Terms & Conditions
DOMINION OAKS RV PARK, LICENSE RELEASE AND INDEMNITY AGREEMENT:
Welcome to Dominion Oaks RV Park. We are glad you have chosen our RV Park for your visit and want to ensure that your expectations are compatible with ours.
The undersigned and all members of his/her party, hereinafter referred to as “Licensee” acknowledges RELEASE OF LIABILITY through this License, Release, and Indemnity Agreement (“the Agreement”), and wishes to utilize and enjoy certain real property located in Bexar County, Texas owned by Dominion Oaks RV Park (“Owner”). For good and valuable consideration, the receipt and sufficient of which is hereby acknowledged, Owner grants a non-exclusive, temporary, and revocable license to Licensee to enter upon real property located in Bexar County, Texas operated by Owner as an RV Park subject to the terms and conditions set forth below.
Licensee is aware that outdoor activities (such as hiking) and the use of any equipment, shelter, or other facilities (including, for example, use of outdoor activity equipment, campfires, pavilions and grills) can be hazardous. Licensee is also aware that natural occurrences (such as lightning, high winds, rainstorms, and flash floods) and wildlife (such as pigs, poisonous snakes, and harmful insects) can be unpredictable and dangerous. Licensee should take all precautions to keep their possessions safe, i.e. locks on trailers, bikes, etc., Park is not responsible in cases of theft or damage to possessions at RV site or in storage areas or overflow parking area.
Additionally, licensee agrees to indemnify the RV Park, its owners, members, managers, officers, and employees or operators against any claims resulting from flooding. Licensee is aware that Park is not responsible for any loss due to fire, windstorm, flood, accident or theft. The Park does not maintain insurance on the property, trailers, contents, etc. of the Licensee or their guests.
Licensee acknowledges that Licensee has read and will adhere to these terms and further agrees to abide by any rules or regulations and to follow any guidelines or instructions that the owners, managers, officers, and/or operators of Dominion Oaks RV Park, may provide orally or in writing. Licensee also understands that Licensee can be asked to leave the property, without refund, for failure to follow the stated rules and policies. A copy of which, is below and posted at Dominion Oaks RV Park.
Licensee understands that adhering to rules, regulations, guidelines, or instructions does not guarantee Licensee’s safety. Licensee hereby assumes all risks of injury, loss of life, and damage to persons or property (including pets). Licensee further releases, indemnifies, and holds harmless the Owner as well as the Owner’s, members, managers, officers, and employees or operators, from and against any and all liabilities, claims, demands, costs, losses, expenses, or compensation of whatever nature in connection with any loss, damage, or injuries to persons and property caused or sustained by Licensee, or members of Licensee’s party including pets.
Licensee assumes all risks and responsibilities for the safety and well-being of all minor child(ren) and is entering into this Agreement on behalf of such minor child(ren). Additionally, Licensee understands that by signing this Agreement, all adults in Licensee’s party, either day or night guests, shall abide by the stated rules, and Licensee will be responsible for their actions. Further, Licensee shall disclose all animals in Licensee’s party, provide proof of rabies shots for each if requested by management, and shall be completely responsible for the actions of such animals.
Licensee acknowledges that if Licensee’s RV is being stored at Dominion Oaks RV Park even if Licensee is not physically present at the Park the terms of this Agreement still apply. Dominion Oaks RV Park is a travel park offering camping on a temporary basis, NOT a residential community. This document provides Licensee with a revocable temporary license to access the real property, which may be revoked at any time for any reason. Additionally, Licensee agrees to maintain a separate permanent residence address for the duration of Licensee’s stay. This license does not create a tenancy or residency or any other real property right in favor of the Licensee.
Licensee’s signature signifies that Licensee has read and understands the above and agrees to pay for all reserved and used site fees or site damages with the credit/debit card on hold or cash. Licensee’s signature below confirms that Licensee has read and agrees to abide by all rules and policies at Dominion Oaks RV Park, including any special rules enacted in cases of emergencies, verbal or written.
In the event Licensee becomes incapacitated or is unable to give instructions or otherwise make Licensee’s wishes known, Licensee gives the Owner and any of its agents, representatives, or other persons acting on its behalf, full power and authority to make any decisions, contact any persons, or otherwise perform any actions that they may deem necessary and appropriate under the circumstances. Licensee specifically understands and acknowledges that Licensees giving of such authority does not create any obligation on the Owner to make any decisions, contact any persons, or otherwise perform any actions on Licensee’s behalf. Licensee hereby releases, indemnifies, and holds harmless the Owner from and against any and all liabilities, claims, demands, costs, losses, expenses, or compensation of whatever nature in connection with any action taken or not taken on Licensee’s behalf.
This License, Release, and Indemnity Agreement is binding for Licensee, Licensee’s heirs, agents, personal representatives, successors, assigns, and other persons acting or purporting to act on Licensee’s behalf. Licensee or Licensee’s estate will reimburse the Owner for any and all costs and attorneys’ fees in defending any lawsuits or claims filed by the Owner or the Owner’s representative. This license for an RV site is in effect from the arrival date for the length of the entire stay. Licensee agrees to comply with all the policies and regulations set forth by the Owner including but not limited to the following:
ALL CHILDREN under 18: Must be accompanied by an adult. Parents are fully responsible for the behavior of their children at all times.
CHECK INS are from 1:00PM to 5:00PM. Since we have limited lighting at night we do not allow after-dark or after-hours check-ins out of consideration for our Licensees/guests, quiet time and for your safety, so please plan ahead. With advance notice we may be able to accommodate an early arrival if the site is available. Please contact the office if you will be arriving early.
CHECK OUT is at 12:00 PM. If you would like a late departure up to 1 pm, there will be a charge of $10. Any departures after 1 pm will be charged 1 day’s daily rate. All late departures are based on availability. All personal items must be removed from the site when you depart. Guests will be charged a $30 site clean up fee (on their credit card on file) if personal items or trash are left on the site. If you leave the property without settling your fees due, either site or electric, we reserve the right to immediately charge your designated payment method for all fees, expenses or damages. You will be emailed a receipt to your address on record.
Restrooms & Laundry Hours: For the comfort of all our guests, restrooms & laundry are open 24/7 except for a temporary closing for cleaning once a day. Laundry is free of charge for all guests (No coin laundry). Please do not leave your laundry unattended. We are not responsible for accidents or theft. NO SMOKING is allowed in the building or restrooms at any time! Failure to comply with this rule will result in immediate removal from the park.
RATES: All rates are for 2 people. A $5.00 per day, $25 per week, & $50 per month charge for each additional person age 18 & above, will be added. Reservations with more than 2 adults are not allowed for extended stays longer than one week.
Cancellation Policy: A 3% processing will be charged for all cancellations.
Extended stays (Monthly):
Cancellations 30 Days or More Before Arrival:
Reservations canceled at least 30 days before the anticipated arrival date will receive a full refund minus a 3% processing fee.
Cancellations 7-29 Days Before Arrival:
Reservations canceled between 7 and 29 days before the anticipated arrival date will incur a cancellation fee of $99.
Cancellations within Less Than 7 Days of Arrival:
Reservations canceled less than 7 days before the anticipated arrival date will not receive a refund or credit.
Short-term stays (Daily/Weekly):
Daily reservations: There is a standard 3 day cancellation policy. You must cancel at least 3 days before arrival date. A one-night charge will be assessed if a reservation is not canceled within the applicable time frame.
Weekly reservations: You can receive a refund (minus a 3% processing fee) of your total fee ONLY IF you cancel at least 7 days in advance of your original reservation arrival date. Cancellations made within less than 7 days of your arrival have NO refund.
No-Shows/Early Departures:
No-Shows:
Guests who do not show up for their reservation (“no-shows”) within 24 hours from reservation time will not receive a refund or credit.
Early Departures:
No refunds or credits will be issued for early departures.
Refund Policy:
No Refunds After Check-In: No refunds will be issued after the guest has checked in, regardless of the circumstances.
Rule Violations: Refunds will not be granted if a guest is asked to leave the premises due to failure to follow the park’s Rules & Regulations or for disorderly conduct.
Management Discretion: The Park Manager or Owner reserves the right to assess and grant refunds on a case-by-case basis at their sole discretion. Exceptional circumstances may be considered, but the decision of the management is final.
Unforeseen Events: Refunds will not be issued for cancellations or early departures due to unforeseen events, such as natural disasters, pandemics, or other situations beyond the control of Dominion Oaks RV Park.
Weather-Related Cancellations: Refunds will not be provided for cancellations or early departures due to inclement weather.

A 10% Discount is available for active duty/military veterans on daily/weekly reservations only.

PET POLICY: (This section applies to RV Park only NOT RV & BOAT STORAGE). IF your pet/animal is approved and/or registered with the RV Park it may remain but Licensee is responsible for their behavior, waste, and noise level. A max of three pets (two if they’re over 50lb) are permitted. Pet waste must be picked up anywhere in the park. Violators will be fined $20 and after 2nd violation will be asked to leave the park.
a. Licensee agrees to clean up after his or her pet/animal and to be considerate of other RV park Licensees. Licensee is liable for any damage or injury caused by his or her pet/animal, including charges for not picking up their dogs’ poo as seen on Park video cameras or by staff or guests.
b. Pets must be on a hand-held leash (NOT TIED OUT IN THE YARD- according to local law) at all times. Watch your pet and keep them leashed at all times while outside. This helps you, your pet, visitors & guests and other pets in the park to stay safe.
c. Pets must not be left unattended outside the RV at any time. Leaving your pets unattended is dangerous for your pet as many factors including weather, power outages, etc. can affect your pet’s well-being while you are away.
d. No outdoor kennels, tie out leashes, fences, dog houses or pet pools are permitted.
e. Pets are not allowed in the buildings, laundry rooms or restrooms. County code laws do not allow pets in our building or pool area.
f. No aggressive dogs allowed. Dominion Oaks has a strict 1-strike-you-are-out policy regarding violation of pet rules. If your pet acts in an aggressive or problematic manner, park management reserves the right for the animal to be removed immediately. Due to the insurance liability, Dominion Oaks RV Park does not allow any variation of Pitbull, Staffordshire Bull Terrier, American Bull dog, Rottweilers, or more than 3 dogs per site. Aggressive pets (or those perceived to be such) may lead to termination of stay in the RV Park. Any Licensee with a dog breed who shows aggression or one of the aforementioned breeds will prevent you from registering into the Park.
g. Licensees have access to the dog park which is the only acceptable area for dogs to be off leash. Please watch your dogs closely in the park so you notice where they leave poo so you can pick it up.
h. An unregistered pet/animal is grounds for immediate removal of the animal if it cannot be approved in accord with RV Parks terms for pets/animals. This may include departure of Licensee in some cases. Excessive barking, not picking up after a dog, or any signs of aggression will not be tolerated. Owners of loose or annoying pets are in breach of their license and will lose their pet privilege or must vacate. Visitors to your site are not permitted to bring pets.
i. Although the same policies apply we welcome all well-behaved service animals.
QUIET TIME: No disturbing noises, (stereos, musical instruments, yelling, honking, barking dogs, etc.) at ANY time. Be especially considerate during the quiet hours of 9 PM to 8 AM. Anyone playing loud music will be warned once & then asked to leave without refund.
MAIL: (This section applies to RV Park only NOT RV&BOAT STORAGE) All packages received here are kept in the package rack in the Clubhouse office. Check for packages daily. We will try our best to inform you of your mail recievd at the office. If you are not comfortable receiving them in this manner or are not able to pick up daily, please feel free to get a post office box nearby. This address cannot be used for bills, official documents like licenses, insurance, business or work related letters, titles or with civil authorities except with prior approval. Any mail that falls under these categories will be returned to the post office.
VISITORS: (This section applies to RV Park only NOT RV&BOAT STORAGE) All vehicles visiting you MUST register each time they visit, with the office, by phone or text (210)201-3701 (Vehicle description, # of guests, site number and guest visiting). If a visitor arrives after office hours you must inform the office via email or text to office phone number providing vehicle description, # of guests, & which site & guest they are visiting. Visitors must park at your site or in the over flow area by the office and preferably be met there by the Licensee. Only guests registered & paid on your site may stay overnight. Visitors who wish to stay overnight must be registered as an additional guest and licensee will incur additional fees of $5.00 per night if total occupancy of the site exceeds 2 persons. Visitors of RV area not staying overnight should be out of the park during quiet time before 9 PM or the vehicle may be towed. Licensee is responsible to inform Guests or visitors of all policies of this License Agreement prior to entering the RV park. Note: a registered/paid guest is the responsible party for all registered persons attached to this license and any visitors. A visitor is anyone over and above those registered on this license. Visitors may not bring any pets onto the premises. It is an insurance and legal requirement that all vehicles and persons in the park be signed in whether in-person or online. Unregistered guests are not allowed access to park facilities without permission including restrooms & showers. Granting unregistered guests access to park facilities without permission will result in you being asked to leave without a refund.
FIREARMS are strictly PROHIBITED in the Park (including pellet and B.B. guns). The use of archery, paintball, slingshots, or air guns is also prohibited. Fireworks (sparklers, smoke bombs, aerials, & firecrackers) are also prohibited. Please do not disturb wildlife. If these items are seen OUTSIDE or your RV, you will be asked to leave immediately without a refund.
FIRES: Campfires are not permitted except when supervised with permission by campground staff in a designated firepit area. County requires advance permission to be obtained by the park each time a fire is lit. Cutting of trees and plants is prohibited. Grills may be lit when not under County ban. When grilling, please be considerate with the direction of any smoke so it doesn’t disturb neighbors. Do not put BBQ’s on picnic tables unless you have a fireproof, grease proof pad under the grill. No open flame heaters allowed in your RV at any time.
Digging: No digging is allowed in the park unless approved by Management or City.
RV Site: If your items or vehicles are in an adjoining site an additional fee will be charged. Parking on OR blocking empty sites is prohibited. This can/will result in a daily rate charge or towing of your vehicle at your expense. Please do not put rugs on the grass or park on the grass, only on the pad. No pools. No fences or kennels. Make sure you only pull your RV into the site as directed by staff, with utilities on the drivers side. Any items on the site that, in management’s opinion, cause a negative impression of the site or the park are subject to being removed and discarded. Fees will be charged and you may be asked to leave if park personnel must clean your site. Park is not responsible for damage, while mowing, to any personal items left in the site. Any satellite dishes must be in an approved location, please ask BEFORE installation, they must NOT be on the grass. Management reserves the right to ask you to leave if vehicles parked on your site or anywhere on the premises carry unpleasant trash or waste material or if vehicles look trashy as park has standards on appearance.
GO-CARTS, ATV’s, DIRT BIKES, and MOTOR SCOOTERS: PROHIBITED in the park except the entrance road or for a park-operated service vehicle. Motorcycles are only permitted between your site and the entrance road & must remain at idle speed inside the park. Motorcycles may not be operated after quiet times from 9 PM to 8 AM.
VEHICLES: (This section is for RV Park only NOT RV&BOAT Storage). All vehicle must have current registration and Insurance. Each RV may park ONE vehicle in most sites unless the site can fit two vehicles safely. Motorbikes ARE vehicles. Extra vehicles above ONE are $35/month each if they do not fit on the site and must be parked in the storage area. All vehicles must be parked in designated area, in operating condition, have a current registration, inspection & insurance. Only two vehicles in addition to the camping unit are permitted in the park unless they are parked in the dry storage area ($75 & up per month.) Others will be ticketed and towed at your expense. No overnight parking of any vehicles allowed in the guest pakring area outside the gates near the office except with pemission from the management.
Vehicle Repairs: No vehicle repairs shall be made on the premises. Only minor local mobile RV repair services can come out to your site to assist you. Major structural repairs are not allowed at any time. Those with Diesel engines, please be respectful and keep your engine noise to a minimum. Please inform the Park upon reservation if you have an electric vehicle (EV.) RVers with EVs will be charged separately for their electric use.
EXTRA VEHICLES including any and all vehicles in dry storage. A boat, trailer, dolly, motorcycle or any other vehicle beyond one per site is subject to additional fees and must be parked in an area designated by the park. Owner reserves the right to require an additional storage agreement and all vehicles must show proof of insurance and valid registration and must be in the name of the site occupant. Extra vehicles must be in good condition & have insurance and license plates at all times. Park is not responsible for any loss to vehicles or toweds due to hail, winds, trees, theft, fire or flood.
RV/BOAT STORAGE: This Section applies to RV & BOAT Storage customers only. Licensee acknowledges that if Licensee’s RV is being stored at Dominion Oaks RV Park even if Licensee is not physically present at the Park the terms of this Agreement still apply. These include but are not limited to:
a. Stored item must have insurance and you agree that regardless of coverage being denied by said insurance that you will be totally responsible for any damage, theft, acts of God or anything befalling your stored item. We strongly suggest you have a hitch lock on your RV that is secure and strong.
c. Stored item must be in decent condition throughout your stay.
d. Please advise staff or office in advance of your arrival if you intend to visit or remove your stored item and please arrange any visits BEFORE dark.
Licensee understands that this boat & RV storage facility and/or its management and/or its owners:
Are not responsible for loss or damage to stored property.
Do not provide insurance for stored property.
Require that licensee provide their own insurance coverage or be self-insured.
Is a commercial business renting space and is not a bailor or a warehouseman.
1. This rental agreement shall automatically be extended for an additional month at the end of each rental period unless the licensee, in writing, delivers to the owner a notice of intent to terminate this agreement seven (7) days prior to the end of the current rental period. If the licensee occupies the storage unit on the first of the month, the licensee agrees that he/she has agreed to rent the storage unit for the entire month and a full month’s rent shall be due. There is no refund for unused days if you vacate after the first day of the month. Owner is not obligated to send out billing reminders for monthly rental charges. Licensee will punctually pay said monthly rental on the renewal date of each month. On the date of expiration of this rental agreement, licensee agrees to return said premises in as good a condition as when received and with the premises being clean and ready for usage. Monthly rent will be considered late if received 4 days after the renewal date of each month. Each day, beginning with the 4th day after the renewal date, a $50.00 late fee will be charged and gate access will be denied until rent is received. Owner has the right to terminate the licensee’s use of the premises and require the licensee to remove their property within ten (10) days unless the owner deems the property to be a health or safety risk in which case the owner will consider it an emergency and may exercise their right to remove the property from the facility immediately. Licensee understands and agrees that NO ITEMS may be stored on the grounds of their rental space and no storage cabinets, bins, or other storage containers may be placed on the grounds of their rented unit.
2. The rental space shall be used and occupied only for the purpose of storing Licensee’s lawful property and for no other purpose specifically. The rental space shall not be used for any illegal purpose or for the storing of any illegal items or property. All property kept, stored or maintained within the premises by Licensees shall be Licensee’s sole risk. Bulk storage (such as grain, fertilizer, etc.) is prohibited. Flammable fluids, hazardous waste, explosives, perishables, live animals, antiques, collectibles, items with sentimental value, and those with no immediately determinable replacement value are also prohibited. There shall be no living in the storage and/or repair work done on the premises. The safety of items stored by the Licensees is the responsibility of the Licensee.
3. Insurance which may be carried by owner against loss or damage to the building or its contents or other improvements situated on the premises shall be for the sole benefit of the parties carrying such insurance under their control. Licensee agrees to indemnify owner and hold owner harmless from any loss expenses and claims arising out of any damage, injuries, or death which he causes or which third parties on the premises with the acknowledge, consent and approval of Licensee cause. Owner shall not be liable to Licensee for any loss or damage that may be occasioned by or through the act or omission of other Licensees on the premises or of any other third person. Owner shall not be responsible or liable to Licensee or any their party for losses or damages resulting from theft, water, mold, mildew, extreme temperatures, fire, rain, storms, tornado, explosion, riot, rodents, civil disturbances, insects, sonic boom, land vehicles, unlawful entry, smoke, wind, mischief, vandalism, or any other causes whatsoever.
4. On failure to pay the rent and other charges in advance as aforesaid, owner may declare Licensee to be in default and this rental agreement forfeited by giving the written notice of such forfeiture to the address of Licensee and owner or owner’s agent shall have the power to enter and hold, occupy, and repossess the entire premises. Notice shall be in writing and shall be deemed to be delivered whether actually received or not on the part of the United States mail, postage prepaid certified mail with return receipt requested address to the parties hereto at the respective address below their names.
5. In addition to any statutory storage liens allowed by law, owner shall at all times have a valid, contractual lien for all rentals or other sums of money becoming due hereunder from Licensee upon all items situated on the premises and upon the default by Licensee. Owner may enter said premise and take possession of any and all items situated on the premises without liability for trespass or conversion and sell the same with ten (10) days from possession without notice, at public or private sale at which owner or its assignees may purchase.
6. In the event that legal action is necessary in order to enforce any provision of this rental agreement, then Licensee agrees to pay reasonable collection fees and/or attorney fees to the attorney selected by Owner.
7. There will be a $5.00 late charge for the rents received after the anniversary date. There will be a $25.00 service charge for returned checks and Licensee agrees to pay these amounts when rent becomes past due. Owner has the right to deny gate access until said rent is paid. If rental account is brought current the owner shall give gate access. Licensee agrees to pay a minimum of $50.00 or the actual cost if greater than $50.00 for the removal of abandoned items from rented unit. An administrative charge of $50.00 applies if the property in the unit must be sold to satisfy the lien of the Licensee in default. Any past due account will draw interest at the rate of twelve percent (12%) annum.
8. The monthly rental rate, deposit amount, late charge, and returned check charge are each subject to increase on the renewal date of each month. Licensee shall be given thirty (30) days written notice of any such increase and this license shall be deemed to be altered if the Licensee continues his occupancy beyond the effective date of the increases. Notices shall be deemed given when owner delivers email or text messages to Licensee at email or phone number given on license or deposits first-class mail, postage pre-paid to Licensee at address given on license. A new license does not have to be executed for new increase.
9. Licensees shall apprize owner of any changes in mailing address or phone number in writing within twenty (20) days of such change.
10. Owner will have the right in the event of an emergency to enter the premises using whatever reasonable force is necessary.
11. This contract is binding and can only be altered in writing with signatures of both the Licensee and Owner. No oral contracts are accepted.
12. Any rights granted herein to Owner may be exercised by Owner’s Rental Agent or other representative or agent.
13. The covenants fore in contained shall extend to and binding upon the parties hereto, their heirs, executors, administrators, and assigns.
14. This agreement shall be governed by laws of the State of Texas.
ELECTRICAL USE: You are responsible for understanding how many amps you are using in our RV. Amp usage over the 50 AMPs provided can trip your breaker. NO SURGER BOXES ARE PERMITTED! Please be mindful of your amp usage so that you don’t trip your breaker during your stay. Please notify the office for electrical issues. Guests are not permitted to diagnose our electrical pedestals per insurance & safety requirements. Even if you are an electrician, laws prohibit you from working on our pedestals unless hired to do so.
UTILITIES RATES: RV site fees include water, sewer & household garbage disposal. Any electricity used on monthly sites will be billed to the Licensee. Meter readings are taken at the end of each month and upon arrival and departure. The charge for electric is around 0.12 cents/kWh (12 cents) and is calculated by the Owner according to TEX. UTIL. CODE § 184.034. If at any time during the term of this Agreement, Licensee becomes delinquent in the payment of electric services, Owner shall withhold electric services until Licensee pays the delinquent amount pursuant to TEX. UTIL. CODE § 184.036. Generally this applies to all using a site for 2 weeks or longer and also by any guest with an EV, Electric vehicle. All EV’s must be disclosed in advance so you can be reserved in a location where charging is safe and will not hamper the power of other guests.
MONTHLY: (This section applies to RV Park only NOT RV& Boat Storage) If you are a long-term licensee, rent & electricity will be due on the first of every month or due date agreed upon by management. Any payment made after three (3) days from due date will incur a $50 Administrative Fee. Payments more than a week late will incur a $100 late fee. If all payments are not made after a week licensee agrees to vacate the site. If licensee does not vacate the site after a week of no payment, licensee agrees for licensee's RV and all vehicles and personal property to be removed from the RV Park property and towed at licensee's expense.
Background Check: Long-term monthly licensees agree to provide ID and for Dominion Oaks RV Park to run background checks on licensee's ID. You specifically authorize the Park to utilize your government-issued identification (such as a Driver's License or State ID) provided by you to conduct criminal background checks, sex offender registry searches, and eviction verifications.
SPEED LIMIT: The park speed limit is 5 mph. This policy is to keep you, your children, and your pets safe. Speed is monitored by both cameras and radar. Repeat offenders may lose their vehicle privileges under this license and/or be asked to leave the park.
GARBAGE: Dumpsters are for household trash only. Garbage must be placed in plastic bags and tied tightly. Please tie trash bags completely closed and place completely inside the garbage container. Please do not place trash on the ground. Please break up cardboard boxes. No large items (furniture/appliances). No toxic or hazardous substances/chemicals, wires, or oil. Do not leave trash bags or cans outside your unit overnight. Do not send small children to empty the garbage as they cannot reach.
CONDITION OF RV & RV SITE. To help maintain a certain standard of appearance. This section is for RV Park only not RV storage.
a. Park has standards on RV condition for all guests. All RV’s must have current registration & up to date inspection. RV must not be older than 10 years. Exceptions may be granted for well-maintained RV's older than 10 years but requires preapproval (based on submitted photos).
b. Licensee understands that RV must be and remain in good condition and well maintained. If your RV sustains unrepaired wear and tear during your stay, your RV may no longer be able to remain on the site. Before erecting anything on the site, guest must first obtain approval from the park. Park reserves the right to charge for each additional structure on the site.
c. Licensee must keep Campsite neat in appearance and must not create a sense of permanence. This means NO refrigerators, freezers, clotheslines, sheds (unless park property and a permanent part of your site) or storage bins are permitted. LPG tanks over 30 pounds are not permitted and propane tanks outside the RV cabinets are not permitted by order of the railroad commission and fire department. No window unit A/C’s unless approved by management. The area beneath the front of a fifth-wheel may be used for storage, but only if screened with a commercially available cover.
d. No tarps, canopies or tents are allowed on site only RV awnings & RV shade screen awnings in good repair are allowed. Please be careful with opening awnings. Must not be long enough to invade the space of any adjacent RV site.
e. Storage of material of any type under the RV is prohibited unless approved by management. Site must be free from trash and any items other than parks picnic table, a couple lawn chairs and a SMALL BBQ. Anything that prohibits easy mowing should not be on the grass.
f. Management reserves the right to ask Licensee to remove any item on the site.
g. Upon termination or expiration of this Agreement, Licensee agrees to surrender the RV Site to Owner in a similar, condition. If Licensee fails to leave the RV Site in good condition, Owner will assess reasonable charges to Licensee for returning the RV Site to good condition. Licensee agrees that any of these charges can be debited from the card in the system.
INSURANCE. Licensee agrees to carry RV & vehicle liability insurance and comprehensive insurance and current vehicle registration during the term of this document. Licensee will furnish proof of insurance to RV Park if requested for both personal and recreational vehicles. By agreeing to these terms you agree to be personally responsible for all property you bring into the park, whether your insurance covers it or not.
CREDIT CARD ON FILE. Licensee will provide Owner with a valid credit/debit card to keep on file. The card information will be used by Owner in the event that Owner must charge Licensee for cleaning or repairing the RV Site or if Licensee vacates the RV site without paying Owner the total amount due under this License. If Owner uses the card information for the reasons described above, Owner will provide Licensee a statement of account listing the charges at the address guest provides. Owner will also use credit card for automatic payments on the site fee due date. Upon expiration of the credit card, it is the Guest’s responsibility to furnish Dominion Oaks RV Park current information. Failure by guest to notify Dominion Oaks RV Park with current information may result in late fees and ejection if rental and other charges are not timely paid.
RV PARKS RIGHT TO TERMINATE. Owner may terminate this License for any or no reason by providing Licensee a notice for Licensee to leave the RV Site (“License Termination Notice”). Licensee agrees to render peaceful possession of the RV Site to Owner within three (3) days of the Site Services License date provided on the License Termination Notice. The three (3) days’ notice and a refund shall NOT be required if termination is the result of an Act of Default (as defined below). If RV is not removed from the property after a license is terminated, Owner has the right to remove the RV from the site, charging a storage fee or allowing a 3rd party to tow it and charge storage. RV can be reclaimed by paying all past due balances.
DEFAULT BY LICENSEE. The following acts constitute defaults by User (“Acts of Default”):
a. Failing to timely pay the RV Site use rate, outlined above, or other lawful charges when due under this license (eg utility fees, storage, etc).
b. Giving false information to Owner;
c. Licensee or any member of Licensee’s party who fails to comply with this Agreement, such as violating provisions of this Agreement or committing serious misconduct or criminal acts;
d. Remaining on the property after giving notice of termination and intent to vacate; and/or
e. Remaining on the property after Owner gave notice of termination at the end of the term or a Termination Notice.
SEVERABILITY. If any provision of this Agreement is held illegal, void, or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this License shall remain operative and binding on the parties.
NO LIABILITY. TO THE EXTENT PERMITTED BY LAW, LICENSEE AND ANY PARTY MEMBER HEREBY INDEMNIFIES, RELEASES, AND AGREES TO PROTECT AND HOLD HARMLESS OWNERS, ITS OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, OPERATORS AND AGENTS (“RV PARK PARTIES”), FROM AND AGAINST ALL CLAIMS, CAUSES OF ACTION, AND/OR LIABILITY ARISING OUT OF OR RELATED TO LICENSEE’S USE OF THE RV SITE, RV PARKS PROPERTY, AND/OR ANY CONDITION THEREON, WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF OR THE GROSS NEGLIGENCE OF RV PARK PARTIES.
a. Registered Licensees and all other users of this property expressly assume ALL risk of any loss or damage and must carry their own insurance for use in any claims.
RESERVATION OF RIGHTS. The real estate on which the RV Park is located is private property. Owner reserves the right to amend these rules without prior notice to Licensees. Owner further reserves the right to refuse entry on park property to any person and to eject current Licensees without a refund. Owner also reserves the right to refuse to accommodate current and returning Licensees or visitors that have violated the parks rules and regulations and/or have vacated the park without paying all fees. We also reserve the right to refuse
a. This Agreement provides Licensee with a revocable license to the property, which may be revoked at any time for any reason.
b. The below signed Licensee and all other members of Licensee’s party represent that all of this information is true and complete and authorize verification by any means. Licensee and all other members of Licensee’s party acknowledge that an investigative consumer report including information as to the character, general reputation, mode of living, whichever is applicable, may be made. False information given shall entitle Owner to: (1) reject this license; (2) and terminate Licensee’s right of license to a site in accordance with the site use document. False information may also constitute a serious criminal offense under the laws of this State.
RECREATIONAL CAMPGROUND NOT FOR RESIDENTIAL USE. Dominion Oaks RV Park is PRIMARILY A TRAVEL & SEASONAL PARK, offering camping on a temporary basis, and is NOT A RESIDENTIAL COMMUNITY. Although we offer a discount for RV campers who want to stay with us for 28 days or more, we do not offer long-term leases, nor is there an automatic renewal of reservations for campers who have stayed for a month or more—such extended stays are contingent on how well a camper respects our efforts to maintain a park-like environment and a guest can be told by management to vacate the private property at any time.
THEFT OF SERVICE AND CRIMINAL TRESPASS
Vandalism of any kind by anyone in your group (regardless of age) may result in eviction from the park, along with a fine of $500.
ACCORDING TO TEXAS PENAL CODE SECTON 31.04, a person commits theft of service if, with intent to avoid payment for service that the actor knows is provided only for compensation, the actor intentionally or knowingly secures the performance of the service by agreeing to provide compensation and, after the service is rendered, fails to make full payment after receiving notice demanding payment. “Intent to avoid payment” is presumed if the actor absconded without paying for the service or expressly refused to pay for the service in circumstances where payment is ordinarily made immediately upon rendering of the service, as in recreational vehicle parks. That is, any guest who leaves without paying for site services or who refuses to pay for site services when due may be subject to criminal prosecution. We will prosecute any violations under the “THEFT OF SERVICE LAW.”
ACCORDING TO TEXAS PENAL CODE SECTON 30.05, a person commits an offense if the person enters or remains on or in property of another, including a recreational vehicle park, without effective consent and the person had notice that the entry was forbidden, or received notice to depart but failed to do so. That is, any guest who receives notice to leave and refuses to do so may be subject to criminal prosecution. If we ask you to leave, you must vacate RV PARKS property. We will prosecute any violations under the “CRIMINAL TRESPASS LAW.”
Profanity or violence towards other guests or park staff will result in immediate eviction from the park & guests violating rules will not receive any refunds for their stay.
By signing below, Licensee agrees that Licensee’s electronic signature is the legal equivalent of, and enforceable as and to the full extent of, a hand-written signature whether presented in court (state or federal), arbitration, or otherwise. Licensee also acknowledges and agrees to be legally bound by any and all materials Licensee signs electronically as if signed by Licensee in person, in hand-writing. Licensee will not raise any defense or invoke regulatory or statutory claims attempting to invalidate the enforceability of documents based on deliver to or execution by Licensee in electronic form. Licensee further agrees that no certification authority or other third-party verification is necessary to validate Licensee’s electronic signature and the lack of such certification or third-party verification will not in any way affect the enforceability of Licensee’s electronic signature.
