Rainbow Rovers RV Park – Terms, Conditions & Reservation Policies

Welcome to Rainbow Rovers RV Park. We want every stay to be safe, comfortable, and enjoyable for all of our guests. By making a reservation, registering at the office, or occupying a site, you ("Guest" or "Tenant") agree to the terms and policies below on behalf of yourself and everyone in your party. Please read them carefully before booking.


PART 1: TERMS AND CONDITIONS

1. Reservations, Check-In and Check-Out

1.1 Check-In and Check-Out Times. Check-in begins at 2:00 PM and check-out is at 11:00 AM. Early arrivals and late departures are subject to availability and the fees described in Section 4.

1.2 Registration. All Guests and visitors must register at the office upon arrival. Unregistered persons may be asked to leave the property.

1.3 No-Shows. If you have not arrived by 12:00 PM (noon) the day after your scheduled arrival date and have not notified us in writing, your reservation will be considered cancelled. No-show reservations are non-refundable.

1.4 Occupancy. The total number of persons in any space or unit may not exceed the maximum capacity for that site. Additional guests may be subject to additional fees or denied entry.

1.5 Written Notice Requirement. All cancellations, modifications, and move-out notices must be submitted in writing by email or through the Campspot portal. Verbal or telephone notices will not be accepted and cannot be used to dispute a charge.

1.6 Nature of Stay (License, Not a Lease). Guest's stay is a revocable license to occupy a site and use the park facilities. It is not a lease and does not create a landlord-tenant relationship. Guest has no right to exclusive possession of the site, and the Park may terminate the license in accordance with these terms and applicable Texas law. Where a stay is determined by a court to be a tenancy, the Park will follow the notice and eviction procedures required by Texas law.

2. Liability, Insurance and Indemnification

2.1 Responsibility for Damage and Injury. Tenants and Guests are responsible for any damage or injury caused by themselves, their children, their visitors, and/or their pets.

2.2 ASSUMPTION OF RISK, RELEASE AND INDEMNITY. GUEST ASSUMES ALL RISKS ASSOCIATED WITH THE FOREGOING AND WITH USE OF THE PARK AND ITS FACILITIES. GUEST, ON BEHALF OF GUEST AND ALL MEMBERS OF GUEST'S PARTY, RELEASES, WAIVES, AND AGREES TO HOLD HARMLESS AND INDEMNIFY [PARK NAME], ITS OWNERS, EMPLOYEES, AND AGENTS (THE "PARK") FROM ANY AND ALL CLAIMS, LOSSES, DAMAGES, AND EXPENSES, INCLUDING REASONABLE ATTORNEY'S FEES, FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, EVEN IF CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE PARK.

2.3 PARK NOT RESPONSIBLE. THE PARK IS NOT RESPONSIBLE FOR PERSONAL INJURIES, OR FOR DAMAGE, LOSS, OR THEFT OF ANY PERSONAL PROPERTY OR VEHICLE, INCLUDING DAMAGE FROM POWER SURGES, FALLING TREE BRANCHES, SEVERE WEATHER, OR ACTS OF THIRD PARTIES, EVEN IF CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE PARK.

2.4 Guest Insurance. Guests are required to carry their own insurance on their RV, vehicles, and belongings. We strongly recommend verifying that your policy covers campground use.

2.5 Supervision. All Guests must ensure that pets and small children are supervised at all times.

3. Rules of Conduct and Park Policies

3.1 Compliance and Removal. We reserve the right to terminate the license of, and require departure by, any person(s) who do not comply with the rules and policies of the park. Notice to vacate will be given as required by applicable Texas law, and the Park will pursue removal through lawful means, including law enforcement or court process where required. Guests removed for rule violations forfeit all remaining payments and are not entitled to a refund.

3.2 Equipment Standards. All motorhomes, RVs, and travel trailers must be in good working order and appearance. We reserve the right to refuse access to any Guest whose vehicle is deemed unacceptable by park management.

3.3 Mail and Packages. We do not accept delivery of mail or packages for Guests. Guests must arrange for mail and packages to be delivered to a third-party location for pickup.

3.4 Cooking and Fires. Propane grills and propane fire pits are permitted.

3.5 Outdoor Sleeping. Blow-up mattresses, sleeping bags, and cots are not permitted outside.

3.6 Maintenance and Washing. Maintenance on RVs or vehicles is not permitted on the property. Washing RVs or vehicles on the property is not permitted.

3.7 Paint and Chemicals. The use of any paint products or chemicals is prohibited.

3.8 Clotheslines and Trees. Clotheslines are not allowed. Guests may not hang any items from the trees.

3.9 Cleanliness and Trash. All sites must be kept neat and clean for the duration of your stay. All trash must be placed in the enclosed trash receptacles located throughout the property. Do not leave trash outside overnight.

4. Late Check-Out Fees

Check-out is at 11:00 AM. Guests who remain on their site past check-out time without prior written approval will be charged as follows:

11:01 AM – 12:00 PM: $25

12:01 PM – 2:00 PM: $50

After 2:00 PM: Full additional night's rate at the then-current rate

Late check-out fees will be charged to the card on file. Approved late check-outs are subject to availability and must be requested in writing in advance. Guests who fail to vacate after notice may be subject to the remedies described in Sections 1.6, 3.1, and 3.10 and other remedies available under Texas law.

3.10 Theft of Service and Criminal Trespass. Under Texas Penal Code §31.04, a person commits theft of service by securing services (such as a site and utility hookups) with intent to avoid payment, and failing to pay after notice demanding payment. Intent to avoid payment is presumed if a Guest leaves without paying or expressly refuses to pay where payment is ordinarily made immediately, as in recreational vehicle parks. Under Texas Penal Code §30.05, a person commits criminal trespass by entering or remaining on the property of another, including a recreational vehicle park, without effective consent after notice that entry is forbidden or after receiving notice to depart. The Park may report violations to law enforcement and pursue prosecution.

PART 2: CANCELLATION POLICY

We understand that plans change. Because each cancelled reservation takes a site off the market, the following policy applies.

5.1 Cancellation Fee. Every cancellation is subject to a non-refundable handling fee of $25 for daily and weekly reservations, or $100 for monthly reservations.

5.2 Daily and Weekly Reservations.

14 or more days before arrival: Full refund, minus the $25 fee

7 to 13 days before arrival: 50% refund (minus the $25 fee) or 100% Camp Credit, at the Guest's choice

Fewer than 7 days before arrival: No refund; the full amount is forfeited

5.3 Holiday Reservations. For holiday periods, written notice of at least 30 days before arrival is required for any refund. Cancellations received after that date are not refundable.

5.4 Monthly Reservations. To receive a deposit refund, written notice must be given at least 30 days before move-in, minus the $100 cancellation fee. Current monthly Guests must give 30 days' written notice before moving out. Any security deposit will be handled in accordance with applicable Texas law, including any itemized list of deductions required by law.

5.5 How to Cancel. Cancellations must be sent in writing by email or through the Campspot portal. The date and time of receipt determines the applicable notice period. Telephone cancellations will not be accepted.

5.6 Camp Credit. Where Camp Credit is offered, it may be applied toward a future stay at Rainbow Rovers RV Park subject to availability and the expiration date stated at the time of issue.

PART 3: REFUND POLICY

6.1 No Weather or Emergency Refunds. Refunds will not be issued for rain, heat, cold, storms, vehicle or RV breakdowns, personal or family emergencies, illness, or early departure for any reason. We encourage Guests to consider travel insurance.

6.2 Eviction. Any Guest removed from the park for violating park rules forfeits all remaining money paid, with no refund of any kind.

6.3 Refund Method and Timing. Approved refunds are returned to the original credit card used for payment within 5 to 10 business days. Your financial institution may require additional time to post the credit.

6.4 Disputes. Refund requests and disputes must be submitted in writing by email or through the Campspot portal. Verbal agreements or promises made by anyone other than park management in writing are not binding.

PART 4: GENERAL PROVISIONS

7.1 Changes to Policies. [PARK NAME] may update these terms and policies at any time. The version in effect at the time of your reservation governs your stay.

7.2 Severability. If any provision of these terms is found unenforceable, the remaining provisions remain in full force and effect.

7.3 Acceptance. Booking a reservation or occupying a site constitutes acceptance of these Terms and Conditions, the Cancellation Policy, and the Refund Policy.
