RULES & REGULATIONS

 

Terms of Service

I agree, and shall cause my children, invitees and guests, to abide by the Park Rules, including those rules and policies below and posted on the Premises or otherwise communicated in any manner by Live Oak Point Management. 

I further understand and agree that Live Oak Point Management does not give credit or refunds due to the discomforts of nature. Live Oak Point Management refund policy varies, depending on the timing of the cancellation notice in advance of the reservation date, as follows:  

Whooping Crane Cabin: You must be at least 21 years old to reserve Whooping Crane Cabin. If a reservation is cancelled more than 3 weeks prior to the arrival date we issue a full refund, minus the non-refundable $25 transaction fee; For a cancellation of a reservation more than 2 weeks, but less than 3 weeks, prior to the arrival date 50% of the balance is forfeited.  For a reservation cancelled less than 2 weeks prior to the arrival date, the full amount of the reservation payment is forfeited to Live Oak Point Management. 

RV SITES: You must be at least 21 years old to reserve a RV SITE. If a reservation is cancelled more than 2 weeks prior to the arrival date we issue a full refund, minus the non-refundable $25 transaction fee; or Camp Credit in the full amount can be elected. For a cancellation of a reservation more than 1 week, but less than 2 weeks, prior to the arrival date we issue Camp Credit for 50% of the payment and the balance is forfeited. For a reservation cancelled less than 1 week prior to the arrival date, the full amount of the reservation payment is forfeited. Fees apply per Campsite.

As a participant in a recreation activity, I am responsible for acting within the limits of my ability and heeding all warnings regarding participation in the activity. I will maintain control of myself and any equipment while participating in the activity and will refrain from acting in any manner that may cause or contribute to injury to myself or to others.

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Skellig Fulton Beach, LP, d/b/a Live Oak Point Management: Rockport, TX, its owners and agents (collectively Live Oak Point Management), from any and all liability to me, my children, my invitees/guests, personal representatives, and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of the Live Oak Point Management property, facilities, walkways, amenities, pier/dock, (collectively, the Premises) and any dangers and hazards associated with acts of nature such as changing weather conditions; hurricanes, high winds; thunder and lightning; temperature fluctuations; falling trees; tree limbs, ice; or encounters with wildlife.

I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS Live Oak Point Management, and each of them, from any loss, liability, damage or cost (including attorney fees) they may incur due to injury (including death), damage or loss of property relating to use of the Premises by me, my children, and/or my invitees/guests or due to any incidents that may occur during my stay. I understand that, although Live Oak Point Management makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all persons registered in my party is my sole responsibility. THE UNDERSIGNED UNDERSTANDS AND AGREES THAT THE FOREGOING RELEASE AND INDEMNITY SHALL ALSO RELEASE AND INDEMNIFY FOR ANY CLAIMS ARISING IN WOLE OR IN PART OUT OF THE NEGLIGENCE OR PROVEN NEGLIGENCE OF LIVE OAK POINT MANAGEMENT.  This release and indemnity is further intended to release liability resulting from any conditions of attractive nuisance, and liability resulting from the negligent, deliberate, willful or malicious injuries caused by third parties other than Live Oak Point Management.  This release and indemnity applies during any time that I and/or my child is on the Premises. I hereby further covenant and contractually agree that neither I, my heirs, legal representatives, successors or assigns, nor my child (or his/her heirs, guardians, legal representatives, successors or assigns) will make any claim or institute any suit or action at law or in equity against Live Oak Point Management by reason of the conditions of the Premises, or activities occurring thereon.

As a courtesy, our employees, if so requested, may assist with directing you to your designated campsite. It is your sole responsibility to ensure that the site will accommodate your specific trailer/RV and that you will not hit any branches, bollards, trees, etc. when positioning your RV on the campsite.

The Premises are privately owned and LIVE OAK POINT MANAGEMENT RESERVES THE RIGHT TO REFUSE SERVICE to anyone for any reason except for those prohibited by law. Live Oak Point Management reserves the right to require any person or party it deems necessary, to leave the Premises based on violations of Park Rules or behavior management deems inappropriate or disturbing to others. Harassment or mistreatment of our staff or other guests, including but not limited to, racist comments or hate speech, will not be tolerated under any circumstances. I have read this notice and agree to it as well as all Live Oak Point Management Rules and regulations. In addition, I understand that I am responsible for the actions of all persons registered in my party, including any children, and any guests that visit during my stay. On behalf of each person in my party, I grant Live Oak Point Management and its affiliated entities and promotional partners the right to include any photographic, video and other visual portrayals of each person in my party in any medium and for any purpose.

I understand that I am and remain personally liable to pay the total amount of my reservation prior to my scheduled check-in date, or at such earlier date communicated to me.  If I fail to pay the total due, I agree that Live Oak Point Management may charge any remaining balance (in additional to any damage charges or other amounts owed under these Terms and Conditions) to any credit or debit card on file with my reservation. Any amounts due after 30 days will be subject to the maximum late charge permitted under state law.

Assignment

The Tenant shall not assign this lease or sublet the Premises in whole or part. Tenant is also specifically prohibited from sharing or renting out the Premises through services such as AirBnB, VRBO , etc.

Additional Terms for Whooping Crane Cabin

I understand and agree as follows:

  • At departure, the Whooping Crane Cabin is to be left in a reasonably clean condition (broom swept), garbage is to be removed and placed in an outside dumpster, all kitchen area is to be left clean, all dishes are to be washed and put away, and the microwave, fridge, toaster oven and countertops are to be wiped clean; otherwise, Live Oak Point Management may charge my credit card with a $125 cleaning fee.  I understand and agree that if I leave the rental unit in an unreasonably filthy condition, permit a pet to occupy without notice or smoke, Live Oak Point RV Management may charge my credit card for the cost to professionally clean the rental unit ($250 minimum charge).
  • All damages to the rental unit, whether caused by myself, my children, guests or pets, will be disclosed to Live Oak Point Management immediately. All damages occurring to the rental unit during my stay will be charged to my credit card after a thorough inspection has been made by Live Oak Point Management. Damages for which I will be responsible include, but are not limited to: lost key(s), broken/lost TV/DVD/AC remote controls, broken items, discharged fire extinguishers (if not used for a fire), damaged/dented/bent appliances, furniture, cabinetry or dishes, writing on walls or bedding, and ripped or torn mattresses or covers.

Additional Terms for Long Term Stays (30+ Days) in Rental Units

  • On a recurring basis, I understand and agree that Live Oak Point Management will be able to conduct inspections of Whooping Crane Cabin for routine maintenance to ensure the integrity and longevity of the rental unit with at least 48 hours’ notice.

Animal Policy

I hereby agree to the following regulations and conditions relating to my dog while camping on the Premises with my dog.

  • Excluded Areas. I agree to keep my dog out of the following areas including, but not limited the laundry building and pier/dock.
  • Certain Dogs Excluded. I agree that Live Oak Point Management has the sole discretion to exclude dogs. The basis for exclusion may include, but is not limited to the following: breed-specific exclusions; due to their young age are exempted from state or local law vaccination requirements; are sick; are in heat; are aggressive, vicious, dangerous or potentially dangerous; require muzzling; or are easily frightened or sensitive, resulting in disruptive behavior (such as fighting or biting) in response to a stimulus. The following dogs will not be allowed on the Premises: Pit Bulls, Rottweilers, Doberman Pinschers, Akitas, Chows and Dalmatians. Please pick up after your pets and deposit mess in the dumpster. The following are totally prohibited at all times: reptiles, exotic animals, or any similar type animal.
  • Supervision. I agree to keep my dog on a leash or in a carrier while in all public areas of the Premises. I further agree to have my dog with me or a designated individual at all times, and understand that I may not leave the dog unattended in the cabin or at the campsite. I agree to prevent noise or any other disturbance by my dog, in the interest of other guests on the Premises.
  • Vaccinations. I represent and warrant that my dog is up to date on all vaccinations (including rabies and distemper) and flea treatments.
  • Disturbances. I agree that, should my dog create any disturbances, which cause complaints to be made to the management by other guests or employees of Live Oak Point Management, at the request of a Live Oak Point Management employee, I will immediately make arrangements to house my dog elsewhere outside the Premises. Additionally, I understand and agree that if I do not find alternative housing for my pet after being asked to do so, I will be asked to leave the Premises and will not be issued a refund.
  • Revocation of Rights. I understand that my permission to have my dog on the Premises with me is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms of these rules and other rules in effect at any given time. I understand that Live Oak Point Management may revoke such permission at any time for any reason.

I have read these Rules and Regulations and understand it is my responsibility to abide by the Rules. I further understand that it is my responsibility to ensure that my guests and invitees also comply with the Rules. Failure to adhere to the policies and rules set forth herein may result in my removal from the Premises without a refund.

Golf Cart Use

Golf Cart Rules

1. No personal golf carts allowed on the Premises unless registered before check in.

2. Lessee must be a minimum of 21 years old.

3. Operator(s) of golf cart must be 18 years of age and have in their possession valid driver’s license and proof of insurance. (Moped license, learner’s permit, etc. are not acceptable.) A Guest found driving under the age of 18 will result in the immediate loss of golf cart and no refund will be given.

4. Golf carts operated after sunset must have lights on.

5. No more than 4 persons may occupy the golf cart at any time. No more than 6 persons may occupy a limo golf cart at any time.

6. Familiarize yourself with and observe all traffic rules and abide by them when using the golf cart on the Premises:

 

      ■ Use hand signals when turning or stopping.
      ■ Rental carts cannot be parked in a fire lane.
      ■ Park the golf cart on a level and steady ground.
      ■ Take the key out of the cart when not in use.


Note that the golf cart has forward, reverse, and neutral gears. When in reverse, you should hear a backing horn (buzzing sound). Please contact the property manager with any questions about the operation of the golf cart.

 

7. Except for bathroom emergencies, golf carts cannot be operated during quiet hours (10 pm - 8 am).

8. Golf carts must be operated properly. Speed limit is 5 ½ mph. Horseplay, racing, or other misuse of cart will not be tolerated. Carts are to be operated on Premises roadways only. No driving through campsites or other restricted areas. Golf carts are NOT allowed on any pedal cart track.

9. All passengers must be seated at all times when the cart is in motion.

10. Remove the key when parked and chock the wheels.

11. Violating any of the following rules will be cause for immediate loss of use of golf cart  privilege:

 

■ Underage drivers – anyone under the age of 18 operating the golf cart.
■ Invalid driver’s license or no driver’s license.
■ Reckless driving.
■ Drinking alcohol while driving or driving under the influence of drugs or alcohol.​​​​
      **Per Texas State law, open containers of alcohol are not permitted on vehicles (golf carts included).

Firearms Policy 

I agree, and shall cause my children, invitees and guests to obey all federal, state, and local laws regarding the ownership and possession of firearms. Firearms are not permitted in any property buildings or common areas. The only exception is that I, my children, invitees or guests may have a firearm in a locked, private vehicle in parking areas if permitted by law. The discharge of firearms, BB guns, air guns/rifles, or similar devices is strictly prohibited.

MANAGEMENT RESERVES THE RIGHT TO REFUSE SERVICES TO ANYONE

Check-In 1PM / Check-out 11AM

Daily quite time 10PM to 8AM

Speed Limit: 5MPH at all times

Rates are based on 2 person occupancy and one vehicle per site.  Additional guests 10 years or older $5 per person per night.

Management assumes no responsibility for accidents, injuries or losses from any cause.

Children 15 and under not permitted without adult supervision.

Anyone riding a bicycle after dark must have proper working headlights and taillights on his/her bicycle.

Only driver licensed drivers may operate a golf cart within the RV park; learner permits are not acceptable.  Golf carts must be covered for personally liability and property damage under the owners insurance policy.

No RV rigs older than 10 years.

All RV rental sites must be maintained in a clean and uncluttered manner.

Management must approve all installations such as storage sheds, porches, etc..

Park in your provided space only.  One vehicle per site rental.

The following are not allowed:

Washing of boats, RV or other vehicles.

Mechanical work or oil changes of any kind.

Operation of generators.

Outside clothesline. 

Garbage must be bagged and tied and placed in trash bins.  All boxes must be flattened.

The park is operated on a Septic system.  Please no grease down the sinks.

Please leave the common area clean of debris.

If a hurricane is predicted to make landfall in the greater Rockport area a personal item must be removed from the area around your RV a minimum of 3 days prior to landfall.  Any items left will be removed and disposed of at a rate of $50 per hour.

Monthly guest are responsible for placing their sewer hose inside a PVC pipe or other appropriate support hose system.

NO OPEN FIRE PITS.

NO FIREWORKS OF ANY TYPE.

NO SMOKING IN ANY COMMON BUILDING OR THE WHOOPING CRANE CABIN.

NO TENT OR OTHER TYPE OUTSIDE CAMPING.

Live Oak Point Management reserves the right of eviction of any guest without refund upon the following basis:

Non-compliance of Park policies, rules or regulations.

Verbal or physical threat of another Park guest or employee.

Possession of dangerous or deadly weapons, firearms, fireworks or explosives.

Deliberate damage or destruction of property belonging to another guest or the Park.

Disorderly, immoral or indecent conduct.

The owner and manager of the Park reserves the right to refuse service or to request the departure of anyone who does not comply with these rules and regulations as stated.  We also reserve the right to change or add or modify in any manner the rules at any time.  Disregard of any of the above rules will result in immediate termination of your stay.
