consecutive days or thirty (30) days per year must be forty-five (45) years of age or older and are subject to approval by management in accordance with the same standards that the Woodall’s Village would apply as Requirements of entry for prospective mobile homeowners. An additional charge shall be made per person, per month for each person in excess of two (2) persons per mobile home. Said additional occupant fee, and the method of any increase thereof, is set forth in the Prospectus. The maximum number of persons per mobile home is four (4). There shall be no more than two (2) persons per each bedroom of a mobile home. Mobile homes are intended to be occupied by a single family only. The mobile homeowner is prohibited from renting and subletting any room or portion of the mobile home on the mobile home lot. Boarding or rooming house enterprises, operations or practices of any kind are prohibited in the community.
2. Homeowners are responsible for registering their guests upon arrival and notify management when the guests depart. All persons, except relatives by blood or marriage who are forty-five (45 years of age or older, visiting with a homeowner and staying overnight must stay with the homeowner who is being visited and such homeowner must be present and in current occupancy of the home at the time of such person’s visit.
3. All overnight guests must be registered and are welcome to use community facilities as long as they comply with all Rules and Regulations. Homeowners are responsible for seeing to it that their guests comply with Rules and Regulations. Such homeowners shall be financially responsible for any damages or injuries caused by their guests. 4. Any guest staying with a homeowner more than thirty (30) consecutive days shall be considered an applicant for permanent residency in the community, and shall be subject to the Rules and Regulations, including but not limited to the obligation to make application for residency and satisfy the Rules of Entry.
CHILDREN
1. For the purpose of these Rules, all persons under forty-five (45) years of age are classified as children.
2. Children are welcome at Woodall’s Village. Homeowners are financially responsible for any damage to community or private property caused by their juvenile guests.
3. Children are welcome to visit up to fifteen (15) consecutive days or thirty (30) days per calendar year, provided the homeowner is present.
4. Children must confine their activities to the home of the owner they are visiting and must be accompanied by the homeowner in all other areas of the community. Absolutely no playing in the streets.
5. Children are not permitted to take part in activities such as card games, bingo, dances and are not permitted on shuffle courts unless accompanied by a homeowner and at such times as no adults are waiting to play.
PETS
1. All pets must be approved by Management before they will be permitted in the community. When a written application is submitted, the resident shall bring to management proof that the pet has a valid and current pet license and has received all of the required vaccinations and inoculations. The resident shall be required to provide to management annually proof of a current pet license and vaccinations and/or inoculations as required. This documentation shall be copied and presented to the park within fifteen (15) days of the renewal date of any pet license and/or vaccination and inoculation requirement. Any Resident that currently has a pet must register their pet with management and complete the pet agreement.
2. A pet shall be limited to and defined as a domesticated cat or dog or bird of fish. Exotic pets such as birds or fish are not restricted as to number; however, noise and containment shall be the responsibility of the pet owner. Wild or exotic cats such as cougars or lynx or similar are not permitted in the Community whatsoever. Snakes or other reptiles, such as boas or constrictors, vipers or any other species having the potential to harm humans or domestic pets are prohibited. Arachnids and anthropoids, such as scorpions or spiders having the potential to harm humans or domestic pets are prohibited.
3. Certain breeds of dogs shall not be allowed, under any circumstances, including but not limited to Pit Bulls, Chows, Wolf Hybrids, German Shepherds, Rottweilers, Bull Dogs, Boxers, Doberman Pinschers, or any dog bred or trained for hunting or as an attack dog. Management shall have final determination of the acceptability of any pet under this Rule. Excepted from this Rule are dogs, such as seeing-eye dogs, trained and certified to assist disabled or impaired residents and/or approved occupants.
4. No pet with a history of biting, attacking, clawing, or barking shall be allowed or approved. Any resident who has been previously sued because of damages caused by any pet for which approval is being requested shall be denied permission for such pet to be brought into the community.
5. A maximum of two pets (dogs and cats) per home site is permitted. Each home is limited to one cat and one small dog or two dogs or two cats. Pets shall be limited to up to 25 lbs. each at maturity.
6. Any resident who has been otherwise approved to have a pet reside in their home must have a resident’s insurance policy for liability coverage to persons and/or property damages that could possibly result from the conduct and behavior of the pet and must list the Park as coinsured. The resident also agrees by a pet being approved to indemnify the Park, its owners and management, for any and all liability claims whatsoever involving the actions of the pet, including but not limited to damages, medical expenses, assessed attorney’s fees and Court costs, and incurred attorney’s fees and Court costs expended by the park to defend against said claims.
7. All pets must have been neutered prior to being approved for entry into the community. A copy of a veterinarian’s statement to that effect shall be filed by the resident with the written application for approval of such pet. If such pet is too young to have been neutered, a veterinarian’s statement must be tendered to the community showing the age and date when neutering is first possible, and, thereafter the resident must show proof that said pet was neutered within thirty (30) days of that date as established by the veterinarian.
8. Pets shall be kept on a leash and accompanied by the owner while outside the home. Pets shall not be tied up outside the home and left unattended. Pets shall not be walked on anyone else’s yard, vacant sites, median strips, or community recreation areas. No messes will be tolerated on lawns, public areas, driveways, roads, or parking areas. In the event of a mess made by any pet, the owner must clean up the mess immediately. Pets are never allowed in the recreation area, laundry, or other community buildings. Service dogs as trained and certified by an appropriate agency shall not be unduly restricted.
9. The resident shall not permit or allow an approved pet to bark, wail or emit any noise or sounds to such an extent that the surrounding residents have their peace and quiet disturbed. If management receives written complaints from two (2) or more occupants of separate mobile homes within any thirty (30) consecutive day period concerning the conduct of an approved pet, Woodall’s Village Rules the resident shall be furnished with a written notice of violation of these Rules. If, within thirty (30) days of a written notice, management receives an additional complaint or complaints regarding the same pet, or if management receives written complaints from three (3) or more occupants of separate homes concerning the conduct of the pet, the approval of the pet shall be revoked, and the resident having the pet shall have thirty (30) days thereafter to remove the pet from the community. Upon receipt of the fourth written complaint, then management shall revoke the resident’s permission to have such pet, and the resident shall have thirty (30) days thereafter to remove the pet from the community.
BOATS, VEHICLES AND TRAFFIC
1. The speed limit in Woodall’s Village is 10 MPH. Please advise your guest. Remember: Pedestrians have the right-of-way!
2. Overnight parking on the streets is prohibited. Guests may park on streets for a brief period, if the flow of traffic is not disrupted or the ability of other homeowners and occupants to enter or leave their driveways is not made unreasonably difficult. Overnight parking at the Recreation Hall is prohibited.
3. Trailers, boats, boat trailers, travel trailers, utility trailers, trucks, commercial or Non passenger vans, campers and motor homes are not allowed to be parked or stored on the homeowner’s lot at any time. Storage for these items is available in Woodall’s Village at a separate location. A monthly fee is charged for use of this storage area.
4. Repairing or overhauling of cars, outboard motors, boats, or other items within the residential area of the community is prohibited.
5. Woodall’s Village specifically reserves the right to restrict the operation of all delivery transportation or other vehicle traffic control within the community which the management deems to be detrimental to the interest of safety and traffic, the well-being of the other homeowners and the preservation of the grounds and roadways of Woodall’s Village.
6. Inoperative and/or unlicensed motor vehicles are prohibited. Every home, motor vehicle, boat or any other vehicle required to be licensed by the State of Florida must have a registration for the current year.
7. Illegally and/or improperly parked vehicles may be towed by the community at the expense of the party owning or in possession of said vehicle.
RECREATION FACILITIES
1. The homeowner must accompany visitors using any of the recreational facilities.
2. Residents and guests using the recreational areas must be properly dressed. Men shall wear shirts in the recreational area and all common areas. No homeowner, occupant or guest may wear bathing suits in the recreational and common areas of the community excepting the pool area.
3. Children are not permitted to play in the Recreation Hall.
MISCELLANEOUS
1. Management cannot be responsible for phone calls. However, in the event of an emergency, every effort will be made to contact those homeowners who do not have phone service. Please leave your telephone number at the office. Do not have mail sent to the office, as management cannot be responsible for mail. Please have mail forwarded by your postman or held at the post office if away from the community.
2. Excessive noise will not be tolerated. Televisions, radios, stereos, phonographs, and other noise-making instruments must be turned low before 8:00 AM and after 11:00 PM.
4. Improper conduct of any kind, such as to create annoyances, nuisances, indecency, or disorderly conduct will not be permitted and will be cause for eviction from Woodall’s Village.
5. All solicitation, peddling or commercial enterprise of any kind is banned from the community, with the exception that homeowners shall have the right to canvas, solicit and assemble as allowed by Florida Statutes 723.054 and 723.055.
6. All complaints, suggestions and recommendations must be written, dated, signed, and presented to management.
7. Park residents, additional occupants, guests, and invitees are responsible for their conduct. The homeowners, additional occupants, guests, and invitees shall not assault, batter, harass, attack, verbally abuse, argue with and/or physically accost management, agents and/or employees. Any violation of this Rule shall be deemed by management to be an act which endangers the life, health, safety, and peaceful enjoyment of the community by its residents.
8. The Rules and Regulations of the community may be amended, changed or modified with ninety (90) days prior written notice to the homeowners.
9. Do not pour cooking oil or grease down the drain. Place in can and put in garbage can. Also, do not flush foil, paper towels, tampax and other foreign matter down the drain.
10. Report vandalism of private or community property to management promptly.
11. Woodall’s Village may evict a homeowner for one (1) or more of the following grounds found in §723.061, Fl.Stat., as amended from time to time.
RESPONSIBILITIES
1. The owners and management of Woodall’s Village shall not be liable or responsible for loss or injury to life or property caused by accident, fire, theft, act of God or any other cause whatsoever.
2. The owners and management of Woodall’s Village shall not be liable or responsible for accident or injury to life or property through homeowner’s use of any recreational facility. Homeowners, occupants, and guests avail themselves of these facilities at their own risk.
3. Homeowners are liable and responsible for damages caused by their family and guests.
4. Homeowners must conduct themselves and require other persons on their premises with their consent to govern themselves in a manner that does not unreasonably disturb their neighbors or constitute a breach of peace.
5. Management shall have the right of access to the homeowner’s home only to prevent imminent danger to the occupant or the home. Management shall have the right to enter on to the lot for purposes of repair and replacement of utilities and protection of the Woodall’s Village at all reasonable times.
6. The right of Woodall’s Village contained herein are cumulative. Failure of the community to exercise any right shall not operate to forfeit any other rights of Woodall’s Village. No waiver of any Rule or Regulation shall be deemed to constitute or imply a further waiver of any other Rule or Regulation.
RV RESIDENTS
The Rules and Regulations previously defined apply to all RV residents, as applicable, with the following additions:
1. Alterations to the lot are not permitted without the management approval.
2. Each RV shall be a minimum of eighteen (18) feet containing complete shower and toilet facilities.
3. Management reserves the right to relocate RVs for any reason determined as necessary.
4. RVs are not permitted in the community year around without management approval. A secure area is available and may be rented for a charge.
5. RV’s exceeding two (2) occupants shall have charged an additional rate per person per week.
6. Renting and reserving of lots for the following year starts in November. A deposit is required to guarantee site and rates for the next season.
SWIMMING POOL
1. NO LIFEGUARD ON DUTY. SWIM AT YOUR OWN RISK
2. NO DIVING AT ANY TIME.
3. No running or horseplay.
4. No food or drinks allowed within five (5’) feet of the pool.
5. Absolutely no glass of any kind permitted in the pool area.
6. No alcoholic beverages allowed in the pool area.
7. Excessive noise is not permitted in the pool area.
8. No animals allowed in the pool area at any time.
9. In case of emergency in the pool, contact 911 immediately and then the Park management.
10. The pool is for residents of Woodall’s Village and their guests, only.
11. Guests must be accompanied by a resident at all times while using the pool.
12. Children under the age of 18 years must be accompanied by an adult at all times while in the pool area.
13. Please shower before entering the pool. The removal of oils and lotions will improve the water quality.
14. Safety devices are available in the pool area. Be aware of them and promote safety.
15. Children wearing diapers are not allowed in the pool. All persons utilizing the pool must wear appropriate bathing attire.
16. Air mattresses, flotation devices, masks and snorkels are not allowed when the pool is occupied by more than ten (10) persons.
17. Volleyballs, Frisbees and all other items that are intended to be thrown are not allowed within the pool area at any time.
18. Everyone has different taste in music. Therefore, we ask that if you want to listen to your favorite music that you listen with a headset.
19. Swimwear cover-ups, shirts and shoes are required to enter the Recreation Hall or Office.
